HomeMy WebLinkAboutBRU 95 035 drainage works THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 95-35 A BY-LAW to provide for a drainage works in the Township of Bruce in the County of Bruce. WHEREAS, the requisite number of owners have petitioned the Council of the Township of Bruce in the County of Bruce in accordance with the provisions of the Drainage Act, R. S. o. 1990, Chapter D .17 , requesting that the following lands and roads be drained by a drainage works: Lot 13, Concession 14 and the North Part of Lot 13, Concession 13, through Lots 11 and 12, Concession 14. AND WHEREAS, the Council of the Township of Bruce in the County of Bruce has procured a report prepared by Maitland Engineering Services Ltd., Wingham, Ontario, and the report is attached hereto and forms part of this by-law. AND WHEREAS, the estimated total cost of constructing the drainage works is $42,800.00. AND WHEREAS, $42,800.00 is the amount to be contributed by the lands and roads in the Township of Bruce for construction of the drainage works. AND WHEREAS the Council is of the opinion that drainage of the area is desirable. THEREFORE, the Council of the Township of Bruce, pursuant to the Drainage Act, R.S.O. 1990, Chapter D.l?, enacts as follows: 1.0 The report, dated June 1995, is hereby adopted and the drainage works as therein indicated and set forth is hereby authorized and shall be completed in accordance therewith; 2.0 The Corporation of the Township of Bruce may borrow on credit of the Corporation the funds necessary for construction of the drainage works. the the 3.0 All monies assessed for this drainage works shall be payable within 30 days of the mailing of the invoices to the affected landowners. Interest will be charged at the rate of 15% per annum for an amount in arrears and, if unpaid, will be collected at the same time as other taxes are collected. .. DRAWINGS, MD231-1 MD231-2 MD231-3 MD232-4 Plan Profile - Main Drain Profile - Branch A Profile - Branch B I I 11 12 I 13 14 I 15 I 15 15 I 17 18 I 18 I 19 22 I 23 24 I 25 I I I I I I I I I I I I I I I I I I I I I I I I I I I I \ \. - 1 - Engineer's Report No. 18 MUnicipal Drain 1995 Township of Bruce 1.0 PORWARD 1.1 Authorization The Township of Bruce authorized the preparation of this Report, in accordance with Section 4 of The Drainage Act, in a letter of instruction from Deputy Clerk-Treasurer Roberta Trelford dated August 31, 1994. 1.2 Objective The objective of this Report is to provide an underdrainage outlet for Lot 13, Concession 14, and the north part of Lot 13, Concession 13 through Lots 11 and 12, Concession 14, all in the Township of Bruce. This Municipal Drain will consist of approximately 1420 metres of concrete drain tile and the ditchbottom only cleanout of approximately 110 metres of the ditch alongside Sideroad 10-11. 1.3 ACknowledgements Maitland Engineering Services Ltd. wishes to acknowledge the assistance and cooperation of the landowners involved with this project, the Township Council members, the Road Superintendent, the Clerk-Treasurer, and Township Office Staff. 1 f - 2 - 2.0 INTRODUCTION On August 10, 1994, the Township of Bruce received a petition, signed by the OWner of Lot 13, Concession 14 and Pt. Lots 11, 12, and 13, Concession 13, requesting an underdrainage outlet for this property through Lots 11 and 12, Concession 14 to the roadside ditch of Sideroad 10-11. An on-site meeting for this proposal was held on November 7, 1994. At that time, the Owner of Lots 11 and 12, Concession 14, indicated that he felt a drain was required to conduct the underdrainage waters from Lot 13, Concession 14 and the north part of Lot 13, Concession 13 through his properties to outlet at Sideroad 10-11. The petitioner was in agreement with this proposal and had signed the Petition for that purpose. The upstream landowners, that is the owners of Lots 14 and 15, Concession 14 and Lot 14, in Concession 13 indicated that they had no need for a drain to conduct either underdrainage or surface waters from their properties and were requesting that they be excluded from the proposal. At present, there are three underdrainage headers that outlet at the line between Lots 12 and 13, Concession 14, into existing low runs or swales that converge at approximately the midpoint of Lot 12 to form one large swale; this swale then travels in a westerly and northerly direction through the remaining portion of Lot 12 and Lot 11 to outlet at Sideroad 10-11. It was suggested that an outlet drain be installed north of the existing low runs extending to the fenceline between Lots 12 and 13 at each location where an existing header outlets. After a brief site investigation, it was agreed to survey the existing low run and proceed with a preliminary design. This route was surveyed on November 7th, 1994 and proved feasible and is proposed in this Report. Drawing MD231-1 indicates this route and the lands affected thereby. The Profiles, Drawings MD231-2, -3, and -4 and the specifications indicate the grades, dimensions, and other particulars of the work. It should be I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I .'1. s , - 3 - noted that this proposed drain is designed to provide underdrainage outlet ONLY for Lot 13, Concession 14, and the north part of Lot 13, Concession 13. Also included in the design is approximately 6.4 hectares of Lots 11 and 12, Concession 14 which consist of a strip of land approximately 22.5 metres in width on either side of the proposed drain and its branches; the reader is asked to consult drawing MD231-1 for the affected area that is included in this drainage proposal. Further site meetings were held on March 29, 1995 and May 30, 1995. 3.0 LOCATION The Township of Bruce is located on the extreme west side of the south half of the County of Bruce and is bordered on the north by Bruce County Road 11, on the south by Bruce County Road 15, on the west by Lake Huron, and on the east by Bruce County Road 1. The Village of Tiverton is located at the southwest corner, while the Hamlet of North Bruce is located at the northwest corner of the Township, and the Hamlet of Glamrnis is located in the extreme southeast corner. The subject drain is located in the northwest corner of the Township, approximately 2.5 km southeast of North Bruce, immediately south of Bruce County Road 11. As indicated on Drawing MD231-1, the watershed boundary includes the middle portion of Lot 11 and the majority of Lots 12, 13, and 14, Concession 14, as well as the northerly portions of Lots 13 and 14, Concession 13. However, the "affected area" of this drain includes only those lands in Lot 13, Concession 14 and Lot 13, Concession 13, as well as the 6.4 hectares in Lots 11 and 12, Concession 14 being a 45 metre strip along the proposed route of the drain and its branches. The outlet for the tile portion of this proposed Municipal Drain is the north roadside ditch of Sideroad 10-11. The eventual outlet for this Municipal Drain is Mill Creek which is located in the extreme northeast corner of Lot 10, Concession 14. 1 i' ~ - 4 - The reader is asked to consult drawing MD231-1 for the exact location of the watershed boundary and the "affected area" for this drainage project. 4.0 THE DRAINAGE ACT, R.S.O. 1990 As this is a new Municipal Drain, this Report is being prepared in accordance with Section 4 of The Drainage Act. 5 . 0 AREA REQUIRING DRAINAGE At the November 1994 on-site meeting, the area requiring drainage was determined to consist of Lot 13, Concession 14, and the north part of Lot 13, Concession 13. Since the Owner of that property had signed the Petition, the petition was considered to have met the requirements of Section 4 (1) (a) of The Drainage Act and was deemed to be valid. 6 . 0 DRAINAGE AREA The reader is asked to consult drawing MD231-1 which illustrates the extent of the drainage area as well as the "affected area" for this drainage proposal. Some additional information is provided under the following headings. 6.1 Extent The "affected area" of this Municipal Drain is comprised of approximately 40.5 hectares of Lot 13, Concession 14, approxi- mately 8.9 hectares of Lot 13, Concession 13, and approximately 6.4 hectares of Lots 11 and 12, Concession 14, which is a 45 metre wide strip along the length of the proposed drain and its branches. The areas of each lot are shown on Drawing MD231-1 and are tabulated in the Schedule of Assessments, Appendix C. 6 .2 Boundary The watershed boundary is indicated on the enclosed Plan and has been established as part of the work undertaken in preparing this Report. To establish this boundary, aerial photographs were reviewed, field inspections were undertaken, and the Ontario Base Mapping was reviewed. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I ,\ .. ~ - 5 - 6.3 Soils The Bruce County Soils Map indicates that Elderslie silty clay loam, a lacustrine soil with imperfect natural drainage, is the predominant soil in the "affected area". In addition, a narrow band of Chesley silty clay loam, a lacustrine soil with poor natural drainage, bounds the low runs along which the proposed Drain and its branches are to be installed. Elderslie silty clay loam has an agricultural capability rating of 70% Class 1 and 30% Class 2 with topography as the limitation. 6.4 Test Holes Test holes were dug prior to preparing this Report and the results have been included herein. Should significant interest be indicated at the time of tendering, further test holes may be dug at that time. 6.5 Shape This drainage area is somewhat rectangular in shape, except for the portion in Lots 11 and 12, which follows the meandering low runs. 6.6 Topography The majo;-ity of the "affected area" is gently sloping to undulating; however, in spite of the topographic limitation of the Elderslie silty clay loam, none of the subject lands in Lots 13, Concession 13 and 14 are too steep to restrict agricultural operations. Adjacent to the low runs in Lots 11 and 12, some of the topography is quite steep. 6.7 Land Use The majority of the land within the "affected area" is privately owned and used for agricultural purposes, namely the production of cash crops such as corn, grain, and beans. A small portion of bush exists in the extreme southeast corner of Lot 13, Concession 14. The affected area in Lots 11 and 12 is used exclusively for intensive pasturing. ~ ¡ ..1 - 6 - 7.0 PRESENT CONDITIONS Underdrainage water from Lot 13 now outlets onto the ground surface at three locations on the east side of Lot 12 and the flows westerly and northerly, through Lots 12 and 11, into the east ditch of Sideroad 10-11. These three flow routes converge at the' midpoint of Lot 12. Surface water also flows through these low runs but has not been addressed in this proposal as it is not of concern to the Owner of Lots 11 and 12. 