THE CORPORATION OF THE TOWNSHIP OF BRUCE
BY-LAW NO. 98-50
BEING A BY-LAW formulating a plan for protecting property and the
health, safety and welfare of the inhabitants in any emergency
area.
WHEREAS the Province of Ontario has passed an Act which provides
for the Formulation and Implementation of Emergency Plans (Short
Ti tIe - The Emergency Plans Act, 1983) by the Council of a
Municipality;
AND WHEREAS this Act makes provision for Head of Council to declare
that an emergency exists in the municipality or in any part thereof
and also provides Head of Council with authority to take such
action or deliver such orders as he considers necessary and are not
contrary to law to implement the emergency plan of the municipality
and to protect property and the health, safety and welfare of the
inhabitants of an emergency area;
AND WHEREAS the Act provides for the designation of one or more
members of Council who may exercise the powers and perform the
duties of the Head of Council during his absence or his inability
to act;
AND WHEREAS the Act authorizes employees of a municipality to take
action under the emergency plans where an emergency exists but has
not yet been declared to exist;
NOW THEREFORE the Council of The corporation of the Township of
Bruce enacts as follows:
1. That the Emergency Plan entitled, "Municipal Emergency Plan
for the Township of Bruce and the Township of Kincardine
Revision 4, 4th October, 1998" on file in the Municipal Office
comes into effect 13th November, 1998 after it is executed.

That the "Municipal Emergency Plan for the Township of Bruce,
the Township of Kincardine and the Village of Tiverton
Revision 0, November 1994" is hereby declared obsolete and is
replaced by the "Municipal Emergency Plan for the Township of
Bruce and the Township of Kincardine Revision 4, 4th October
1998".

3. That the Reeve and Clerk be authorized to sign the new plan on
behalf of Bruce Township.

That the Head of Councilor designated alternate as provided
in the Plan is empowered to declare an emergency;
5. That certain appointed official s or their designated
al ternates as provided in the Municipal Emergency plan are
empowered to cause an emergency alert to be issued to members
of the Municipal Control Group and to take action under the
emergency plans where an emergency exists but has not yet been
declared to exist; and
6. That annua11 y, the Municipal Control Group wi 11 cause the
emergency plan to be reviewed and to make such changes to the
Emergency Notification Fan-Out and Emergency Telephone and
Resource Directory as are considered appropriate while
referring all other changes to Council for further review and
approval.
7. That By-law No. 98-48 is hereby repealed.

By-law read a Third time and finally passed, signed, sealed, and
number 98-50 this TENTH day of NOVEMBER, 1998.
