THE CORPORATION OF THE VILLAGE OF TIVERTON
BY-LAW NO 94-3
A BY-LAW TO AMEND BY-LAW NO. 84-3, AS AMENDED,
BEING THE COMPREHENSIVE ZONING BY-LAW OF THE
CORPORATION OF THE VILLAGE OF TIVERTON
The Council of the Corporation of the Village of Tiverton
pursuant to section 34 of the Planning Act, 1990, ENACTS as
follows:
.
1. Schedule "A" to By-Law No. 84-3, as amended, being the
Comprehensive Zoning By-Law for the Corporation of the
Village of Tiverton, is here by amended by adding the
following paragraph (a) to Section 12.3 thereof:
(a)
Notwithstanding their "R7" zoning designation,
those lands delineated as "R7-1" on Schedule
"A" to this By-law shall be used in accordance
with the "R7" zoning provisions, excepting
however that:
(i)
semi-detached dwelling units may be
permitted in accordance with the
"R6" zoning provisions, excepting
however that:
1.
the "minimum lot area"
shall be 350 square metres
(3,770 square feet) per
unit;
2.
the "minimum lot frontage"
shall be 8 metres (26
feet) per interior unit
and 11 metres (36 feet)
per corner unit;
3.
the "minimum side yard"
shall be 2 metres (6.5
feet); however, where a
semi-detached dwelling
unit has been divided to
provide individual
ownership to each dwelling
unit, the common side
yard between attached
units shall be reduced to
o metres (0 feet);
4.
the "minimum exterior side
yard .. shall be 5 metres
(16.4 feet); and,
.
5.
the "minimum ground floor
area" shall be 84 square
metres (900 square feet)
per unit.
(ii) townhouse dwelling units may be
permitted in accordance with the
"R7" zoning provisions, excepting
however that:
1.
the "minimum lot area"
shall be 204 square metres
(2,195 square feet) per
unit;
2.
the "minimum lot frontage
shall be 6 metres (19.6
feet) per interior unit
and 11.7 metres (38 feet)
per corner unit;
3.
the "minimum side yard"
shall be 3 metres (9.8
feet); however, where a
townhouse dwelling unit
has been divided to
provide individual
ownership to each dwelling
unit, the common side yard
shall be reduced to 0
metres (0 feet);
.
4.
the "minimum exterior side
yard" shall be 5.7 metres
(18.7 feet);
5.
the "minimum ground floor
area" shall be 84 square
metres (900 square feet)
per unit; and,
6.
the "maximum lot coverage"
shall be 41.2%.
(iii)
existing apartment buildings shall
be permitted in accordance with "R7"
zoning provisions, excepting however
that:
1.
the "minimum lot area"
shall be 183.9 square
metres (1979 square feet)
per unit;
2.
the "minimum lot frontage"
shall be 31 metres (101
feet) ;
3.
the "minimum side yard"
shall be reduced to 2.27
metres (7.4 feet); and,
4.
the "minimum rear yard"
shall be 9.23 metres
(30.28 feet);
.
2. Schedule "A" to By-law No. 84-3, as amended, is hereby
further amended by changing thereon from "R7" to "R7-
l"the zoning designation of those e lands described as
Lots 1 and 2, Registered plan 123, in the Village of
Tiverton, which is outlined in the heaviest black broken
line of the attached Schedule "A"
3. This By-Law takes effect from the date of passage by
Council and comes into force and effect pursuant to the
provisions of the Planning Act, 1990.
