HomeMy WebLinkAboutTIV 95 014 acquisition of land CORPORATION OF THE VILLAGE OF TIVERTON BY-LAW NUMBER 1995-14 BEING a by-law to authorize and confirm the acquisition of land and the establishment of same as a public highway on Registered Plans 830 and M-44, in the Village of Tiverton, County of Bruce. . WHEREAS pursuant to the Municipal Act, R.S.O. 1990, CM. 45, Section 191(1) the council of every corporation may pass by- laws for acquiring any land required for the purpose of the corporation. AND WHEREAS pursuant to the said Municipal Act, Section 297(1)(a) the council of every municipality may pass by-laws for establishing and laying out highways. AND WHEREAS pursuant to the said Municipal Act, Section 286, lands shown as highways on a registered plan of subdivision are not public highways until assumed by a municipality. AND WHEREAS Plans 830 and M-44 are both registered plans within the Village of Tiverton, County of Bruce. AND WHEREAS it is desirous and necessary to confirm the status of the public highways created by these plans. NOW THEREFORE be it enacted and it is enacted by the council of the Village of Tiverton as follows: PLAN 830 1. That the streets known as Maple Street, Princess Street, