BEING A BY-LAW authorizing the sale of surplus lands by the Township of Bruce.
WHEREAS by By-law No. 96-14 passed the 23rd day of July, 1996 the Township of
Bruce did establish procedures for the sale of real property owned by the
rrunicipali ty.
AND WHEREAS by resolution passed May 26th, 1998, the Council of the Township of
Bruce did declare Parts 2, 4, and 5, Reference Plan 3R-2811 as being surplus to
the needs of the Township.
AND WHEREAS by resolution passed May 26, 1998, the Council did authorize the
lands to be appraised by an "Opinion of Value" fran a local realtor.
AND WHEREAS by resolution passed May 26, 1998, the Council did establish terms
for the advertisement for sale and receipt of bids for the sale of the said
lands.
AND WHEREAS the Township of Bruce has received bids fran persons who wish to
purchase the lands.
NCM 'mEREFORE be it enacted and it is enacted by the Council of the Township of
Bruce as follows:
1. That the tender of Ken Robinson in the arrount of $2,000.00 for the
purchase of Part 2, Reference Plan 3R-2811 be accepted.
2 . That the tender of Jack McMann in the aroount of $3,000.00 for the purchase
of Parts 4 and 5, Reference Plan 3R-2811 be accepted.
3. That the sale of Part 2, Reference Plan 3R-2811 is subject to receipt of
written confirmation fran the purchaser regarding the following matters:
-.
the well located on the land has been contaminated in the past
and the well water is not potable;
the purchaser assures all liability for use of the land
including the well and provides a release and indennification
to the Township of Bruce;
the existing pump, electrical service and water distribution
lines wi 11 be removed;
the purchaser will agree to advise future owners of the status
of the well water and the requirement to establish certified
confirmation that the well water is potable before being used
for human consumption.

Both purchasers will be required to provide written acknowledgement
confirming that they are aware that these lands are not and cannot be
connected to the Underwood Water System operated by the Township of Bruce,
and that building permits are not and may never be available for these
lands.

5. Upon satisfactory catt>letion of these requirements and upon receipt of
payment in full for the purchase price, the Reeve and Clerk are authorized
to execute the deeds and such other dOCl.ments as may be required and to
deliver them to the purchaser.
