BEING A BY-LAW formulating a plan for protecting property and the health, safety and welfare of the inhabitants in any emergency area. WHEREAS the Province of for the Formulation and Ti tIe - The Emergency Municipality; Ontario has passed an Act which provides Implementation of Emergency Plans (Short PI ans Act, 1983) by the Counci 1 of a AND WHEREAS this Act makes provision for Head of Council to declare that an emergency exists in the municipality or in any part thereof and al so provides Head of Council wi th authority to take such action or deliver such orders as he considers necessary and are not contrary to law to implement the emergency plan of the municipality and to protect property and the health, safety and welfare of the inhabitants of an emergency area; AND WHEREAS, the Act provides for the designation of one or more members of Counci 1 who may exercise the powers and perform the duties of the Head of Council during his absence or his inability to act; AND WHEREAS the Act authorizes employees of a municipality to take action under the emergency plans where an emergency exists but has not yet been declared to exist; NOW THEREFORE the Council of the Corporation of the Township of Bruce enacts as follows: 1. That the Emergency Plan entitled "Municipal Emergency Plan for the Township of Bruce, Township of Kincardine and Village of Tiverton - Revision 0, November 1994" on file in the Municipal Office. 2. That Head of Councilor designated alternate as provided in the Plan is empowered to declare an emergency; 3. That certain appointed officials or their designated al ternates as provided in the Municipal Emergency Plan are empowered to cause an emergency alert to be issued to members of the Municipal Control Group and to take action under the emergency plans where an emergency exists but has not yet been declared to exist; and · - THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 95-7 PAGE 2 4. That annual 1 y, the Municipal Control Group wi 11 cause the emergency plan to be reviewed and to make such changes to the Emergency Notification Fan-Out and Emergency Telephone and Resource Directory as are considered appropriate while referring all other changes to Council for further review and approval. FORWARD The combined Municipal Emergency Plan (Revision 0) for the Township of Bruce, the Township of Kincardine, and the Village of Tiverton forms Schedule "A" to Bruce Township By-Law No. 95-7 , Kincardine Township By-Law No. 95-08 , and Village of Tiverton By-Law No. 1995-2 - "A by-law formulating a plan for protecting property and the health, safety and welfare of the inhabitants in any emergency area". The Plan has been prepared to provide key officials, agencies and departments within Bruce Township, Kincardine Township, the Village of Tiverton, the Bruce Nuclear Power Development, and Bruce County, with a general guideline to the expected initial response to an emergency, and an overview of their responsibilities during an emergency, Any emergency situation is unique, so that it is not possible to precisely define the actions required by any local, County, or Provincial agency who may be involved in emergency response. It is important, then, that the elements of this Plan be implemented with common sense recognizing the situation at hand and the capabilities of those agencies involved. For this Plan to be effective it is important that all concerned be made aware of its provisions and that every official, agency and department be prepared to carry out their assigned functions and responsibilities to the best of their ability in an emergency.
