NO. 2015 - 092
BEING A BY -LAW TO ACCEPT A TENDER FOR A
RUBBER TIRE ARTICULATED LOADER
(Nortrax Canada Inc.)
WHEREAS pursuant to the Municipal Act, 2001, S.O. 2001, c. 25 as amended,
Sections 8 (1) and 9 provide that the powers of a municipality under this or any
other Act shall be interpreted broadly so as to confer broad authority on the
• municipality to enable the municipality to govern its affairs as it considers
appropriate and to enhance the municipality's ability to respond to municipal
issues and has the capacity, rights, powers and privileges of a natural person for
the purpose of exercising its authority under this or any other Act;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it necessary replace a rubber tire articulated loader at the Ward 3
(Underwood) site and included $225,000.00 in the 2015 budget for this purpose;
AND WHEREAS the Council of the Municipality of Kincardine deems it expedient
to accept the tender of Nortrax Canada Inc. for a 2015 Model Year Rubber Tire
Articulated Loader as outlined in Report No. PWD 2015 -06;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the tender of Nortrax Canada Inc. for a 2015 Model Year John Deer
Power Tech, Rubber Tire Articulated Loader, in the amount of $200,797.42
(including applicable taxes and a trade in amount of $22,000.00), be
hereby accepted.
2. That the Mayor and Chief Administrative Officer be authorized and directed
to execute on behalf of the Council of The Corporation of the Municipality
of Kincardine, any contracts and other documents required to authorize this
purchase.
3. This by -law shall come into full force and effect upon its final passage.
4. This by -law may be cited as the "Rubber Tire Articulated Loader (Nortrax
Canada Inc.) By -law ".
READ a FIRST and SECOND TIME this 10th day of June, 2015.
READ a THIRD TIME and FINALLY PASSED this 10th day of June, 2015.
