HomeMy WebLinkAboutBRU 95 034 sick leave credit THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 95-34 BEING A BY-LAW to adopt a Sick Leave Credit Policy for the Township of Bruce. _".c WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, Section 207, Subsection 47 authorizes a Municipality to pass by-laws regarding Sick Leave Credit Plans. NOW THEREFORE the Council Bruce deems it expedient established, and enacts as of The Corporation of the Township of that a Sick Leave Credit Policy be follows: 1. That the Township of Bruce sick Leave Credit Policy, a copy of which is attached as a schedule and forms an integral part of this by-law, is hereby authorized and approved by the Council of the Township of Bruce. 2. The Sick Leave Credit Policy will be effective August 1st, 1995. 3. Where there is a conflict with any other by-law or policy, the attached policy will supercede any previous policy. This policy and its terms are to be effective 1st, 1995. credit being August The intent of the policy is to allow full-time staff to: 1. Earn to a credit to a maximum of one and one-half days per month (18 days per year) credit in accumulated sick days. A sick day equivalent to a normal work day (office staff - seven hour day - road's crew - eight hour day). 2. Each month the full-time employee earns one and one-half days less any time used as sick time. 3. The maximum accumulation to be 120 days for any employee. When the maximum of 120 days is reached, no further credits earned. 4. Sick time taken off will reduce the employee sick leave credit. 5. Employees to be paid to the maximum sick leave credit in their favour until the sick leave credit is reduced to nil; No payments will be made by the employer if the credit total has been reduced to nil. 6. Employees unable to work for longer periods of time due to hospitalization, illness or injury will change to long term disability (LTD) when they qualify for LTD (after 17 weeks of short term disability). 7. For sick leave claims longer than three days for hospitalization, illness or injury (HII), the employer can request a doctor's certificate or other evidence satisfactory to the employer of hospitalization, illness or injury. 8. Office staff will keep the ongoing records required to control sick time and this will be in a form satisfactory to Council, and staff shall report to Council as required by Council. ~ ' , ~ ...}. \-.; r .d~;- ¿t ~ sick Leave Credit policy Page 2 9. Sick leave credits can also be used for medical doctor's appointments: a) For any medical doctor appcintment (not to include dentists and optometrists, etc.); b) Some evidence satisfactory to the employer is required to claim sick time for doctor appointments (e.g. an appointment card); c) Employees are encouraged to m~n~lDJ.ze using sick leave credits for doctor appointments so the maximum amount is available to employees to use in the case of a longer term use, such as injury, hospitalization or a longer illness. 10. There is no cash out value to this plan and it terminates without payment if an employee ceases to be an employee. 11. Sick leave payments occur only when the employee is absent from work due to the conditions listed in this policy - (hospitalization, illness, injury or for a qualifying medical doctor's appointment) and the employee is not receiving wages from the employer or another wage replacement plan. If a supplementary wage loss income is available to the employee, then the employer would limit its payment to ensure a maximum of 100% of normal wages are received by the employee. 12. Sick leave payments apply only to absence required for the employee's hospitalization, illness, injury or medical appointments and not for appointments, hospitalization, illness or injury to any other person (family or otherwise). 13. The employee payment will be their regular daily pay for each sick day used (or prorated portion of a day if a full day is not used). 14. The policy subject to change, as determined by Council.