8.0 DESIGN CRITERIA The applicable sections of "Design and Construction Guidelines for Work Under The Drainage Act", as prepared by the Government of Ontario, and the applicable sections of "Drainage Guide for Ontario", as published by the Ontario Ministry of Agriculture and Food, have been used for the design of this Municipal Drain and will be used for the construction as well. A drainage co-efficient of 12.7 rom or one half inch in 24 hours has been used to determine the underdrainage outlet requirements. It should be noted that NO ALLOWANCE FOR SURFACE WATER DRAINAGE HAS BEEN MADE IN THIS DESIGN. 9.0 DESIGN CONSIDERATIONS In addition to the normal items considered when designing a tile Municipal Drain, the following special items were considered for this project. 9.1 Soil Conditions As a result of the subsurface soil conditions along the entire route of the proposed drain, concrete drain tile is proposed to be used for the closed part of this Municipal Drain. The reader is asked to consult the test hole results for details concerning these soil conditions. 9.2 Drainage Route As previously indicated, significant low runs exist through Lots 11 and 12. It is proposed to install the new Municipal Drain generally to the north of these low runs. Crossings of these low runs shall be kept to a minimum. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I -~ j -1..7 - 9.3 Underdrainage Allowance As previously indicated, the majority of the "affected area" for this Municipal Drain is Lot 13, Concession 14, and the north part of Lot 13, Concession 13. This design area has been used for sizing the proposed concrete drain tile. Also as indicated previously, an allowance for apprqximately 6.4 hectares of Lots 11 and 12 has been included in the design. This 6.4 hectare area is composed of a 45 metre wide strip extending along the entire length of the new Municipal Drain. This allowance has been incorporated into the design to provide for underdrainage of the low wet land adjacent to the proposed Municipal Drain and has been agreed to by the owner of Lots 11 and 12. 10.0 PROPOSED WORK The work proposed under this Report has been divided into three parts, a Main Drain and Branches A and B. These are described separately, as follows. All tile will be installed with a wheel- type trencher, generally on the north side of the respective low run. 10.1 New Drain The Main Drain portion of this No. 18 Municipal Drain is proposed to consist of approximately 150 metres of ditch alongside Sideroad 10-11 (110 m of which will be excavated), 6 metres of 400 mm diameter corrugated steel outlet pipe with riprap, approximately 1030 metres of 350, 300, 250, and 200 mm diameter concrete drain tile, and four junction boxes. This tile will follow the south low run to the east side of Lot 12. 10.2 Branch A This Branch Drain will service the north low run and will consist of approximately 280 metres of 200 mm diameter concrete tile and one junction box. 10.3 Branch B This Branch Drain will consist of approximately mm diameter concrete tile and one junction box. the middle low run on the east side of Lot 12. 105 metres of 150 It will service · ~ ~ - 8 - 10.4 Purther Details Complete details of the proposed work are included in Appendix B - Cost Estimate and the Special Information to Tenderers included with this Report. The reader is asked to consult these for further information regarding the various sections of the Drain. It is not anticipated that any unknown existing tiles will be encountered; however, should such tiles be found, they will be reconnected to themselves or to the new Drain as determined by the Engineer at the time of construction. 10.5 General The construction work described in this Report is that which is proposed at the time of writing; however, if unforseen circumstances are encountered after the preparation and adoption of this Report, the Engineer may institute Change Orders, as may be required, in order to have the works properly constructed. 11.0 ENVIRONMENTAL CONSIDERATIONS Since all of the proposed work will be undertaken on pastured land and since the new drain will be installed using the trenching method, it is not anticipated that this project will create any significant adverse environmental effects. Sediment control will be undertaken where necessary. 12.0 APPENDICES Three appendices are attached hereto and form part of this Report, namely Appendix A - Allowances, Appendix B - Cost Estimate, and Appendix C - Assessments. 12.1 Appendix A - Allowances In accordance with Sections 29 and 30 of The Drainage Act, this Appendix includes allowances for right-of-way and for damage to lands for the portions of Lots 11 and 12, Concession 14 upon which the work is to be undertaken. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I , ~J: L ~ - 9 - 12.2 Appendix B - Cost Estimate This Appendix provides a detailed estimate of the cost of the proposed work including all materials, construction, administration, and allowances. 12.3 Appendix C - Assessments This Appendix is the distribution of the total estimated cost over the lands and roads involved. These assessments are made in accordance with Sections 22 and 23 of The Drainage Act. All affected private lands are agricultural within the meaning of The Act and, therefore, should be eligible for any grants which may be available from the Ministry of Agricultural, Food, and Rural Affairs. 13.0 MAINTENANCE The sections of The Drainage Act dealing with obstruction of, damage or injury to, and pollution of a Municipal Drain, namely Sections 80, 82, and 83 are brought to the attention of the landowners. As can be seen from these sections, the landowners, as well as the Municipality have responsibilities to ensure that a Municipal Drain is properly maintained and not abused. Proper maintenance of the proposed works described herein will be necessary to ensure that all parts continue to function properly. This maintenance should include regular inspection and necessary work along the entire length of the drain. These proper maintenance procedures should ensure that the junction boxes remain unobstructed by debris or sediment and are cleaned on a regular basis. As well, any areas of washout or settlement should be attended to immediately. Landowners involved with this drain should make regular inspections of the portion on or adjacent to their properties and should report any problems to the Township so that proper action can be taken by the Township Drainage Superintendent. Normally, it is recommended that no lateral drains be connected to a new Municipal Drain, but rather that headers or main drains be constructed on each side and connected at the junction boxes ~ ,1 ~ - 10 - along the route of the Municipal Drain. However, in this particular case, since only a narrow width of Lots 11 and 12 has been included in the affected area, two sets of connections will be allowed to the Main Drain downstream of Station 0+662. However, upstream of that point, and on the Branches, connections shall be made only at the junction boxes. All connections must be made very carefully, especially those being tapped directly into the concrete tile. After this Municipal Drain has been constructed, the Township of Bruce shall be responsible for the maintenance thereof. Maintenance costs incurred in the future shall be distributed in accordance with the terms of The Drainage Act using ONLY THE OUTLET PORTION OF THE ASSESSMENT SCHEDULE IN APPENDIX C. The Township Road Authority shall be entirely responsible for the cost of future maintenance of the roadside ditch along Sideroad 10-11. This shall be the method of proportioning maintenance costs for the subject Municipal Drain until such time as it is varied in accordance with The Drainage Act. I , L - 15 - SPECIAL IHPORJIATION 'l'O TENDERERS POR THE CONSTRUCTION OP THE NO. 18 MUJlTICIPAL DRAIN 1995 TOWNSHIP OP BRUCE SPECIPICATIONS This Special Information, along with Section F, "Project Specifications for the Construction of a Municipal Drainage Works", attached hereto, together with the Plan and Profiles, shall be part of this specification and shall apply to and govern the construction of the No. 18 Municipal Drain, Township of Bruce. EXTENT OF WORB: SECTION A - HAIN DRAIN The majority of the work is located in Lots 11 and 12, Concession 14, Township of Bruce, which is approximately 2.5 km southeast of the hamlet of North Bruce on Bruce County Road 11, and includes the supply and installation of approximately 1035 metres of 150 to 350 mm diameter concrete drain tile (CDT) , one steel outlet pipe, 6 junction boxes, and the cleanout of 100 metres of roadside ditch including spoil treatment. Test holes were dug along the route of this Drain on May 5, 1995 and the results are attached for the Contractor's review. Additional test holes will be dug at the time of tendering, if sufficient requests are received. As a result of this soils information being available, NO EXTRA PAYMENT WILL BE MADE FOR SPECIAL INSTALLATION TECHNIQUES OR MATERIALS DUE TO SOIL CONDITIONS OR COMPOSITION, unless specifically approved in writing by the Engineer. Where practical, the concrete drain tile shall be installed north of the existing low run through Lots 11 and 12. < .' --'l6 - Access to the construction site and working space shall only be via public roadways or existing farm laneways, unless specifically approved otherwise by the Engineer. Item A1. Ditchbottam Only Cleanout - Sta. 0+040 to 0+150 For the lump sum price bid, the Contractor shall undertake a ditchbottom only cleanout of approximately 110 metres of the east ditch along Sideroad 10-11. Included in the lump sum price bid for this item shall be the disposal, in a location selected by the Township Road Superintendent, of all resulting spoil and the levelling of this spoil at the approved disposal site. The disposal may include loading and hauling, as specified at the time of tendering. Item A2. 400 mm CSP OUtlet - Sta. 0+150 to 0+156 For the lump sum price bid, the Contractor shall supply and install 6 metres x 400 mm diameter x 1.6 mm rivetted CSP at the grades and depths shown on Profile drawing MD231-2. Included in the price of this item shall be the supply and installation of approximately 15 square metres of field stone riprap, an approved rodent grate, and a water-tight wrapped butt joint at the connection with the CDT. Item A3. 350 mm Concrete Drain Tile - Sta. 0+156 to 0+200 For the lump sum price bid, the Contractor shall supply and install approximately 44 metres of 350 mm diameter CDT at the grades and depths shown on Profile Drawing MD231-2. Item A4. 