BEING A BY -LAW TO AMEND ZONING BY -LAW NO. 2003 -25,
BEING THE COMPREHENSIVE ZONING BY -LAW FOR THE
MUNICIPALITY OF KINCARDINE

North Part of Lots 1 and 2, Concession 8, geographic Township of Kincardine,
Municipality of Kincardine
• WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the
Councils of Municipalities to enact and amend zoning by -laws which comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has
enacted By -law 2003 -25, a zoning by -law enacted under Section 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
desires to amend By -law 2003 -25;
NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine
ENACTS as follows:
1. Schedule 'A' to By -law No. 2003 -25 as amended, is hereby further amended by
changing thereon from 'ACI', 'Al' and `EP' to 'ACI-q', `A1 -gd -H' and `EP' the
zoning designation on those lands described as North Part of Lots 1 and 2,
Concession 8, geographic Township of Kincardine, Municipality of Kincardine, as
outlined on the attached Schedule 'A'.
III 2 . By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for
the Municipality of Kincardine, is hereby further amended by adding the following
paragraph to subsection 9.5 thereof:
9.5.184 Notwithstanding their 'Al' zoning designation, those lands delineated
as `A1 -gd' on Schedule `A' to this By -law may be used for `Agricultural'
purposes in compliance with the 'Al' zone provisions contained in this
By -law, excepting however, that:
i) No residential buildings or structures shall be permitted.
ii) Prior to removal of the `H- Holding' provision, site alteration and
development shall be prohibited. Council may consider removal
of the 'H — Holding' provision in accordance with the Planning
Act, R.S.O. 1990, once it is satisfied that an archaeological
assessment has been provided by a qualified individual and that
the Ministry of Culture, Tourism and Sport has accepted, and
registered the assessment, if required.

• 3. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for
the Municipality of Kincardine, is hereby further amended by deleting section
27.4.16 in its entirety, and adding the following paragraph to subsection 27.4
thereof:
27.4.16 Notwithstanding their `ACI' zoning designation, those lands delineated
as `ACI -q' on Schedule `A' to this By -law may be used for `Agricultural
Commercial Industrial' purposes in compliance with the `ACI' zone
provisions contained in this By -law, excepting however, that:
(i) A contractor's yard and woodworking shop are also permitted
non - residential uses;
(ii) An accessory office to the permitted Agricultural Commercial
Industrial uses shall be permitted;
(iii) A Singe Detached Dwelling existing at the date of passing of
this By -law is also a residential permitted use.
4. This By -law takes effect from the date of passage by Council and comes into
• force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990.
5. This By -law may be cited as the "Amendment to Comprehensive Zoning By -law
2003 -25, (North Part of Lots 1 and 2, Concession 8, geographic Township of
Kincardine, Municipality of Kincardine), By -law ".

READ a THIRD TIME and FINALLY PASSED this 11th day of March, 2015.
