BY-LAW NO. 2004 -189 BEING A BY-LAW TO DETERMINE THE PROCES FOR THE COMMUNITY CONSULTATION TO BE CONDUCT D BY THE STRATEGIC COUNSEL TO DETERMINE PUBLIC OPINION REGARDING THE MANAGEMENT OF LOW AND IN ERMEDIATE LEVEL WASTE WITHIN THE MUNICIPALITY OF K NCARDINE WHEREAS Section 130 of the Municipal Act, 2001, 5.0. 001, c. 25, as amended, provides that a municipality may regulate matters for purposes related to the health, safety and well being of the inhabitants of the mu icipality; AND WHEREAS pursuant to the said Municipal Act, Secti ns 8 and 9 (1), municipalities are provided with powers of a natural person t enable them to govem their affairs as they consider appropriate and to enha ce their ability to respond to municipal issues; AND WHEREAS The Council for the Corporation of th Municipality of Kincardine authorized entering into an agreement with Ontario ower Generation Inc. for the management of low and intermediate level nuclea waste within the Municipality of Kincardine with the adoption of By-law No. 2004 - 157; AND WHEREAS the agreement with Ontario Power Generati n Inc. documents the provision of an independent community consultation by t e Municipality to ascertain the public's support of the project; AND WHEREAS The Council for the Corporation of th Municipality of Kincardine entered into an agreement with the Strategic Counsel for the provision of professional services to conduct an indepe dent community consultation with the adoption of By-law No. 2004 - 176; AND WHEREAS the Corporation of the Municipality of Ki cardine deems it expedient to determine the process to be utilized by The Strat gic Counsel when conducting the community consultation to determine pUblic op nion regarding the storage of low and intermediate level waste; NOW THEREFORE the Council for The Corporation of t e Municipality of Kincardine ENACTS as follows: 1. That The Strategic Counsel has been engaged to con uct a community consultation by polling every adult determined, by the req irements set out in Municipality of Kincardine By-law No. 2004-182, to be eli ible, and providing them with an opportunity to comment on the possibility of managing low and intermediate level nuclear waste at the Westem Waste Ma agement Facility. .../2 ... . e- - Page 2 Community Consultation Process By-Jaw No. 2004 - 189 2. That The Strategic Counsel will conduct the community onsultation by following the ensuing process: , i) The consultation will begin January 6, 2005; I ii) Each household will be contacted by telephone; seaso~al residents will receive mailed ballots; , iii) Each household will be asked to identify all eligible part cipants; iv) Each eligible participant who chooses to participate will be read a preamble and asked to respond to the consultation qu tion; v) If, after 10 telephone attempts, no contact is made ballots will be mailed; ~ vi) Summary results will be reported to the Municipali of Kincardine, however, individual voting details will be held in co fidence by the polling firm; . vii) BDO Dunwoody will conduct a limited process audit. 3. Pollsters employed by The Strategic Counsel, when conducting the community consultation, will pose the following preamble and question: "Preamble The Kincardine Council has expressed its support fo the long-term management of low and intermediate level nuclear waste in a deep geologic repository to be owned and operated by Ontario Power eneration at the Western Waste Management Facility located at the Bruce si Council's decision was based on the following key points: ~ It provides the highest level of safety of an option. ~ There will be a rigorous environmental assessment and Canadian Nuclear Safety Commission r gulatory process that includes opportunities for publi input before construction is approved. ~ The deep geologic repository will perma ently isolate the low and intermediate level waste stream,¡much of which is already stored on site. I ~ It provides significant economic benefit t~ the residents of the Municipality. I ~ No high level waste or used nuclear fuel wfUld be allowed in the facility. , In summary, Council believes it is important to solicit the vi s of residents. Question: Do you support the establishment of a facility f r the long-term management of low and intermediate level waste at t e Western Waste Management Facility?