300 mm Concrete Drain Tile - Sta. 0+200 to 0+875 For the lump sum price bid, the Contractor shall supply and install approximately 675 metres of 300 mm diameter CDT at the grades and depths shown on Profile Drawing MD231-2. Item AS. 250 mm Concrete Drain Tile - Sta. 0+875 to 1+020 For the lump sum price bid, the Contractor shall supply and install approximately 145 metres of 250 mm diameter CDT at the grades and depths shown on Profile drawing MD231-2. Junction boxes shall be installed at the following locations: a) Station 0+662; b) Station 0+875; c) Station 1+020; and d) Station 1+185 (complete with a connection of the existing PDT at the line between Lots 12 and 13) . AO+OOO to AO+280 For the lump sum price bid, the Contractor shall supply and install approximately 280 metres of 200 mm diameter CDT at the grades and depths shown on Profile drawing MD231-3. AO+280 For the lump sum price bid, the Contractor shall supply, install, and connect a junction box with approved marker and post as indicated on the "Junction Box/Catchbasin Details" sheet. BO+105 For the lump sum price bid, the Contractor shall supply, install, and connect a junction box with approved marker and post as indicated on the "Junction Box/Catchbasin Details" sheet. The Contractor's attention is drawn to the notes on this detail sheet with respect to plugged inlets, . sumps , covers, etcetera. This installation shall include the connection of the existing PDT at the line between Lots 12 and 13. SECTION P - PROVISIONAL ITEMS This section covers work which mayor may not be required as part of this project and these items shall apply only as and when approved by the Engineer. Pl. Reconnection of EXisting Tile It is not anticipated that any existing drains will be encountered in Lots 11 and 12; however, where existing drains are encountered, and for the lump sum price bid for each, the Contractor shall supply all necessary material and labour required to reconnect any unknown existing tile encountered during the construction of the drain, all in accordance with the appropriate specification in Section F. The Engineer may require that tile 150 mm diameter or larger be connected to the new drain. This does not 'include any tile mentioned in any other items. Rigid pipe such as PVC sewer pipe shall be used for reconnections as follows: a) 100 mm; b) 150 mm; and c) 200 mm and larger. Working Space The Contractor shall contain his construction operations to as narrow a width as possible so as to prevent damage to land, etcetera. The widths shown on the page entitled ·Working Space" are the maximum widths permitted for the various sections of this Drain. Item D2. Utilities The Contractor shall be responsible for contacting the appropriate utility companies prior to undertaking any work in a location where an underground utility(sJ may exist and shall be responsible to work in accordance with the instructions of the utility. The Contractor shall be entirely responsible for any damage to utilities caused by him, his subcontractors, or his employees while undertaking this work. Item D3. Bench Harks Bench marks for this project are shown on the Profiles and all elevations shall be established ONLY from these bench marks. rtem D4. Haterials Unless specified otherwise at the time of tendering, all necessary materials shall be supplied by the Contractor. Item D5. Time for Completion The land through which the new drain is to be installed is used for intensive pasturing of livestock until September 15, 1995. Accordingly, the Contractor shall commence his operation after September 15, 1995 and, therefore, shall indicate his date of completion only. rtem D6. Tender Deposit and Contract Surety A certified cheque in an amount equal to $2500 shall be submitted by the Tenderer as a Tender Deposit with the Tender. This cheque will be held by the Township as Contract Surety and will be returned to the Contractor upon substantial completion of the project. < A -ôO- · Item D7. "Understanding Drainage Assessment;" May 1976) Sid Vander Veen, P. Eng. Resources Management Branch The Drainage Act provides a legal procedure by which an "area requiring drainage" may have an outlet drain con- structed to dispose of excess water. The drainage worl< is initiated by interested individuals within an "area requiring drainage" who will benefit from the construction of the drain. A petition fonn. obtained from the municipal clerk. is signed by interested landowners. In order to be valid or sufficient, the petition must be signed by the majority of the owners in the "area requiring drainage" or by owners that represent at least 60% of the lands in this area. The "area requiring drainage" is usually described by lot and concession, or other legal land description. By tak- ing this action. it is presumed that the owners signing the petition have made a decision that the drain will be of bene- fit to them and that the probable cost will be lower than the anticipated benefits. The initial benefit-cost decision is made at this point by the landowners. not the engineer or Council. The petition is presented to and considered by Council. If the petition represents a proper "area requiring drainage", that is a real drainage basin. and appears to be valid, the Council may decide to proceed. Council then notifies each of the petitioners of this decision as well as any other munic- ipality affected and the local Conservation Authority and the Ministry of Natural Resources. Council then appoints an engineer. The engineer is an employee of Council, hired to design this specific drain. Under The Drainage Act, Section 9(2), the engineer is required to hold an on-site meeting to detennine (I) the area requiring drainage, (2) if the petition is valid. (3) the drainage needs of the area. The engineer is then required "to make an examination of the area requiring drainage as described in the petition and to prepare a report which shall include, (a) plans, profiles and specifications of the drainage works; (b) a description of the area requiring drainage; (c) an estimate of the total cost thereof; (d) an assessment of the amount or proportion of the cost of the works to be assessed against every parcel of land and road for benefit. outlet liability and injur- ing liability; (e) allowances, if any, to be paid to the owners of land affected by the drainage works and (f) such other matters as are provided for under this Act." The engineer's report is presented to Council, who then notifies all persons assessed and calls a special meeting where the report is considered. General objections to the report may be raised at this time. At this meeting signatures may be added or removed from the petition and this deter- mines if the project will continue. Unresolved problems, depending on the subject. may be appealed to the Court of Revision, the Ontario Drainage Tribunal or the Drainage Referee. Details on appeal procedures may be found in The Drainage Act* or in Ontario Ministry of Agriculture and Food Factsheet, Drainage Legislation. The engineer's report includes two important items: I. The estimated cost of the worl<: No matter how indi- vidual assessments are amved at, this total estimated cost must always be equal to the total amount assessed, otherwise the work cannot proceed. 2. The assessment liability: This may be spread over several pages if an owner owns several parcels of land and if there are branch drains. It may be sum- marized. Let us examine the obligations regarding this assess- ment. Responsibilities Under Common Law A natural watercourse is defined generally as a stream of water which flows along a defined channel, with bed and banks. for a sufficient time to give it substantial existence. This may include streams that dry up periodically. A riparian landowner (owner of lands that abut upon a natural watercourse) has the right to drain his or her lands into the natural stream, but may not bring water in from another watershed. He or she can collect water in ditches and drains and discharge it into the watercourse even though it results in an increase in volume and rate of flow. Where a natural watercourse becomes a pan of a drain. it is no longer a natural watercourse. When this occurs, the riparian rights. as described earlier. are lost. Surface water not flowing in a natural watercourse (i.e. not having discernible bed and banks) has no right of drainage; an owner of lower land may, at his or her own choice. either allow the water from higher land to flow over it or by dams or banks, keep such water off his or her prop- * The Drainage Act may be found in the Revised Statutes of Ontario 1980, Chapter 126. available in most public libraries. No owner has the right to collect such surface water by ditches or drains and discharge it on lands of another. He or she has a responsibility to take this water to a sufficient out- let, i.e., a natural watercourse or a drain constrUcted under The Drainage Act. ' Since there is no right to drain surface water, the owner of each parcel of land in the watershed is generally assessed for "outlet liability". In other words, his or her Common Law liability is removed by paying for the increased size or cost of the drain due to the volume of water which is dis- charged from his or her property. even though the drain may not provide a direct outlet for this water. The authority for this liability is set out in Section 23(1). Since, through Common Law, a landowner is also liable for any damage he or she may cause from water which he or she collects in drains and discharges on other land without a sufficient outlet, he or she may be assessed for relief from such "injuring liability" if the new drain serves as an outlet for his or her drains and prevents this injury from occurring. The authority for this liability is set out in Section 23(2). Injuring liability is frequently difficult to distinguish from outlet liability, consequently many engineers' reports do not contain such an item. The assessment for outlet liability and injuring liability is based on the volume and rate of flow of the water artificially caused to flow from an owner's property. Generally, the assessment is based upon a unit value per hectarage. Owners at higher elevations on a watershed may have a higher unit charge than those owners near the outlet since the water from their land makes use of a greater length of drain. A difference may be made in the unit outlet charge due to varying types of soil or land use. or the distance to the drain. Responsibility Under The Drainage Act In addition to the Common Law responsibility, an owner may also be assessed for benefit. Benefit will vary between different