BEING A BY-LAW to authorize the maintenance of the Ribey Drain in
the Township of Bruce and the payment therefore by the lands and
roads affected.
WHEREAS the Council of the Township of Bruce has received a written
request for the maintenance of the Ribey Drain, as is more
particularly delineated in red on the plan attached hereto as
Schedule "A".
AND WHEREAS this municipal drain was constructed after a report by
A. M. MacKay & Associates Limited, dated August 22, 1968 and
approved by By-law No. 974 of the Corporation of the Township of
Bruce, being the current by-law.
AND WHEREAS the Council of the Township of Bruce decided to proceed
with the maintenance of a portion of this drain without obtaining
the report of an Engineer, in accordance with Sections 74 and 75 of
The Drainage Act.
AND WHEREAS in accordance with Section 74 of The Act, the cost of
the maintenance of municipal drains is to be at the expense of all
the upstream lands and roads in any way assessed for the
construction or improvement of the drainage works and in the
proportion determined by the current by-law pertaining thereto.
AND WHEREAS the estimated cost of this maintenance was $1,200.00
(twelve hundred dollars).
AND WHEREAS $1,200.00 was the estimated amount to be contributed by
the lands and roads in the Township of Bruce for the maintenance of
this municipal drain.
AND WHEREAS the Council of the Township of Bruce decided that the
maintenance of this municipal drain is desirable.
AND WHEREAS the drain maintenance has been completed at a cost of
$1,232.91.
NOW THEREFORE the Council of the said Township of Bruce pursuant to
the provisions of The Drainage Act, enacts as follows:

Firstly: That the following repairs are hereby authorized and
shall be completed in accordance herewith; that portion
of the drain situated at Lot 7, Concession 13 marked as
"E" in red on Schedule "A" is to have approximately 120
feet of six inch clay tile replaced with 120 feet of
eight inch tubing, and the eroded area regraded
approximately 400 feet.
Secondly: The total amount of $1,232.91 necessary to be raised by
the Township of Bruce for such drainage works, shall be
made a cash assessment upon the lands and roads affected
by the said municipal drain. That the Clerk be
authorized to levy the rates to the assessed landowners,
as per the attached Schedule "B", without a grant
allowance as there is no ministry funding available for
this project.
Thirdly: This by-law comes into force and takes effect upon the
final passing thereof and may be ci ted as the Ribey
Drain, Maintenance By-law, 1998.
By-law introduced and read a First time this THIRD day of FEBRUARY,
1998.
By-law read a Second time this THIRD day of FEBRUARY, 1998.
By-law read a Third time and finally passed, signed, sealed, and
numbered 98-11 this THIRD day of FEBRUARY, 1998.
