BEING A BY-LAW to regulate the collection, removal and disposal of waste in the Corporation of the Township of Bruce. WHEREAS the Municipal Act R.S.O. 1990, Chapter M.45, Section 210, Subsection 89, provides that a municipality may pass by-laws to establish and maintain a system for the collection, removal and disposal of garbage. AND WHEREAS the Council of The Corporation of the Township of Bruce deems it expedient to so establish, maintain and regulate a system for the disposal of waste within the municipality and to establish procedures, regulations, policies and fees for the disposal of waste and the recycling of waste materials; NOW THEREFORE the Council of The Corporation of the Township of Bruce enacts as follows: 1. TITLE. SCOPE AND DEFINITIONS 1.1 SHORT TITLE This by-law may be cited as the "Waste Disposal By-law". 1.2 SCOPE 1. 2.1 1. 2.2 The provisions of this by-law shall apply to persons, lands, structures and uses within the boundaries of the Corporation of the Township of Bruce, and the Village of Tiverton. No person shall dispose of, or cause to be disposed of, any waste, recyclable, refuse or garbage except in conformi ty wi th the provisions of this by-law and schedules attached hereto. 1.3 DEFINITIONS 1. 3.1 1. 3.2 1. 3.3 1. 3.4 Ashes shall mean the solid residue of any fuel for heating or cooking purposes, and soot or other cleanings from chimneys, fireplaces or heating appliances. Baq Taq shall mean the approved stick-on tag to be attached to each garbage bag placed for curbside pickup. Burn Area shall mean the area in the landfill site designated by signs or otherwise for the purpose of burning. Cardboard shall mean and include all material made from corrugated paper. Fill Area shall mean that operative area of the landfill site which is designated as an area for the disposal of waste and the subsequent covering by earth fill. Garbage shall mean and include all vegetable and animal matter subject to decay, whether it be household, commercial or industrial waste and shall include the receptacles and wrappings in which the same is placed. Garbage Baqs shall mean garbage bags manufactured for the use of garbage disposal having a maximum size of 77 cm by 97 cm (30" X 38"). Garbage Packer Truck shall mean a truck wi th an enclosed load-carrying receptacl e and machinery used to compact the load. Hazardous Waste shall include: paints, stains, varnish, urethanes, oils, herbicides, pesticides, car batteries, pharmaceutical, pool chemicals, gas cylinders and any other items considered a hazardous waste. Joint Board of Manaqement shall mean a board comprised of three members of the Council of the Corporation of the Township of Bruce, and two members of the Counci 1 of the Corpora ti on of the Village of Tiverton, as per the terms of the joint agreement. Landfill Site shall mean a waste disposal si te designated and operated by the Corporation of the Township of Bruce and the Joint Board of Management, for the disposal or transfer of waste in accordance with the provisions of this by-law and the terms and conditions of a Certificate of Approval issued by the Ministry of the Environment and Energy. Occupier shall mean a person who is in physical possession of premises or who has responsibility for and control over the condition of premises or the activities there carried on, or control over persons allowed to enter the premises. Prohibi ted Waste Material s shall mean any waste other than garbage and as set out in Schedul e "B" to this by-law. Recvclable Waste shall mean any material that is acceptable under the recycling program for the Township of Bruce and/or the Village of Tiverton. Refuse shall mean and include all waste materials such as broken crockery and glass, jars, bottles, bones, discarded wearing apparel and all kinds of refuse not subject to decay other than those items accepted by recycling. Scavenqinq shall mean the unauthorized removal of reusable materials from in, around or among disposable solid waste at the landfill site. Scrap Metal Area shall mean the area of the site designated by signs or otherwise for the purpose of recycling scrap metal. Ti ppinq Fees shall be a waste disposal established by the Council as set out in "A" to this by-law. fee, as Schedule Ti re Area shall mean the area of the si te designated by signs or otherwise for the purpose of placing tires. Township shall mean the Corporation of the Township of Bruce. Villaqe shall mean the Corporation of the Village of Tiverton. Waste shall mean garbage, approved for disposal Environment and Energy. refuse and other materials by the Ministry of the Waste Disposal Attendant shall mean the employee(s) appointed by Council responsible for the supervision and operation of the landfill site and for the administration of this by-law. LANDFILL SITE 2.1 No person shall use any lands wi thin the Township of Bruce or the Village of Tiverton for the purpose of a waste disposal si te except lands designated by by-l aw for such use by the Council of the Corporation of the Township of Bruce or the Ministry of the Environment and Energy. 2.2 The landfill site shall be operated and maintained by the Corporation of the Township of Bruce in accordance with the terms and conditions of the site Certificate of Approval, the provisions of this by-law, the provisions of the Joint Board of Management Agreement, and the requirements of the Ministry of Environment and Energy. 2.3 Hours of Operation 2.3.1 2.3.2 2.3.3 No person shall deposit refuse, garbage, trade and industrial waste and building materials in the landfill site other than those days and during those times as may be established by the Council from time to time. Notice of such dates and times and any changes thereto shall be published by the Township. Notwi thstanding the provisions of section 2.3.1 above, public access to the landfill site shall be restricted to those times when a Waste Disposal Attendant is on duty and in attendance at the site as set out in Schedule "A". No person shall trespass on the landfill site except as is required to transfer material to the site in accordance with this by-law, or as is necessary to conduct lawful business with the Township during designated hours of operation of the landfill site in the presence of the Waste Disposal Attendant or other authorized Township official. 