lands, according to their differences of elevation, quantity of water to be drained from each, distance of undrained land from the course of the proposed ditch, and the presence or absence of existing drains, and other like factors. To consider whether a parcel of land will receive any benefit from the construction, it is proper to consider whether any enhanced fmancial value will accrue to it as a result of the drain construction. This may occur through the increased productive power of the land or by rendering it mOre saleable and at a better price, or by preventing water from entering on to it. If the proposed drainage works can be of no possible ben- efit to the owner. or is of no commercial or agricultural value, the Act does not authorize a contribution for benefit. Sometimes, an owner has an undeveloped area that he or she intends to leave in this condition. The owner may feel that he or she should not be assessed since the drain will be of no benefit. However, the property could change hands and the new owner might want to drain and develop it. It is with this in mind that the engineer must make an assess- ment, regardless of the present owner's intentions. It is the duty of the engineer to detenoine whether or not a parcel of land will benefit from the project. When appealling a benefit assessment, the landowner must prove that the land has no benefit from the drain. . ' ... An ~wner has no responsibility for work done upstream from his or her property unless the work provides a benefit by "cutting off" a harmful flow of water across the property. In some instances, a "special benefit assessment" may be levied against the property. This value usually represents the difference in cost between that which was originally designed and the increased level of design requested by a landowner. For example, a closed or tile drain where open ditches would ordinarily suffice, or the construction of ponds beside the drain, or other special requests by a landowner specifically for this benefit. The authority for this liability is set out in Section 24. Engineer's Report The Engineer's report should contain a plan and profile of the drain, as well as details on the drain design and the assessment schedule. The plan shows the location of drains and the limits of the watershed. The profile shows ground elevations along the drain and the present and proposed drain bottom. The specifications give details on how the drain is to be con- structed_ The Schedule of Assessment contains several columns. The first group contains the names of owners with a descrip- tion of each parcel of land assessed. The hectarage shown in the schedule for which an owner is assessed is only approximate. No survey is made to accu- rately establish the watershed boundary or farm areas. Any minor error in hectarage assessed is not a valid basis for appeal nor does it greatly affect the assessment. The other columns in the Schedule set forth the assessment liability for each drain and/or branch drain. These values are only esti- mates. The final value will not be known until the constrUc- tion work is finished. The assessment will then be prorated to recover the actual cost. Allowances to lands injured by the work are set out in a separate schedule by the engineer. Authority for this is Sections 29 to 33 of the Drainage Act. Damage to crops during construction and disposal of waste material will vary with the time of year the work is constructed. Crop damage due to spreading the spoil on the banks is based on a decreasing yearly loss of crop over sev- eral years. All or part of the cost of access bridges from a public road to the property may be assessed to the property owner. Farm bridges are constructed as a part of the work. In certain circumstances a severance allowance may be paid instead of building the bridge. The allowance will depend upon the value of the land severed, or the cost of the bridge that would be required. The cost, or part of the cost of farm bridges or the severance allowance may be assessed against the property. Where private drains are incorporated into the new drain, a nominal allowance may be paid based on any saving that may result from using the private drain. These allowances may not be included in the Summary of Assessments but are usually shown in a separate Schedule of Allowances. B. 2 TENDERING SUBMISSION Each tender shall be submitted in its entirety and in accordance with the Special Information to Tenderers. It shall include a fully completed Form of Tender as bound herein. The complete written Tender Documents must be submitted as a tender, and the Form of Tender must remain bound with the other documents. The Form of Tender is provided in Duplicate and the Tenderer may retain one set for his records. All sections of the Form of Tender shall be completed. B. 3 WITHDRAWAL OR QUALIFYING OF TENDERS A tenderer who has already submitted a Tender may submit Tender at any time up to the official closing time. Tender received shall supersede all Tenders previously by that Tenderer. A Tenderer may withdraw or qualify his Tender at any time up to the official closing time by submitting a letter bearing his signature and seal as in his tender to the point of tender delivery where the time and date of receipt will be recorded and the letter placed with the other tenders. No telegrams or telephone calls will be considered. a further The last submitted B. 4 INFORMAL OR UNBALANCED TENDERS Tenders which are incomplete, conditional, illegible, or obscure, or that contain additions not called for, reservations, erasures, alterations, or irregularities of any kind, may be rejected as informal. Tenders that contain prices which appear to be unbalanced so that they likely would adversely affect the interests of the Owner, may be rejected. Tenders that are based upon an unreasonable period of time for the completion of the works may be rejected. - Bt - " , Wherever in a tender the amount tendered for an item does not agree with the extension of the estimated quantity and the tendered unit price, the unit price shall govern. The amount and the Total Tender Price shall be corrected accordingly. The Engineer reserves the right to waive formalities at his discretion. Tenderers who have submitted tenders that have been rejected by the Engineer because of informalities will normally be notified of the reasons for the rejection within fourteen days after the closing date for tenders. B. 5 DISCREPANCIES IN AND INTERPRETATION OF TENDER DOCUMENTS Should a Tenderer find discrepancies in, or omissions from any part of the tender document, or should he be in doubt as to its meaning, he should notify the Engineer who may send written instruction to all Tenderers. No oral interpretation shall be made to a Tenderer as to the meaning of anything within the tender document. Addenda shall be issued by the Engineer to items in the tender as he determines. Addenda shall be in writing unless time prohibits mail delivery prior to tender closing. B. 6 QUANTITIES ARE ESTIMATED The quantities shown for the items in the Form of Tender are estimated only and are for the.. sole purpose of indicating to Tenderers the general magnitude of the work. For any work done or materials supplied on a unit price basis, the Contractor will be paid for the actual measured quantities at the respective unit prices tendered. The Engineer has the right to increase or to reduce the quantities required or to suspend or omit any item or portion of the work at any time as he may deem advisable. The Contractor shall not be entitled to any compensation neither for loss of anticipated profit nor for removal or the bringing in of materials as a result of the deletion or of the addition of any item or part of an item from the Form of Tender. B. 7 PRICES TENDERED The unit prices or lump sum bid shall include all labour, equipment and materials necessary for the construction of the items specified, in complete conformance with the standards of work and materials specified, as set out in the applicable sections of this Contract. '" , ,- p3 - B. 8 ACCEPTANCE OR REJECTION OF TENDERS The Engineer shall not be responsible for any liabilities, expenses, loss or damage incurred, sustained or suffered by any Tenderer prior or subsequent to or by reason of the acceptance or non- acceptance by the Engineer of any tender or by reason of any delay in the acceptance of a tender. Tenders are subject to a formal Contract being prepared and executed. The Engineer reserves the right to reject any or all tenders and to waive formalities as the interest of the Owner may require without stating reasons therefore and the lowest or any tender will not necessarily be accepted. B. 9 TENDER DEPOSIT Each Tender must be accompanied by a tender deposit in the form of a certified cheque made payable to the Owner in the amount specified in Section 'A', Special information to Tehderers. The tender deposits of all but the lowest two Tenderers will be returned within fourteen days after the Tender closing date. The tender deposit of the two lowest Tenderers will be retained for the period specified in Section 'A' Special Information to Tenderers or until a Tender has been accepted, the required surety and other documents specified herein have been accepted by the Engineer, and a Contract has been executed by the Owner and the successful Tenderer. The tender deposit of the Tender to whom the Contract is awarded shall be forfeited should he fail to execut a Contract and provide the satisfactory documents as required prior to signing the Contract, within fourteen working days after receiving written notice from the Engineer of the Owner's intent to award the Contract. B.l0 FORMATION OF THE CONTRACT The Engineer, when so instructed by the Owner shall forward three complete copies of the Contract Documents to the successful Tenderer for execution. The Tenderer agrees that if he has been notified that his tender has been recommended to the Owner for acceptance he will complete the Contract Documents in triplicate in the form bound herein within fourteen days after receiving those same Documents in triplicate. The successful Tenderer shall execute and return with the three copies of the Contract Documents, to the Engineer within fourteen days, the following in triplicate: Performance and Maintenance Bonds as specified: Liability Insurance Certificate as outlined in Clause B.12 of Section B, Information to Tenderers for the amount as outlined in Section A, Special Information to Tenderers; and a clearance letter from the Workers' Compensation Board as outlined in Clause B.13 of Section B, Information to Tenderers. - B4 - . .. . , . It may also be required of the successful Tenderer to submit, at the same time, a completed schedule of work on a form as may be supplied by the Engineer. B . 