HomeMy WebLinkAboutBRU 96 023 vacation policy THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 96-23 . BEING A BY-LAW to adopt a Vacation Pol icy for the Township of Bruce. WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, section 101 and Section 102 authorizes a Municipality to pass by-laws. AND WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, Section 20, Subsection 45 allows for fixing of remuneration and security for performance of employees duties. NOW THEREFORE the Council of The Corporation of the Township of Bruce deems it expedient that a Vacation Policy be established, and enacts as follows: 1. That the Township of Bruce Vacation Policy, a copy of which is attached as a schedule and forms an integral part of this by- law, is hereby authorized and approved by the Council of the Township of Bruce. 2. The Vacation Policy will come into effect for the 1996 calendar year. 3. Where there is a conflict with any other by-law or policy, the attached policy will supercede any previous policy. The current vacation entitlement is as follows: a) Part-time employees receive vacation entitlement as 4% vacation pay on their regular pay. b) Full-time employees receive 4% pay at the end of their first year of employment (based on two weeks vacation entitlement) to pay those employees up to December 31st for the first year of employment. Then all full-time employees earn vacation based on a calendar year and the entitlement is prorated for any partial year. On termination of employment, an adjustment would have to be calculated and paid, or deducted from the last pay, based on entitlement and vacation received. c) Three senior staff the Clerk-Treasurer, Deputy Clerk- Treasurer, and Road Superintendent receive an extra week of vacation entitlement as set up in the terms of their hiring by-laws. Otherwise, these staff are subject to all the same rul es as full-time employees for vacation enti tl ement. The Clerk-Treasurer and Road Superintendent have their vacation requests approved by the Reeve on behalf of Council. All vacation requests are to be submitted in writing by employees, using the current standard vacation request form, to the employees immediate supervisor for approval, and the original copy of the approval is filed in the employee's file. For the first five full calendar years, the entitlement is two weeks paid vacation. For the next five full calendar years, the entitlement is three weeks paid vacation. For the next ten full calendar years, the entitlement is four weeks paid vacation. After that, the entitlement for each full calendar year would be five weeks paid vacation. -- - .. A· 1:;0 By-law No. qL..:l~ passed this 'il~\\ dilly of ~ be.r :=~~ THE CORPORATION OF THE TOWNSHIP OF BRUCE SCHEDULE "A" BY-LAW NO. 96-23 The staff and supervisors are encouraged to consider municipal objectives and work schedules when requesting vacation leaves and try to have requests and approvals to be in harmony with these objectives, work schedules, and other employees requests. In the event of conflict, the supervisor is expected to make the approval decisions. If there is dissatisfaction with the approval or a potential conflict, then either the employee or supervisor can request Council's input into the approvals. Council decisions shall be considered final. Supervisors are authorized to approve a maximum period of three continuous weeks off at one time. If a request is for a period of more than three continuous weeks off at one time, the request is to be referred to Council for approval. Employees are encouraged to use up their full entitlement of vacations in the calendar year in which they are earned. Supervisors can approve a maximum carryover of one week (five days) from one calendar year to the next calendar year provided that the employee plans to use up these (5) five carried over days by 3anuary 31st of the second calendar year. If there is a request to carryover more than five days or to extend the carryover beyond 3anuary 31st of the second calendar year, then the request should be made directly to Council for approval. The supervisors are to monitor their employee's request to ensure the terms are being complied with and to report any concerns as soon as they become apparent. Early reporting to Council allows Council more flexibility to deal with the issues. The present full-time Road Department employees will be allowed to accumulate overtime to allow their vacation entitlement to reach the same level as the vacation entitlement of the Road's Foreman.
