WHEREAS pursuant to the said Municipal Act, Section 8 (1) and 9 provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the • municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues and has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS Council passed Resolution #08/12/15 -06 at the August 12, 2015 meeting to proceed with the Request for Proposals including the Terms of Reference as outlined in Report CAO 2015 -09 and fund this expenditure from the Capital Reserve to be replenished in 2016 with property tax revenues generated from the SP Armow Wind Turbines AND WHEREAS Council deems it expedient to accept the tender of Swallow Acoustics Consultants Ltd. for the Wind Turbine Noise and Sound Emission Evaluation and Impact Assessment as outlined in Report No. CAO 2015 -10; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the request for proposal of Swallow Acoustics Consultants Ltd. for the Wind Turbine Noise and Sound Emission Evaluation and Impact e Assessment in the amount of $60,300.00 (net of HST), be hereby accepted. 2. That the Mayor and Chief Administrative Officer be authorized and directed to execute, on behalf of the Council of The Corporation of the Municipality of Kincardine, any contracts and other documents required to authorize such work to commence. 3. This by -law shall come into full force and effect upon its final passage. 4. Certificate of Insurance naming the Municipality as an additional insured and evidencing Liability Insurance in an amount of not less than $2,000,000 ($2 Million) as well as showing all other types and limits of insurance issued by their broker /insurer directly to the Municipality (to be obtained upon each expiry) 3. Signed copy of the Municipality of Kincardine Occupational Health & Safety Compliance form. Failure to provide this information will result in stoppage of work. 4. Clearance Certificate issued by the Workplace Safety Insurance Board (WSIB) directly to the municipality at intervals of 60 days from first issuance. Introduction Swallow Acoustic Consultants Ltd. (SACL) of Mississauga, Ontario is pleased to present this proposal for the baseline study of acoustic sound and infrasound of the Armow Wind project area, situated within the Municipality of Kincardine, Ontario. The Armow Wind project area consists of ninety - two wind turbines consisting of Siemens SWT- 2.3 -101 models with a rated capacity for the project of 180 MW. We understand that the baseline study described within the request for proposal (RFP) is desired by the Municipality of Kincardine as a means of documenting the existing conditions with the expectation that future operations of the Armow Wind Project could increase acoustic sound and infrasound levels experienced by inhabitants. 2. Scope of Work In the sections below we briefly outline the proposed scope of the work and the approach to each task with defined study deliverables: 2.1. Resources from the Municipality of Kincardine SACL will identify residences where field measurements can be conducted, on a preferential basis. Assistance will be required from the Municipality to negotiate with the owners of these residences so that access to the exterior property and interior of each residence is possible. Additionally, if any public lands are to be accessed then the Municipality should allow for such access by SACL. If permits are required for any purpose then cooperation would be of benefit towards expediting the work to completion. 2.2. Critical Analysis From the RFP, "A critical analysis of the determination that all of the Armow Wind Project area is designated as a Class 3 area, pursuant to the Ontario Noise Guidelines for Wind Farms. (Reference Noise Impact Assessment, Armow Wind Farm GL Garrad Hassan, September 2013)." SACL will review the relevant documents and provide commentary on whether or not the application of a Class 3 area is justifiable in terms of evaluations of noise impacts due to the future Armow Wind project. Establish Baseline Acoustic Sound and Infrasound Levels From the RFP, "Establish typical baseline receptor interior [acoustic sound] and infrasound levels at key locations within the Armow Wind project area, and at other locations within other Kincardine wind turbine installation project areas." SACL proposes undertaking measurements concurrently at five (5) residences that are in proximity to the future Armow Wind project area, where future operations of the wind turbines are expected to create the highest noise levels. The preferred residences would also be at an appreciable distance from intrusive sources of sound /infrasound including industrial sites, highways, and railways, such that secondary sources of sound /infrasound are minimized for both existing and future conditions. SACL further proposes that measurements be conducted concurrently at both an exterior and an interior microphone position, in order to adequately document that the baseline sound /infrasound are attributable to sources outside of each residence. As such, measurements will be conducted at a total of ten (10) positions, inside and outside each residence, for time periods of up to two (2) weeks each. During the measurements, one (1) consultant from SACL will be present on site to address any and all issues associated with obtaining continuously - measured infrasound data that is accurate and defensible. Additional staffing may be provided on a discretionary basis so as to ensure that instrumentation is installed and removed expeditiously. SACL will undertake measurements using instrumentation that is capable of narrow -band frequency acquisition using 1- minute time intervals to average the data. Concurrent measurements of relative humidity, temperature, wind speed and direction will be made at the exterior position for each residence using short-time intervals to synchronize with sound /infrasound data. 2.4. Interpret Data From the RFP, "Interpret the data gathered from the field investigation and examine relative to current academic research on the potential impacts of infrasound, how the findings may relate to the Armow Wind [project] specifically and to industrial wind farms generally, and provide conclusions and recommendations on possible mitigation measurements, as an if indicated." SACL will analyze the measurement data from exterior and interior microphone positions, for the existing condition, in order to discriminate between sounds that originate from the exterior and interior of each residence. The relevant results will be for interior sound /infrasound that is attributable to exterior sources. Measurements that are compromised by the activities of people within each residence will be identified and excluded from the reporting. SACL will prepare graphics that illustrate the relationship between measured levels of sound /infrasound and exterior meteorological parameters, such as wind speed and direction. SACL will compare the measurement data and results shown in graphics to thresholds of impact that have been identified with reference to current academic research and applicable regulation. 2.5. Document Pertinent Findings and Conclusions From the RFP, "Include any other pertinent findings and conclusions on the potential impacts from noise generated by the Amiow Wind [project] specifically, and from industrial wind turbines generally." Pertinent findings and conclusions will be provided regarding the findings in terms of noise impacts to human health that are associated with both existing conditions and future wind turbine operation. A single deliverable report will be provided that addresses the results of critical analysis, measurements of existing sound /infrasound levels, results of analysis and graphics, and findings and conclusions regarding both impacts to human health and regulatory compliance. 3. Deliverables One (1) draft report will be provided on or about November 30, 2015. A time period of two (2) weeks is assumed required by the Municipality of Kincardine to review the draft report and provide comments. One (1) final report will be provided by December 31, 2015. 4. Timeline • September 2015: Work with Municipality of Kincardine to identify appropriate measurement locations that allow for access to the interior of residences. • October - November 2015: Complete weeklong measurements at five (5) residences. • November 2015: Interpret data and draft report. • December 2015: Time period for comments and completion of final report.