11 BONDS The Tenderer shall supply, with the executed Contract Documents if so required, Performance and Maintenance Bonds in triplicate in the form approved by the Canadian Construction Association for the amount as specified in Section A, Special Information to Tenderers. B.12 INSURANCE The successful Tenderer shall file with the Engineer a Certificate of Liability Insurance in a form acceptable to the Engineer. The Liability Insurance shall: (a) have a limit of liability, of an amount not less than that specified in Section A, Special Information to Tenderers, inclusive for anyone occurrence; (b) be comprehensive Liability Insurance covering all operations and liability assumed under Contract with the Owner; (c) be endorsed to provide that the policy will not be altered, cancelled or allowed to lapse without thirty days prior written notice to the Engineer; (d) name the Engineer and Owner as additional insureds thereunder; and e) when specifically requested in the Special Information to Tenderers, not contain any exclusions or limitations in respect of shoring, underpinning, raising or demolition of any structure, collapse of any structure or subsidence of any property, structure or land from any cause. No work shall commence until the required Certificate has been provided. B.13 WORKERS' COMPENSATION DECLARATION The Contractor shall, at the time of entering into a Contract, obtain and provide a clearance letter from the Workers' Compensation Board, which is satisfactory to Engineer. One copy of the clearance letter shall be bound into each of the three executed sets of the Contract. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I , \ . - B5 - . . B.14 SUBCONTRACTORS AND SUPPLIERS The Tenderer shall list, on the page provided in the Form of Tender, the name and address of each subcontractor and Supplier used in pre- paring his tender, stating the portion of the work allotted to each. Only one subcontractor shall be named for each part of the work to be sublet. After a formal Contract has been executed, the Contractor shall not be permitted to substitute other subcontractors in place of those named in his tender without the approval of the Engineer. The Contractor shall not employ any subcontractors to whom the Engineer may reasonably object. If the change of any sub-contractor is required by the Engineer, the Contract price shall be adjusted by the difference between the prices of the two Subcontractors. The Engineer shall, on request, furnish to any subcontractor wherever practicable, evidence of the amounts certified to on his account. The Contractor shall be held fully responsible to the Owner for the acts and omissions of his subcontractors and of persons directly or indirectly employed by them, as for the acts and omissions of persons directly employed by him. The Contractor agrees to bind every subcontractor by the terms of the Contract, as far as applicable to the subcontractor's work. In view of this responsibility for the acts and omissions of his subcontractors, the Contractor shall not be obliged to employ as a subcontractor any person or firm to whom he reasonably objects. Nothing contained in the Contract Documents shall create any contractual relation between any subcontractor and the Owner. B.15 PROOF OF ABILITY The Tenderer shall, if required by the Engineer, provide proof of his experience and responsibility in successfully completing projects of a similar nature. This proof of ability shall apply in general to the Tenderer's experience in similar work, the Tenderer's senior supervisory staff and the experience of each, the Tenderer's construction plant, and the name and business address of each proposed subcontractor. This information shall be provided to the Engineer by the Tenderer within three days of request. B.16 EXAMINATION OF SITE Each Tenderer must visit the site of the work before submitting his tender and must satisfy himself by personal examination as to the local conditions to be met during the construction and conduct of the work. He shall make his own estimate of the facilities and difficulties to be encountered including the nature of the subsurface materials and conditions, and existing services. - B6 - . ~ , . , The Tenderer is not to claim at any time after sUbmission of a tender that there was any misunderstanding of the terms and conditions of the Contract relating to site conditions. B.17 LOCAL SPECIFICATIONS TO APPLY The work proposed under this Contract, and the materials to be used, shall comply in every respect to the specifications and standards of the local municipal authority. Supervision of construction of the proposed works may be provided by the local authorities, and the Contractor shall comply with each municipal authority's regulations with respect to notification prior to commencing work. Materials to be incorporated into the proposed works shall conform in every respect with the municipality's requirements regarding acceptance of materials. Each Tenderer shall satisfy himself by personal examination as to the local conditions, requirements and specifications. He is not to claim at any time after submission of his tender that there was any misunder- standing as to the requirements of the local municipality with respect to the proposed works. B.1S EXISTING SERVICES The Contractor shall, at his own cost and expense and in a manner approved by the Engineer, sustain in their places and protect from injury any and all poles and posts, water and gas mains, all sewers and drains (except where removal or connections to same are called for), conduits, service pipes, sidewalks, curbs and all other structures or property in the vicinity of his work, whether over or underground, or which appear in the excavation, and he shall assume all costs and expenses for damage which may be occasioned by injury to any of them. If damage to any structure, utility or improvement occurs by reason of the Contractor's operations, even though special precautions have been employed, the Contractor shall be entirely responsible for such damage whether such operations and the work resulting therefrom have received the proper approval of the Engineer or not, and all such damage shall be satisfactorily rectified at the Contractor's expense. The Engineer has endeavored to plot on the Contract Drawings all known existing utilities, pipes, catchbasins, conduits, poles, chambers or other objects being located underground, on the surface, or above ground; but should the plottings of such be found to be incorrect, incomplete or omitted, the Contractor shall have no claim on that account. The Engineer considers it to be the duty of the Contractor to notify all local utilities requesting the staking or marking of cable, conduits, watermains, etc. before the start of construction. The Contractor shall be solely responsible for damages caused to any utility, pipe, or object. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I ~ . \ .. - J37 - Throughout the execution of the works included in this Contract, the Contractor shall ensure that the necessary steps are taken to maintain the flow and use of the existing services, except as otherwise herein specified. The Contractor shall have no claim for delay sustained while waiting for the relocation or repair of services by other forces, as a result of the Contractor's work. Certainly any such relocations as appear necessary shall be undertaken prior to the Contractor's work on the site, however, those which have not been completed or which are not foreseen as a problem shall be the Contractor's responsibility to the extent of contacting the utilities involved and sustaining his own work and forces under the Contract. The Owner shall bear the direct relocation costs charged by any utility for relocation essentially, though not repair, resulting from the Contract work. The Contractor shall be responsible for all services and utility lines disturbed with the following exceptions; (a) water services encountered within three feet of the surface, (b) the combining of more than one sanitary service to avoid the newly constructed work which requires re-design of the services involved. B.19 TRAFFIC CONTROL The Contractor shall provide adequate control of traffic while operating equipment on municipal road allowances. The Contractor will be required to provide flagmen, and to maintain traffic flow at all times. The Contractor shall be responsible for adequate fencing of any excavations overnight and on holidays, and shall provide adequate lights and barricades as may be required in the opinion of the Engineer. On any detour or traffic route through construction, the Contractor shall be responsible for the placement of water or calcium chloride for dust control as directed by the Engineer. Payment for water or calcium chloride shall be made in accordance with the Form of Tender item pertaining to such work, or if no such item exists, the work shall be as an extra, unless specified otherwise. The Contractor shall be entirely responsible for dust control on hard roads and shall remedy unsafe conditions as directed by the Engineer. - BBo - ;. ~ +.J B.20 SURVEY FOR CONSTRUCTION The Engineer shall establish all line and grade in advance of construction. The Contractor shall give the Engineer 24 hours notice when line and grade is required and the Contractor shall satisfy himself that line and grade set by the Engineer is correct before proceeding with the work. Proceeding with the work as set out by the Engineer, shall signify the Contractor's acceptance of the line and grade established. The Contractor shall be fully responsible for the maintenance and protection of the stakes and datum marks set out by the Engineer, and shall be liable for all costs of replacing datum marks and stakes disturbed after being notified of their location by the Engineer. In the event that grade stakes are disturbed to the extent that insufficient line and grade remains, the Contractor shall be fully responsible for any delays caused due to their replacement by the Engineer, and for any work improperly installed due to his proceeding with work without the benefit of re-established line and grade. The Engineer may require the Contractor, at the Contractor's expense, to provide such masts, scaffolds, batter boards, straight edges, templates, personnel, machinery with operator, and other devices as may be necessary to facilitate laying out, inspecting, and constructing the work. Whenever necessary, work shall be suspended for such reasonable time as may be necessary to permit the Engineer to layout and inspect any portion of the work, and the Contractor will not be allowed any extra compensation for this suspension of work. B.21 OCCUPATIONAL HEALTH AND SAFETY ACT It is specifically drawn to the attention of the Tenderer that the Occupational Health and Safety Act provides in addition to other things a section governing work in trenches. It is the responsibility of the Contractor to ensure that this Act and the regulations are complied with. B.22 FAIR WAGE SCHEDULE All labour on this project shall be paid in accordance with the Fair Wage Schedule as established by the Department of Labour for the location of this work, where applicable. Additional information may be outlined in Section A, Special Information to Tenderers. