HomeMy WebLinkAboutBRU 98 029 lawn garden services THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 98-29 BEING A BY-LAW to regulate the use of hoses, sprinklers and soakers for lawn and garden service for the area known as the Township of Bruce for the area known as the Village of Tiverton. WHEREAS it is provided by the RSO 1990 Chapter 0.40 that the Corporation may pass by-laws for regul-ating the time, manner and extent and nature of the supply to which and to whom the water shall be furnished, the price to be paid therefore, and every other matter or thing related to or connected ther_ith that it may be necessary or proper to regulate, in order to secure to the inhabitants of the Municipality a continued and abundant supply of pure and wholesome water. NOW THEREFORE the Council of the Corporation of the Township of Bruce enacts às follows: 1. No owner, occupant, tenant, firm or corporation shall use water for lawn or garden fr01l the service provided by the Township of Bruce for the area known as the Village of Tiverton water systea except: approximately one half of the Village's population being permitted to use the service at any one time and the Village being divided so that north of Queen Street shall be permitted to water on the odd dates of the month and the remainder being permitted to water on the even dates of the month. That the hours of use shall be from six o'clock to nine o'clock in the morning and from six o'clock to nine o'clock in the evening. 2. No person shall: (a) Willfully hinder or interrupt or cause or procure to be hindered or interrupted, the Corporation or any of its officers, contractors, agents, servants or workmen in the exercise of any of the powers conferred by this by-law; (b) Willfully let off or discharge water so that the water runs waste or useless out of the works; (c) Being a tenant, occupant or inmate of any house, building or other place supplied with water from the waterworks, lend, sell or dispose of the water, give it away, permit it to be taken or carried away, use or apply it to the use or benefit other than his own, increase the supply of water agreed for or improperly waste the water; (d) Without lawful authority willfully open or close any hydrant, or obstruct the free access to any hydrant, stopcock, chamber, pipe or hydrant-chamber, by placing on it any building material, rubbish or other obstruction; (e) Throw or deposit any injurious or offensive _tter into the water or waterworks, or upon the ice, if the water is frozen, or in any way fouls the water or co_it any willful d~ge or injury to the works, pipes or water or encourages the same be done; (f) Willfully alter any meter placed upon any service pipe, or connected ther_ith, within or without any building or other place, so as to lessen or alter the amount of water registered; (g) Lay or cause to be laid any pipe or _in to communicate with any pipe or _in of the waterworks or in any way obtain the water without the consent of the Corporation. (h) Anyone found guilty of an offence under this section is on summary conviction, liable to a fine of not more than $300.00 or may be imprisoned, without the option of a fine, for a term of not more than one month. THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 98-29 PAGE 2 3. This shall be in effect all year round commencing on the date of the final passing thereof. . 4. Any owner, occupant, tenant, firm or corporation found in violation of section 1 of this By-law subject to the following penalty: Warning at zero dollars, second offence at $50.00, third and subsequent offences at $100.00 each. 5. Failure to pay the penalty for the violation of section 1 will mean disconnection of water service. 6. Council may by resolution amend this by-law recoaaendation of the ontario Clean Water Agency, occur which require liaited watering for a period 7. That Tiverton By-law No. 78-9 is hereby repealed. upon the if changes of time. By-law introduced and read a First time this 'lWENTY-THIRD day of JUNE, 1998.
