THE CORPORATION OF THE TOWNSHIP OF BRUCE
BY-LAW NO. 98-49
.
BEING A BY-LAW confirming the acquisition of land for highway
widening purposes and establishing the same as part of the public
highway system for the Township of Bruce.
WHEREAS pursuant to the Municipal Act, R.S.O. 1990, Chapter M.45,
Section 191(1), the Council of every municipality may pass by-laws
for acquiring land for municipal purposes.
AND WHEREAS pursuant to the said Municipal Act, Section 297(1)(b)
the Council of every municipality may pass by-laws for widening any
highway or part of a highway.
AND WHEREAS the Corporation of the Township of Bruce has from time
to time acquired land for the purposes of widening and improving
the existing Bruce Township public highway system.
AND WHEREAS it is desirous to confirm the acquisition of the land
as part of the Bruce Township public highway system.
NOW THEREFORE be it enacted and it is hereby enacted by the Council
of the Township of Bruce as follows:
- (1) That the acquisition of the lands described in the schedule
attached to this by-law are hereby confirmed and approved.
(2) That the said lands described in the schedule-attached to this
by-law are hereby acquired for highway widening purposes and
are accepted and dedicated as part of the public highway
system of the Township of Bruce.
(3) That this by-law shall become effective upon its final passage
by the Council of the Township of Bruce and upon its
registration in the Registry Office for the Registry Division
of Bruce (No.3).

The easements described on the schedule hereto and being Part afLot 4, Block D, Plan
104 as described in Box 5 of the attached easement are for the purposes of installing and
maintaining, drainage services, by the Corporation of the Township of Bruce.
In consideration of good and valuable consideration the sum of$I.00 paid by the
transferee to the transferor, the transferor grants to the transferee its successors and
assigns, the easements over the land described in Box 5 for the purposes referred to
above, including the rights:
1. To enter, construct, maintain, inspect and repair the agreed municipal services,
both above and below the surface of the land including all appurtenances thereto.
2. For the servants, agents, contractors and workmen of the transferee to enter with
machinery, material, vehicles and equipment necessary for the. use of the easemeri{'
The transferor covenants to keep the lands clear of all brush, trees and other obstructions
as may be necessary for the use of the easement.
The transferee covenants to install all work and to maintain same for the use of the
easement in a good and workmanlike manner and toretum the lands comprised in the
easement to the same condition as it was prior to such maintenance.

BY-LAW NO. 98-34
BEING A BY-LAW confirming the acquisition of land for highway
widening purposes and establishing the same as part of the public
highway system for the Township of Bruce.
WHEREAS pursuant to the Municipal Act, R.S.D. 1990, Chapter M.45,
Section 191(1), the Council of every municipality may pass by-laws
for acquiring land for municipal purposes.
AND WHEREAS pursuant to the said Municipal Act, Section 297(1)(b)
the Council of every municipality may pass by-laws for widening any
highway or part of a highway.
AND WHEREAS the Corporation of the Township of Bruce has from time
to time acquired land for the purposes of widening and improving
the existing Bruce Township public highway system.
AND WHEREAS it is desirous to confirm the acquisition of the land
as part of the Bruce Township public highway system.
NOW THEREFORE be it enacted and it is hereby enacted by the Council
of the Township of Bruce as follows:
(1) That the acquisition of the lands described in the schedule
attached to this by-law are hereby confirmed and approved.
(2) That the said lands described in the schedule attached to this
by-law are hereby acquired for highway widening purposes and
are accepted and dedicated as part of the public highway
system of the Township of Bruce.
(3) That this by-law shall become effective upon its final passage
by the Council of the Township of Bruce and upon its
registration in the Registry Office for the Registry Division
of Bruce (No.3).
By-law introduced and read a First time this ELEVENTH day of
AUGUST, 1998,
By-law read a Second time this ELEVENTH day of AUGUST, 1998.

The difficulty was that the registry office rules do not pennit using a description which excepts C
Part of a Part on a reference plan. Time pressures required that we register last year on the
understanding that the McGillivrays would obtain a new reference plan describing the parts of the
land which each in turn had lost to road widening. At this time I enclose a copy of Reference Plan
3R-6654 together with draft deeds from the respective owners reconveying the road lands to the
township. Could you please review and advise if same are acceptable and we will attend to their
execution and registration. To save time if I could be authorized to sign for these purposes as
solicitor for the township we can avoid the necessity of you signing the Land Transfer Tax Affidavit.