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I '\ i - ~9 - B.23 PAYMENT Payment shall be authorized by the Engineer on Progress Payment Certificates which will be issued monthly. Specific details with respect to payment shall be as outlined in Section H, Articles of Agreement and Section A, Special Information to Tenderers. B.24 CONTINGENCY ALLOWANCE The items and quantities making up the Contingency Allowance, if any, are estimates of additional work which mayor may not be required. All work done under the Contingency Allowance shall be determined by the Engineer as the work progresses. Any work so required shall be authorized, in writing, by the Engineer on a Field Order and accepted by the Contractor, on a Contract Change Order. The value of any additional work for which a unit price has not been established in the Contingency Allowance shall be determined in accordance with Article B.25, Section B, Information to Tenderers. The Contractor is not entitled to payment for any work included in the Contingency Allowance except such work as is ordered by the Engineer as set out above. Payment shall be made only for work actually done, and materials in place, in accordance with the specified unit of work. B . 25 EXTRA WORK Work which is required for the performance of the intent of this Contract shall be paid for by the unit prices established in Section C, Form of Tender. Any work not covered for payment by the unit prices in Section C, Form of Tender, if authorized in writing by the Engineer, will be paid for at a price which is negotiated at the time of authorization. If a price for the authorized work is not negotiated, payment for the work shall be made on the following basis involving labour, equipment and material. Labour - Direct wage to the employee plus 60 per cent for benefits and overhead. Equipment - Ministry of Transportation current rental rates shall apply with 33% rental rate paid for equipment on standby. Material - Direct cost plus 20 percent for overhead. Subcontractors - Labour and equipment performed by sub- contractors shall be valued at the above rates, plus the general contractor will be entitled to a markup of 5 percent. · ;- - B+O T I Notwithstanding any other provisions of this section no payment shall be made to the Contractor for or in respect of hand tools or equipment that are tools of the trade. Except where there is agreement in writing to the contrary, the compensation as herein provided shall be accepted by the Contractor as compensation in full for all costs and expense arising out of the work including all costs of general supervision, administration, and management time spent on the work and no other payment or allowance shall be made in respect of such work. The hours worked each day by each piece of equipment and by each man, on work which is being paid for by the hourly basis, shall be agreed upon, at the completion of each day, by the Contractor or his representative and the Engineer or his representative. Any work so authorized shall be summarized for payment on a contract Change Order. The Contractor shall submit to the Owner a separate invoice in triplicate for the work within thirty days of the completion of the work. Each invoice shall include the order number and covering dates of the work, and shall itemize separately labour, materials, and equipment, and submitted with the invoice shall be receipted invoices for materials, rented equipment, and other charges incurred by the Contractor on the work. B.26 FEDERAL GOODS AND SERVICES TAX The Tenderer shall include the Federal Goods and Services Tax in the Tender in the manner indicated on the tender form. Whenever so requested by the Engineer or the Owner, the Contractor will verify the amount of Goods and Services Tax paid under the Contract. B.27 PROVINCE OF ONTARIO RETAIL SALES TAX The Tenderer shall include all Provincial retail sales taxes applicable in the Tender and shall insure that this tax is not applied on the Federal Goods and Services Tax. I I I I I I I I I I I I I I I I I I I , ~ t , ~ - 1 - SECTION F PROJECT SPECIFICATIONS , No.30 General for Municipal Drains F.30.1 SCOPE OF SPECIFICATION This specification covers the general conditions governing the construction of a municipal drain under the most recent revision of The Drainage Act and amendments thereto. F.30.2 BENCH MARKS Bench marks shall be set at intervals along the course of the work at locations shown on the accompanying plan and/or profile. The Contractor shall be held liable for the cost of re- establishing bench marks destroyed during the course of construction. Attention is drawn to Section 13(2) of The Drainage Act. F.30.3 STAKES Normally stakes are set 30 m apart throughout the course of the work and at all fences. The Contractor shall be held liable for the cost of replacing any stakes destroyed during construction. The drainage area shall be held liable for the cost of replacing any stakes destroyed prior to commencement of construction. F.30.4 LINE The drain shall run in straight lines throughout each course except at intersections, where it shall run on a curve of 15 m radius unless otherwise specified. If the work consists of the improvement of an existing open drain, then the centre line of the existing drain will be the centre line of the finished work unless otherwise specified. The centre line of the ditch shall be staked by the Contractor at least one complete course ahead of the digging, and all sloping and widening necessary shall be done in such a manner as to make the finished work uniform. ~ / .. 'J - 2 - F.30.5 PROFILE The drain is to be excavated to regular grade lines as shown on the profile. These grade lines show the bottom of the finished drain and are governed entirely by the bench marks. In the case of tile drains, the grade line is that of the invert of the tile. The profile shows, for the convenience of the Contractor and others, the approximate depths from the surface of the ground to the grade at the point where the numbered stakes are set and from the average bottom of the present drain as taken at the time of survey, however, the bench marks must govern the construction. Open drains shall be brought to an even grade in the bottom so that water will not stand therein. A variation of 20 mm from the grade lines for tile drains shall be deemed sufficient reason to cause the work to be rejected and done over. F.30.6 CLEARING Brush, timber, logs, stumps, boulders or other obstructions located in or along the course of the work and any brush or debris along the banks of a drainage works shall be removed a sufficient distance to be clear of the excavation and the excavated material, or to the widths shown on the page entitled "Working Space". No brush or trees are to be left inside the slopes of the drain whether they are located within the limits of the excavation òr not. Brush cleared in accordance with the above shall be piled in a,location and in a manner satisfactory to the Engineer for burning by the Owner. Unless otherwise specified or directed, brush piles shall be a minimum of lOO m apart and shall contain only cleared material. The Contractor will be permitted to cut standing timber along the course of a works, to the extent that may in the opinion of the Engineer be necessary to allow the safe and economical operation of the excavating equipment. Timber so cut shall be left on the property of origin for use of and disposal by the Owner. F.30.7 FENCES The Contractor will be permitted to remove fences to the extent necessary to allow him to construct the drain and dispose of any excess material according to specifications. Any such fences shall be carefully handled so as to cause no unnecessary damage. Such fences shall be replaced by the Contractor in as good a condition as found. The Contractor shall supply all material necessary to properly reconstruct any fences. The contractor shall not leave any fence open when he is not at work in the immediate area. Replacing of the fences shall be to the satisfaction of the Engineer. The Contractor shall be deemed to have met this specification when he obtains a statement in writing signed by the Owners of the land affected to the effect that the treatment of fences is satisfactory to them. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I ... . \ ~. - 3 - F.30.8 TRIBUTARY OUTLETS During the construction of a tile drain, the Contractor shall afford opportunity to the Owners to connect tributary tile drains to the main drain if approved by the Engineer and at locations approved by the Engineer. During the construction of an open drain, the Contractor shall guard against damaging outlets of any tributary drains encountered. F.30.9 NOTIFICATION OF AGENCIES The Contractor shall, before performing any work affecting the land or property of the Ministry of Transportation & Communications, or any railway, telephone, pipeline company or public utility, obtain at his expense any necessary permits or approvals for the construction. The Contractor shall further agree to perform the work affecting such lands or property in accordance with the specifications of such Ministry, company or utility, as though said specifications were hereto attached. The Contractor shall provide 7 days written notice when construction will affect the right-of-way of a Municipality, County, the Ministry of Transportation & Communications, or a railway, as follows: if a Municipality, then the Road Superintendent or Works Foreman shall be advised; if a County, then the County Engineer shall be advised; if the Ministry of Transportation & Communications, then the District Engineer shall be advised; and if a railway, then the Area Engineer of the railway shall be advised. Copies of this notice shall be sent to the Drainage Engineer. F.30.l0 STANDING CROPS AND LIVESTOCK The Contractor shall contain his construction operations to the working space specified. As long as the construction operations