BEIMG A BY-LAW to authorize the establishment of a "water works" in the Township of Bruce and to provide for a water works rate sufficient to pay for the capital costs of the said system. WHEREAS the Municipal Act, R.S.D. 1990, Chapter M.45, section 210, P. 98 authorizes the Council of local municipalities to procure investigations and reports as to water works and water supply systems. AND WHEREAS the said Act, Section 221(2) authorizes the Council of a local municipality to pass by-laws imposing a water works rate as a charge for the capital cost of the water works, upon owners or occupants of lands who derive or will derive a benefit from the system. AND WHEREAS the said Act authorizes the by-law for such purposes to designate the land for which the owners or occupants are liable to the rate. AND WHEREAS an engineering study and professional opinion has been received with regard to the necessity, utilization. design and related matters regarding a water supply system known as the Scott Point Water System and the said study has been received and adopted by the Council of the Township of Bruce. AND WHEREAS a water works and water supply system known as the Scott Point Water System has been constructed for the benefit of some of the residents of Registered Plan 790. in the Township of Bruce, County of Bruce, and is fully operational and available for use. NOW THEREFORE be it enacted and it is hereby enacted by the Council of the Township of Bruce as follows: ES'I'ABLIR18IRII'I' OF WATER WORltS 1. (a) The establishment of a water works and water supply system in the Township of Bruce known as the Scott Point Water System, for the benefi t of the I andowners and residents of Plan 790, in the Township of Bruce is authorized and confirmed. THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 94-30 PAGE 2 . (b) The initial payment of all capital costs of the Scott Point Water System, less grants received from the Ontario Ministry of the Environment, in the amount of $204,614.78 which has been paid from the general revenue and reserves of the Township of Bruce, are authorized and confirmed. The owners or occupants of those lands described in Schedule "A" attached to this by-law, being those lots which are serviced by water meters installed as part of the capital cost of the system and being fully connected to the system shall be liable for a water works rate to pay the capital costs of the water works. 3. The owners or occupants of land as described on Schedule "A", are the owners of record of the lands as of November 1, 1994, and the rate shall be binding on their heirs, executors, administrators and assigns. 4. (a) The water works rate on these lands described in Schedule "A" shall be a flat rate fixed charge of $5,351.98 for each separately assessed parcel of land as listed on Schedule "A". (b) Such flat rate fixed charge shall be due and payable within 30 days of the receipt of an invoice from the Township of Bruce for the said charge, provided that such rate may, at the option of the person liable therefore be paid as an annual charge of $535.20 over a period of 10 years commencing December 15th, 1994 and to be fully paid by December 15, 2003. (c) Those persons electing to pay the charge on an annual basis as provided for in Paragraph 4(b) shall pay interest at the rate of 6% per annum on the total outstanding balance of the principal amount and accrued interest owing from time to time. (d) Those persons electing to pay the charge on an annual basis may pre-pay any amount at any time provided that the minimum amount due and owing in any year shall be an amount equal to one-tenth the original principal amount ($535.20), plus interest as hereinbefore provided, until the full amount of all principal and interest has been paid. WATER WORltS RATE - LOTS tJlIICODECTED 5. The owners or occupants of those lands ~described in Schedule "B" attached to this by-law, being those vacant lots which have not had water meters installed and are not yet connected to the system, shall be liable for a water works rate to pay the capital costs of the water works. 6. The owners or occupants of the land as described in Schedule "B" are the owners of record of the lands as of November 1st, 1994 and the rate shall be binding on their heirs, executors, administrators and assigns. 7. (a) The water works rate on those lands described in Schedule "B" shall be a flat rate fixed charge of $5,115.37 for each separately assessed parcel of land as listed on Schedule "B". (b) Such flat rate fixed charge shall be due and payable within 30 days of the receipt of an invoice from the Township of Bruce for the said charge, provided that such rate may, at the option of the person liable therefore be paid as an annual charge of $511.54 over a period of 10 years commencing December 15th, 1994 and to be fully paid by December 15th, 2003. Those lots listed on Schedule "B" shall connect to the system at the time the lots are developed and shall pay such further connection charges and water meter charges as may be authorized by the Township of Bruce at that time.
