BY-LAW NO. 95-38

BEING A BY-LAW to adopt an Overtime Policy for the Township of
Bruce.
WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, section 45,
authorizes a Municipality to pass by-laws regarding employee
remuneration.
NOW THEREFORE the Council of The Corporation of the Township of
Bruce deems it expedient that an Overtime Policy be established,
and enacts as follows:
1. That the Township of Bruce Overtime Policy, a copy of which is
attached as a Schedule "A" and forms an integral part of this
by-law, is hereby authorized and approved by the Council of
the Township of Bruce.
2. The Overtime Policy will be effective January 1st, 1995.
3. Where there is a conflict with any other by-law or policy, the
attached policy will supercede any previous policy.
By-law introduced and read a First time this TWENTY-EIGHTH day of
NOVEMBER, 1995.
By-law read a Second time this TWENTY-EIGHTH day of NOVEMBER, 1995.
By-law read a Third time and finally passed, signed, sealed, and
numbered 95-38 this TWENTY-EIGHTH day of NOVEMBER, 1995.

OVERTIME POLICY
Bruce Township Council recognizes that overtime is required to get
the job done in a variety of situations, the Council encourages the
staff to try to minimize the use of overtime where practical.
Council encourages the supervisors and Council itself, to work with
the staff to plan the work in a fashion to minimize the total
number of hours required to get the various job requirements
completed.
Council realizes that a certain amount of overtime will always be
required in circumstances beyond Council and staff control, such as
unforeseen situations, deadlines to meet, weather conditions,
assist contractors, attend meetings, etc..
Bruce Township Council encourages staff to bank overtime at one and
one-half times the hours worked (or other statutory rate) and take
the accumulated banked time off in lieu of pay as a measure to
reduce costs.
However, Council recognizes that staff are entitled to pay at
statutory rates normally one and one-half hours pay for each hour
worked beyond the normal work day or work week.
Council wishes to be kept up-to-date and informed on the amount of
overtime worked, paid, taken off or accumulated to assist them with
their management function.
Council asks staff to use up or be paid their overtime in the year
which it is earned, so the overtime does not accumulate a year end
liability to the municipality. In order to monitor the overtime,
Council is requesting quarterly reports of current status of
overtime and the staff members plans to clear up overtime.
While Council asks to have overtime used up or paid by year end,
Council realizes unusual circumstances could prevent this in some
circumstances. Council authorizes the Clerk or Road Superintendent
to authorize carryover of a maximum of three or four days in
unusual circumstances for their staff members, as long as Council
is promptly advised. If the Clerk or Road Superintendent wish to
carryover any overtime at year end, the approval would have to be
obtained from Council.
Authorization will be considered in circumstances which indicate
the carryover will be used up by January 31st in the following
year.
While the use of banked time is a voluntary plan, Council does
encourage its use to reduce costs. However, its use will have to
be monitored to see how this works and review any concerns which
might result from this plan.
Council hopes with good planning and staff awareness of Council's
desire to minimize costs associated with overtime, that a common
sense approach to the issue will help to achieve the desired
affects.
This policy effective January 1st, 1995.