are contained within the specified working space, the Contractor shall not be responsible for damages to crops along the course of the drain. The Contractor shall give each landowner 24 hours written notice before commencing work on his property. Should work on a property be temporarily terminated for a period of time (one week minimum) the Contractor shall again formally notify the landowner in writing before recommencing work on that property. A Contractor responsible for the construction of a tile drain shall backfill all tile that have been inspected and approved by the Engineer, within three (3) working days after said approval. Should adequate backfilling not occur within the time specified, the Contractor shall become liable for any injury or loss, including livestock, due to this backfilling not being completed. ~ . I - . ~ ) After receiving proper notice, the Owner of the property upon which a drain is being constructed shall be liable for any damages to the drain, drain materials, or to the Contractor's equipment, caused by his livestock. F.30.ll ROADS When the construction consists partly or wholly of the removal of a drain from a road allowance, such drain shall be constructed entirely on farm lands and excavated material shall be placed in the abandoned channel as directed by the Road Superintendent of the Corporation having authority over said road. If not other- wise directed, all work on any road allowance shall be performed as directed by the aforementioned Superintendent. Where it is necessary to replace any pavement it shall be done by, and at the expense of the authority having control over said road unless stated otherwise in the Special Information to Tenderers. F.30.12 DAMAGES LIABILITY The Contractor shall pay all losses, damages, or claims received by the Municipality and he shall protect and save harmless the Municipality against liability for any accidents, damages, casualty, losses, or claims directly or indirectly arising out of the Contract, or manner of performance thereof by the Contractor, his agents, employees or Subcontractor. The Contractor will be solely liable for all injuries and/or accidents to workmen, and/or public and/or livestock and/or property, and for any expenses or damages occasioned by fences being left open or improperly closed, insufficient guarding and lighting or bad workmanship at places where a drain runs along or across a road allowance or any negligence in carrying on the work. Any such expense or damages may be deducted from the amount of the contract or may be recovered by the Municipality from the Contractor or his sureties. The Municipality shall have the right to require the Contractor to furnish proof of his insurance against any or all liabilities prior to obtaining the contract. F.30.l3 FINAL INSPECTIONS Final inspection will be made by the Engineer within lO days after he has received notice in writing from the Contractor that the work is completed or as soon thereafter as weather conditions permit. All the work included in the contract must, at the time of final inspection, have the full dimensions and cross-sections called for in the plans and specifications. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I a . { ( . , - 5 - F.30.14 PROGRESS PAYMENT Progress payments equal to approximately 90% of the value of the work completed and materials incorporated in the work will be made monthly by the Municipality to the Contractor on the written certificate of the Engineer. The balance will be paid within 20 days after final acceptance by the Engineer, or at the next regular Council meeting thereafter. The Municipality shall have the right to require the Contractor to furnish a complete release from Subcontractors or of all liens arising out of this contract (other than his own) which may have been registered against this work before the final payment or any part thereof shall become due. F.30.15 FAULTY MATERIAL OR WORKMANSHIP Neither the final certificate nor payment thereunder, nor any provision of the contract documents shall relieve the Contractor from responsibility for faulty materials or workmanship, which shall appear within a period of one year from the date of the Engineer's Completion payment Certificate, and he shall remedy any defects thereto and pay for any damages to other work re- sulting therefrom which shall appear within such period of one year. F.30.l6 TENDERS Unless otherwise stated at the time of tendering, tenders will be received and contracts awarded only in the form of a lump sum of the completion of the whole work in accordance with the plan, profile and specifications or of such portions as specified in the Tender Form. Where the Tender Form calls for unit prices for certain items, these unit prices shall only be used where it is necessary to make adjustments in the amount of work to be done. The tender form or proposal, when signed and submitted by the bidder, shall be a formal and binding contract when accepted by and signed on behalf of the Municipality or Owner. Each bidder shall file a sealed proposal in duplicate and with it a certified cheque for a sum equal to ten percent (10%) of the bid price, made payable to the Municipality unless other conditions are stipulated in the tender advertisement. All certified cheques, except that of the bidder to whom the work is awarded, will be returned within ten days after the contract is awarded. The certified cheque of the bidder to whom the work is awarded will be returned with the final payment on the work. The bidders must examine for themselves the plans, profiles and specifications, and the location of the proposed work, and exercise their own judgement as to the extent of the work to be done. The Contractor must assume all risks of variance in any computation by whomsoever made, of statements of amounts or quantities necessary to complete the work required by the contract. " ..r 4' ) >' - 6 - If any doubt exists in the mind of any person tendering as to the exact meaning of any portion of these specifications or the plan or profile, it must be removed before signing the tender form; thereafter the Contractor will be bound by the decision of the Engineer on all points. F.30.l7 GUARANTY BONDS The Municipality shall have the right to require the Contractor to furnish bond covering the faithful performance of the contract and the payment of all obligations arising thereunder. F.30.18 TERMINATION OF CONTRACT Time shall be deemed the essence of this contract. All the work included in the contract must be concluded on or before the date fixed at the time of tendering. The Contractor further agrees that if at any time the Engineer shall be of the opinion and shall so certify in writing to the Municipal Council, that the said work or any part thereof is unnecessarily delayed or that the said Contractor is violating any of the conditions of this contract, or is not executing same in good faith, or if the said work is not fully completed within the time named in the contract for its completion, the Council shall have the power, five days after receiving notice from the Engineer, to notify the said Contractor to discontinue all further work and terminate all future performance thereof by the Contractor but reserving all claims against the Contractor for breach of contract by written notice to be served upon the Contractor either personally, or at his residence, or by registered mail, or with his agent in charge of the work. There- upon the Contractor shall discontinue said work, and the Council shall have the power to procure labour, tools, material and machinery, by contract or otherwise and to complete said work and to charge the expense thereof, including other damages of every name and nature due to the breach of contract, to the aforesaid contract. The expense so charged shall be deducted by the Council out of such monies as may then be due or may at any time therafter grow due to the said Contractor under or by virtue of the signed agreement. In such case, if expense shall exceed the amount payable under this contract, the Contractor shall pay the amount of such excess to the Municipality. F.30.l9 MATERIALS As part of the work included in this contract, the Contractor shall place any and all material resulting from this project only in locations approved by the Engineer. The requirement shall apply to all materials, no matter who supplied said materials, and further, shall apply to any and all excess material remaining on site at the completion of the project. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I ~ ~ . t f . - 1 - SECTION F PROJECT SPECIFICATIONS No. 31 Open Drains F.31.1 GEOMETRY The drain shall have the full specified bottom width at the specified grade line at the time of final inspection. Each side of an open drain shall be sloped at 1 meter vertically to 2 meters horizontally, or as otherwise specified or shown on the accompanying plan, profiles, and detail sheets. Each side of the drain shall be smooth and have a uniform slope from top to bottom. F.31.2 SPOIL BANK A clear berm or margin of at least 2 meters shall be left between the top edge of the open drain and the spoil bank. No excavated material is to be left in any ditches intended to conduct water into the open drain. In no case shall the side of the spoil bank closest to the drain be sloped greater than 1.5 H to 1 V unless otherwise specified. F.31.3 EXCAVATED MATERIAL Excavated material shall, in general, be placed on the lower side of the drain or on the side opposite trees or fences. It shall be deposited, spread and levelled to a maximum depth of 200 mm and left in a manner such that the lands on which it is spread may be cultivated with adjacent lands by use of ordinary farm machinery. Material excavated in land which is timbered may be spread to a maximum depth as specified on the profile or to a maximum depth of 600 mm if not specified on the profile. The Contractor is not responsible for the removal of stones or boulders from the excavated material. Disposal of excavated material shall be to the satisfaction of the Engineer. F.31.4 SURFACE WATER INLETS Surface water inlets to the drain shall be provided through the levelled spoil on each property at intervals of 100 meters or at locations as shown on the profile. No excavated material shall be left in, or any damage done to a ditch, furrow, pipe, tile or depression which is intended to conduct water into or across an open drain. ". . j -2....... F.31.5 ABANDONED CHANNEL Excavated material shall be used to fill abandoned channels as specified in the Special Information to Tenderers or on the detail sheets. F.31.6 FARM BRIDGES All farm bridges shall have a