BEING A BY -LAW TO REMOVE CERTAIN LANDS
FROM PART LOT CONTROL
WHEREAS Subsection 50(7) of the Planning Act, R.S.O 1990 permits Councils of local
municipalities to exempt lands, within a plan of subdivision, from the requirements of
Subsection 50(5) of said Act;
• AND WHEREAS the owner of Part of Lot 144 and Lots 145, 146 and 147, Plan 3M -98
(being Parts 1 to 8, Reference Plan 3R -9671, Municipality of Kincardine (geographic
Town of Kincardine) County of Bruce, has made application to the Municipality of
Kincardine to remove part lot control from those lands;
NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine
ENACTS as follows:
1. That Subsection 50(5) of the Planning Act shall not apply to those parts of the plan
of subdivision described as follows:
i) Part of Lot 144 and Lots 145, 146 and Lot 147, Plan 3M -98 (being Parts 1 to 8,
Reference Plan 3R- 9671); in particular, the following parcels:
a. Part Lot 146 and Lot 147, Registered Plan 3M -98, being Part 1 and 2,
Registered Plan 3R -9671,
b. Part Lot 145 and Part Lot 146, Registered Plan 3M -98, being Parts 3 and 4,
Registered Plan 3R -9671, Together with an easement or easements over Part
of Lots 144 and Lot 145, being Parts 6 and 8, Registered Plan 3R -9671
• c. Part Lot 144 and Part Lot 145, Registered Plan 3M -98, being Parts 5,6,7 and
8, Registered Plan 3R -9671; Subject to an easement or easements over Part
of Lots 144 and Lot 145, being Parts 6, and 8, Registered Plan 3R -9671.
2. This By -Law shall come into force and effect upon approval by the County of Bruce.
3. Upon approval of the By -law by the County of Bruce, the Clerk of the Municipality
of Kincardine is hereby instructed and authorized to register this By -law in the Land
Registry Office for Bruce County.
4. This By -law shall expire within three (3) years from the date of passage of the By-
law.
5. This By -law may be cited as the "Part Lot Control Exemption for Part of Lot 144
and Lots 145, 146 and 147, Plan 3M -98 (being Parts 1 to 8, Reference Plan 3R-
9671 By -law ".