3. GENERAL PROVISIONS 3.1 No person shall dispose of, or cause to be disposed, waste at the landfill site that originates or is generated from a location or use outside of the municipal boundaries of the Township of Bruce or the Village of Tiverton, and is not in accordance with the Certificate of Approval. 3.2 Persons shall dispose of permitted waste at the landfill site in accordance with the directions of the Waste Disposal Attendant and in accordance with the provisions of this by-law and the Ministry of Environment and Energy. 3.3.1 3.3 Containers and Garbaqe Baqs 3.3.2 Each garbage bag shall have affixed to it an approved Township of Bruce/Village of Tiverton garbage bag tag. No person shall place garbage for collection unless the same has been packaged and prepared in accordance with this by-law. CORPORATION OF THE BY-LAW NO. 96-22 PAGE 5 3.3.3 3.3.4 3.3.5 3.3.6 3.3.7 3.3.8 3.3.9 TOWNSHIP OF BRUCE Garbage may be placed in containers equipped with tightly fitting removable lids and proper handles, and not exceeding the size and weight as defined in this by-law. All waste is to be placed inside securely closed plastic bags and the top bag shall have affixed to it a bag tag that is clearly visible when the lid of the container is removed. Garbage collection shall be carried out on a weekl y basis beginning no earl ier than 7: 00 a.m. on the day of collection, and is subject to change. Every pI astic bag shall be securel y tied to prevent spillage and be of sufficient thickness to eliminate tearing and the weight of the contents shall not cause breakage and shall not weigh more than 18 kilograms (40 pounds). No person shall place ashes for collection. No person shall remove a bag tag from a bag of refuse belonging to another. No person shall copy, counterfeit or in any other way attempt to duplicate the Township of Bruce/Village of Tiverton's bag tag. Owners and/or Occupiers of premises shall utilize the services of the recycling program as provided by the Bruce Area Solid Waste Recycling Association Inc. Failure to do so could result in garbage not being collected. 3.4 For the purpose of this by-l aw, the defini tions and interpretations given in this by-law shall govern. In this by-law, "Shall" is mandatory; words in the singular include the plural; words used in the masculine gender include the feminine and vice versa. 4. MANAGEMENT/OPERATION OF THE LANDFILL SITE 4.1 The Township may provide and designate such areas within the Landfill Site as it deems necessary and appropriate for the removal, temporary storage and handling and processing of all wastes regulated under this by-law. 4.2 All waste collected by the Township or Village or by any citizen or private contractors within the limits of the Township or Village and on the Certificate of Approval shall be deposited at the site. 4.3 Corrugated facilities materials. cardboard provided accepted only collection of at the these will for be the 4.4 The landfill site shall be under the supervision of the Waste Disposal Attendant. 4.5 No person shall place during the hours of Schedule "A" attached waste at the landfill site except operation, or as specified on to this by-law. All waste delivered to the landfill site shall be placed under the direction of the Waste Disposal Attendant. No person shall enter the landfill site for any purpose other than depositing waste wi thout the prior approval of the operating authority. 4.9 Fees for the disposal of waste at the landfill site shall be established by Council as set out in schedule "A" attached to this by-law. Notice of such fees and any changes thereto shall be published by the Township and shall be applicable to all persons authorized to use the site. 5. ADMINISTRATION 5.1 The Waste operations compliance Disposal Attendant shall supervise all at the landfill site and shall enforce with the provisions of this by-law. 5.2 Council may by resolution grant permission to community groups, special activities and other circumstances where Council deems such actions are within the public interest and not contrary to the intent of this by-law. 5.3 Council may authorize studies and programs and prepare policies for the maximization of the life expectancy, efficiency and effectiveness of the landfill site and the reduction, reuse and recycling of waste. 5. Any person requesting the Landfill Site to be opened on any other hours than the normal open hours shall m a k e arrangements with the Municipal Office or the Landfill Site Supervisor and shall pay a $20.00 base fee plus applicable tipping fees. Thereafter, an additional fee of $20.00 per hour will be charged for the duration of time the landfill site remains open for the disposal of waste outside of normal hours of operation. NORMAL HOURS OF OPERATION Mid May to Mid September Tuesday - 1:00 p.m. to 9:00 p.m. Saturday - 9:00 a.m. to 5:00 p.m. Mid September to Mid May Tuesday - 1:00 p.m. to 5:00 p.m. Saturday - 9:00 a.m. to 5:00 p.m. ROOFING & DEMOLITION & ALL OTHER WASTE (EXCLUDING EXCEPTIONS LISTED BELOW) All material disposed of at the site must be sorted into designated areas. Roofing and demolition material is deemed to be sorted when clean, burnable wood and scrap metal is separated from non-recyclable roofing and demolition material. No charge is levied for the disposal of clean, burnable wood and recyclable scrap metal. No charge is levied for compost material disposed of in the compost area. The bags or containers must be emptied by the person disposing of the material. DESIGNATED AREAS OF DISPOSAL as defined in Section 3.1 of this By-Law Burn Area - the following materials will be accepted for disposal in the Burn Area: Clean wood Brush Tree branches Any other clean wood product as determined by the Waste Disposal Attendant. 2. Heavy Metal Area - the following materials will be accepted for disposal in the Heavy Metal Area: Scrap metal Steel Iron Aluminum Any other metal material as determined by the Waste Disposal Attendant. Clean, corrugated cardboard free from grease, food, oil and paint shall be accepted for recycling. Cardboard shall be flattened and deposited within the containers provided located at the I andfi II si te and in compliance with the directions of the Waste Disposal Attendant and/or at anyone of the approved designated locations in the municipalities. 2.
