WHEREAS Section 391 of the Municipal Act, 2001, S.O. 2001, c. 25, provides authority for municipalities to pass by-laws imposing fees or class of persons for services provided by the municipality; . 1. 2. 3. 4. 5. 6. 7. - AND WHEREAS Section 12 (2) of O.Reg. 244/02, provides that the a ount of fees or charges for the use of a waste management system, the use of a sew ge system or the consumption of water shall not exceed the cost of providing the waste management system, sewage or water system; AND WHEREAS Section 12 (3) of O.Reg. 244/02 provides that a by-I w for the setting of fees for the use of a waste management system, a sewage system or the consumption of water, if not repealed earlier, expires on December 31 of the year foil wing the year in which the by-law was passed. AND WHEREAS the Council for the Corporation of the Municipality of Kincardine deems it advisable to pass a by-law to set fees for solid waste management, s nitary sewer and water capital, and sanitary sewer and water operating charges; NOW THEREFORE the Council for The Corporation of the Municipali of Kincardine ENACTS as follows: That the rates and fees for Solid Waste Management, as des ribed in the attached Schedule "A"", be hereby set. That the rates and fees for Sanitary Sewer Capital Charges, a described in the attached Schedule "B", be hereby set. That the rates and fees for Water Capital Charges, as describ d in the attached Schedule "C", be hereby set. That the rates and fees for Sanitary Sewer Operating Charge ,as described in the attached Schedule "D", be hereby set. That the rates and fees for Water Operating Charges, as des ibed in the attached Schedule "E", be hereby set. That this by-law shall supercede any other by-law inconsisten with the provisions in this by-law.
