THE CORPORATION OF THE VILLAGE OF TIVERTON
BY~LAW NUMBER 93-4
A BY-LAW TO ESTABLISH A PERSONNEL POLICY FOR EMPLOYEES OF THE
VILLAGE OF TIVERTON.
WHEREAS Councils of municipalities are authorized to pass by-
laws for providing personnel policies for employees.

AND WHEREAS it is deemed advisable to pass such a by-law.
NOW THEREFORE the Council of the Village of Tiverton enacts
as follows:
1. VACATIONS
1.1 Vacations for full time employees will be as
follows:
1.2
employees who have completed on~year of continuous
service shall receive annually two weeks vacation
with pay.
1.3
employees who have completed 3 years of continuous
service shall receive annually three weeks
vacation with pay.
1.4 employees who have completed 10 years of continuous
service shall receive 4 weeks vacation with pay
1.5 Vacations for all other employees will be according
to the Employment standards Act.
2. PAID HOLIDAYS
2.1 The Clerk Treasurer will be granted the following
holidays with pay to be calculated at their regular
straight time rate for the position:

2.2
The Public Works Foreman will be granted the
following holiday with pay to be calculated at
their regular straight time rate for the position.
The following holidays were taken from the Job
Description for this position:
New Year's Day
Good Friday
Easter Monday
Labour Day
Canada Day
Civic Holiday
Victoria Day
Christmas Day
Boxing Day
Thanksgiving
Day
2.3
The vacation request must be submitted and approved
prior to any holidays being taken, and will form
part of this by-law and attached as .. Schedule A"
2.4
Vacation pay to casual or part time employees will
be paid at the rate of 4% per pay.
2.5
Where a paid holiday falls within an employee's
vacation period, an extra day off shall be granted
at a mutually agreeable time. The additional day
shall be taken at a time such that the efficient
operation of the Corporation's business is not
disrupted.
2.6
Where a paid holiday falls on a Saturday or Sunday
and this is a non-scheduled working day, the next
working day following will be taken off in lieu.

3 BEREAVEMENT LEAVE
3.1
In case of the death of a member of an employee's
immediate family, a leave of absence of no more
than three calendar days, ending on the day of the
funeral, with pay.
3.2 "Immediate Family" is defined as: wife, husband,
common law wife, common law husband, child, mother,
step-mother, father, step father, brother, sister
grandchild, brother in law, sister in law, mother
in law, father in law (included common law
relation) grandparent.
4. LEAVE OF ABSENCE
4.1 Leave of absence for training, education or other
circumstances will be considered on the basis of
each particular case.
4.2 An employee, with the approval of Council, may be
allowed a leave of absence from work. No payment
will be made to the employee during the time
he/she us absent from work, but fringe benefits
will be kept in force.
5. SICK LEAVE
5.1 sick leave shall be five days after six months
employment, then:
5.2 one day per month to a maximum of 8 days per year.
5.3 accumulation of unused days not to exceed 60 days.

upon retirement, payment to be made from unused
accumulated sick days to date of retirement.
6.
PENSION
6.1
To be eligible for the Registered Retirement
Savings Plan an employee must be in the employment
of the Village of Tiverton for one continuous year
(12 months)
6.2
On or before December 31st of each year a
Registered Retirement Savings Plan in the amount of
two thousand dollars ($2,000.00 maximum) shall be
purchased for each employee in his or her name.

Employees ~ contribute one half of the Registered
retirement Saving Plan ($1,000.00 maximum), the

Village of Tiverton must contribute ($1,000.00
maximum) .
6.4 Any deviation from this plan will be considered on
an individual basis by Council.
6.5 Upon termination of an employee the amount for the
year of termination shall be prorated.
6.6 This plan applies only to full time employees who
do not take advantage of the Extended Health and
Dental Benefits.
7. HEALTH AND WELFARE

7.1
ONTARIO HEALTH TAX - The Employer shall pay 100% of
the Ontario Health Tax for all employees.
7.2
GROUP LIFE, ACCIDENTAL DEATH AND DISMEMBERMENT,
DEPENDENT LIFE, WEEKLY INDEMNITY AND LONG TERM
DISABILITY BENEFITS, the employer agrees to pay
100% of the premiums as set out by Mosey and Mosey
and underwritten by North American Life, and
attached as "Schedule B".
7.3
HEALTH AND DENTAL CARE BENEFITS the employer agrees
to pay 100% as set out by Mosey and Mosey and
underwritten by Green Shield Prepaid Services Inc.,
and attached as "Schedule B". These benefits are
applicable to full time employees who do not take
advantage of the PENSION PLAN.
7.4
In the initial year (1993) of benefits the Employer
realizes that it will become effective April 1,
1993, for the months of January, February, and
March the Employer will pay these monthly benefit
amounts less any benefit increases to Bob Lavigne
and Sharon Mooser on a salary percentage before
December 31, 1993.
7.5
Effective January 1, 1994 the plan will be 1n full
force.
7.6
All full time employees of the municipality will be
covered under the plan with the commencement of
employment and will be eligible to draw benefits
under the plan after he/she has completed the
probationary period of employment on a continuous
basis.
8. REMUNERATION SCHEDULE

