HomeMy WebLinkAboutBRU 94 029 conveyance 1/3 robin TIlE CORPORA'!'IOR OF mE '!'OWlISBIP OF BRUCE BY-LAN RO. 94-29 BEING A BY-LAW to amend By-law No. 94-23, which authorizes the conveyance of a one third interest in Robinson street, Tiverton, to the Village of Tiverton. WHEREAS By-law No. 94-23, Paragraph 1, authorized the conveying of that portion of Robinson Street described as: "In the Village of Tiverton, in the County of Bruce being composed of Parcel Streets - 2, Section M-SO, being part of Robinson Street, Plan M-SO shown as Parts 1 and 2 on Reference Plan 3R-4099" to the Village of Tiverton. AND WHEREAS the legal description of Robinson street should only refer to Part 1 of Plan 3R-4099. NOW THEREFORE we amend Paragraph 1 and delete the reference to Part 2 of Reference Plan 3R-4099. That the Reeve and Clerk are authorized to execute the deeds and other documents required to complete this conveyance and to affix the corporate seal as and when required. By-law introduced and read a First time this EIGHTH day of NOVEMBER, 1994. By-law read a Second time this EIGHTH day of NOVEMBER, 1994. By-law read a Third time and finally passed, signed, sealed, and numbered 94-29 this EIGHTH day of NOVEMBER, 1994. ~. THE CORPORATION OF THE TOWNSHIP OF BRUCE Hereinafter called the "Township" OF THE FIRST PART - and - AMBERT WOODROW SCHELL Hereinafter called the "OWner" OF THE SECOND PART WHEREAS the owner represents that he is the registered owner of West Part of Lot 5, Concession 14, in the Township of Bruce, in the County of Bruce and hereinafter referred to as the subject property. AND WHEREAS the Township wishes to erect a sign on the owners property. AND WHEREAS the owner has agreed to such a sign being erected on the subject property. NOW THEREFORE this agreement wi tnesseth that in consideration of the mutual covenants and agreements herein contained and subject to the terms and conditions hereinafter set out, the parties hereby agree as follows: 1. The Township and OWner agree to the design of the existing sign erected in the present location. 2. The Township agrees that no demand will be made upon the owner for any upkeep or removal of the said sign. 3. The Township agrees to pay to the owner a sum of $40.00 annually on the first day of June in each year. 4. This agreement can be cancelled at any time by either party upon ninety (90) days notice.