m~n~mum opening equal to the cross- sectional area specified in the report or on the profiles. F31.7 FARM CULVERTS If the owner, at the time of construction, has supplied a culvert of the specified size at the site, the Contractor shall install it as part of the work. The culvert shall be installed with the invert 150 mm below the grade of the drain. F31.8 EXCAVATION AT BRIDGE SITES The excavation at bridg~ sites shall be to the full depth of the drain and as nearly as possible the full width of the drain as specified for the bridge location. The excavation at a bridge site shall be made in a manner to protect the structural integrity of any permanent bridge. A temporary bridge may be carefully removed to allow excavation. The removal of said bridges is to be done in such a manner so as to cause no unnecessary damage to the bridge components. Temporary bridges removed to allow excavation shall be replaced in as good a condition as found so far as material allows. Replacing of such bridges shall be to the satisfaction of the Engineer. The Contractor shall notify the Engineer immediately it becomes apparent that excavating to a specified grade will endanger any culvert or bridge. The Contractor shall cease excavation at the bridge or culvert site until the Engineer instructs him to proceed. F31,9 SEEDING Unless indicated otherwise in the Special Information to Tenderers, the Contractor shall seed the newly excavated ditch banks, with a seed mixture and at a rate approved by the Engineer, at the end of each working day. F31.10 SEDIMENT CONTROL Unless indicated otherwise in the Special Information to Tenderers, the Contractor shall install an approved sediment control device at the downstream end of the open drain excavation and shall remove any accumulated sediment therefrom after the open drain work is completed. The sediment control device shall also be removed at the completion of the work, I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I \. '" "- 1 - '- '. SECTION F PROJECT SPECIFICATIONS No. 32 Tile Drains F.32.1 MATERIALS All tile installed under these specifications shall be sound and of first quality. Clay and concrete drain tile shall meet ASTM Specifications as set out in Designation C4 and C498 for Clay Tile or the latest revision thereof and/or C412 for Concrete Tile or the latest revision thereof. Corrugated plastic drainage tubing shall meet CGSB standard 41-GP-29 Ma, or the latest revision thereof. Tile supplied by the Contractor shall be approved by the Engineer prior to being incorporated in the work. The Engineer shall have the right to order any tests he deems necessary to be performed on the tile. All costs of such tests shall be borne by the Contractor. The Contractor shall be responsible for the unloading and placement of all materials required for the municipal drain construction. Such unloading and placement shall be undertaken in a manner acceptable to the Engineer. F.32.2 DRAIN GRADE The grades for the tile drain shall be established and controlled by laser grade control equipment mounted on the tile installation machinery or in the drain trench. F.32.3 TILE LAYING All tile shall be laid carefully in a smooth bottomed trench. All tile shall be laid together as tightly as possible. The maximum allowable space between successive tiles shall be 6 mm. Each tile shall be laid firmly on a solid bottom in the trench so that the successive tiles align both horizontally and vertically. If a wheel-type or chain-type ditching machine is not used to excavate the trench for the tile, the Contractor shall, at his expense, supply and install a layer of approved granular bedding material, at least 150 mm in depth, on the entire trench bottom, prior to placing the tile. The trench shall not be opened up for a distance greater than 60 m in advance of the tile laying. The trench shall have a maximum width at the top of the tile not greater than a value equal to the outside diameter of the tile plus 225 mm. All obstructions, dirt or foreign material shall be removed from the inside of the tile prior to laying. Tile drains shall be con- structed at an offset from and parallel to any existing ditch or defined watercourse. The Contractor shall exercise care not to disturb any existing tile drains which follow the same course as the new drain. ~ ~;l - 2 - F.32.5 MAIN TILES ENCOUNTERED Any subsurface drain encountered by the Contractor when constructing a municipal drain under these specifications, shall be either reconnected or connected to the new drain being constructed, as directed by the Engineer. The normal practice for reconnecting existing tile drains, up to and including 150 mm diameter (6"), will be to hand compact uncontaminated sub-base material from the new trench bottom to the underside of the existing tile. After adequate consolidation has been achieved, a perforated plastic drainage tube of sufficient size to slide over the outside of the existing tile shall be coupled over the existing tile. This connection shall be made where the existing tile is sound. When completing backfilling at such a location, the Contractor shall take sufficient care to ensure that the new plastic drainage tubing is not damaged. Any tile drains encountered which are larger than 150 mm diameter (6") may, if approved by. the Engineer, have their upstream end connected to the new drain with suitable sized plastic drainage tubing or equal material, and the downstream end of said tile shall be plugged to prevent entry of foreign material into the said tile. The Contractor shall provide a unit price per connection in Section C, Form of Tender, and said unit price shall include the supply of all material labour and equipment necessary to make the said connection(s~. Further, the Contractor shall notify the respective landowner of any and all sub-surface drains encountered. F.32.6 BACKFILLING As the laying of the tile progresses, partial filling (blinding) shall be made at the sides sufficient to hold the tiles securely in place. After the work is inspected by the Engineer, the remainder of the excavated material shall be used to restore and maintain the natural surface of the ground. Care shall be exercised in backfilling the trench to see that no stone or boulder capable of damaging the tile is used in the backfill material adjacent to the tile. In no case shall stones having a diameter greater than 150 mm be used in backfill material within 300 mm of the tile. F.32.7 OUTLET PROTECTION The outlet end of a tile drain shall consist of a length of riveted corrugated steel pipe fitted with a rodent proof grating which is hinged at the top to allow the exit of foreign material from the tile. Unless otherwise specified, the end of the corrugated steel pipe shall be protected with hand placed riprap as specified by the Engineer. The riprap shall extend from the bottom of the receiving trench to the original ground surface and for a distance of at least 2 m from the end of the outlet pipe. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I - 3 - ,; ; F.32.8 JUNCTION BOXES Unless specified otherwise, J/B's shall be constructed of 20 MPa (minimum) reinforced concrete. The sides and bottom shall be 114 nun (4 1/2") thick. The inside dimensions shall be 600 nun x 600 nun (2' x 2'), and a 300 nun (1') sump shall be provided. Prefabricated boxes meeting the aforementioned requirements may be used subject to the Engineer's approval. Each J/B shall be placed such that the top extends 150 nun (0.5') above the ground surface. With the exception of DI/CB's all boxes shall have a plugged tile or blind inlet the same size and elevation as the inlet (to a maximum size of 300 nun (12"») placed in all sides not used by this drain. Suitable grouting material (concrete, unless specified otherwise) shall be placed around all tiles and/or pipes connected to the box. Welded steel junction box tops or grates shall be constructed of two pieces of 51 nun x 51 nun x 6 nun (2" x 2" x 1/4") angle iron, connected by 32 nun (1 1/4) steel tubing at 76 nun (3") centers with outside tubes 38 nun (1 1/2") from end of angle iron. The grate shall be fastened to the structure using non-corrosive fasteners. Buried junction boxes shall be constructed as described above with the following exceptions: no sump required; bottom and sides shall be 150 nun (6") thick; and top shall be 150 nun (6") thick concrete. Post and sign type markers, similar to those supplied by Coldstream Concrete Ltd., shall be supplied and installed at each junction box. F.32.8 CATCHBASINS Unless specified otherwise, catchbasins shall be constructed of 20 MPa (minimum) reinforced concrete with 114 nun (4 1/2") thick sides and bottom, inside dimensions of 600 nun x 600 nun (2'x 2') and a sump with a minimum depth of 300 nun (1'). Prefabricated basins meeting the aforementioned requirements may be used subject to the Engineer's approval. Each basin shall be placed such that the inlet (or top) is at the elevation specified on the "Junction Box - Catchbasin Details" sheet, and the exact field location of the basins shall be approved by the Engineer. Where ditch inlet catchbasins (DI/CB) are called for, the slope of the top shall be 2:1 unless specified otherwise. Grates for flat top catchbasins (FT/CB) shall be of similar construction to the grates specified for junction boxes (J/B) and shall be fastened to the structure using non-corrosive fasteners. Suitable grouting material (concrete unless specified otherwise) shall be placed around all tiles and/or pipes connected to the basin. The standard grate for a ditch inlet catchbasin (DI/CB) shall be the three sided protruding type consisting of three vertical sides, a flat top, and a bottom sloped to conform to the slope of the top of the DI/CB. Ditch inlet gratings shall be constructed from the same material as is specified for J/B tops. Post and sign markers, similar to those provided by Coldstream Concrete Ltd., shall be supplied and installed at each catchbasin. Field stone riprap shall be placed around each basin for a 1 m width. -------.. r .t. ::JI\ "¡".." 4~ F.32.10 STRIPPING Where it is necessary to strip material in order to install a municipal drain, the Contractor shall undertake such stripping in a manner such that when restored, the topsoil returns uncontaminated to the top of the stripped area. This would normally mean that the topsoil would be stripped and piled separately from the subsoil. The Contractor shall have regard for the working space provided for such stripping operations. Unless approved otherwise by the Engineer prior to work being undertaken, stripping shall be done using an hydraulic excavator, '. ------------. 'I I I I I I I I I I I I I I I I I I I