8.1
All employees receive a cost of living increase
each January 1st based on the last years C.P.I.
(Ontario Consumer Price Index) or cost of
negotiated benefits.
8.2 All employees will be paid on a weekly basis.
Hourly employees must submit a time sheet.
9. PROBATIONARY PERIODS:
9.1 Employees selected for employment will be engaged
on a probationary basis. The length of the
probation shall be set by council at the time of
employment and will vary as to the nature of the
work and necessary skill required. Council may
extend the probationary period as may be seen
necessary but probationary employment will not
extend for more than a period of one year.
10. HOURS OF WORK
Regular hours of work for all full-time Village
employees shall be as follows:

OFFICE HOURS
Monday thru Thursday
9:00 a.m. to 5:00 p.m. with 1 hour for lunch

Friday 9:00 a.m. to 1:00 p.m.
32 hours per week
The Clerk-Treasurer in addition to the office hours
is required to attend 2 Regular Council meetings
per month (7 hours monthly maximum which is
included in the salary rate)
10.2
PUBLIC WORKS DEPARTMENT
Monday thru Friday
8:00 a.m. to 4:30 p.m.
40 hours per week
10.3 Although these hours are the regular hours of the
Public Works Department, there may be times when
the Village may be best served by altering these
hours. Any such alteration will be at the
discretion of the Public Works Committee.
11 OVERTIME PAY
11.1 An hourly rated employee who has worked more than
44 hours in a given week shall be paid for the
hours of work in excess of 44 once authorization
has been obtained from the Public Works Chairperson
or Reeve.
11.2 The Clerk-Treasurer will be paid overtime upon
authorization from the Reeve after 38 hours per
week.
11.3
The Employee will have a choice in overtime pay,
either the individual will be paid weekly or time
in lieu at the rate of 1.5 times.

12. PART TIME EMPLOYEES
12.1
Employees who are employed on a casual or part time
basis shall only be entitled to benefits under the
Canada Pension Plan and the provisions of the
Employment Standards Act, unless otherwise
specifically designated by Council.
13 GENERAL PROVISIONS
13.1
All questions or circumstances not covered by the
foregoing provisions are to be referred to Council
for a ruling.

This by-law shall be circulated to all employees
for their information
13.3
This by-law shall come into force upon the final
passing thereof and shall be referred to as the
Personnel Policy By-Law
13.4
This by-law hereby rescinds by-laws 88-12, 89-2.
90-3A and any other by-law dealing with personnel
policies.

3.
Definition of Disability
During the elimination period and for 24 months thereafter,
the employee is deemed to be disabled if he/she is wholly
prevented by injury or sickness from performing his/her
regular occupation.
After these 24 months, disability means the complete
inability of an insured employee, because of accidental
bOdily injury or sickness, to engage in any occupation or
employment for remuneration or profit for which he/she is
leasonably suited by reason of education, training or
experience.

Prescription drugs including oral contraceptives, syringes,
and needles, diabetic testing agents, insulin and all other

Private duty nursing inoluding the services of a Registered

Re: Bruce County-Wide BllPlov_ Benefit Plan
As per your request of February 17, 1993, we are pleased to
provide you with a brief synopsis and monthly cost of the
employee group benefits available under the Bruce County-Wide
Benefit Plan.
The comprehensive schedule of benefits outlined in our quotation
are available to all full-time employees and their eligible
dependents. Furthermore, all quoted rate structures and
contractual provisions are based on the combined volume of
the overall plan.
Please note that the Group Life, A.D.&D., Depen4ent Life, Weekly
Indemnity and Long Term Disability benefits are underwritten by North
American Life, while Health and Dental Care benefits are insured
through Green Shield Prepaid Services Inc. Both these insurers have
an excellent reputation in the public sector.
As the Bruce County-Wide plan is upcoming up for renewal, the rates
quoted in the attached synopsis may not be accurate.
Should your municipality decide to participate in the Bruce
County-Wide employee benefit plan, we will be pleased to provide
all the required documentation and back-up service to facilitate
implementation.
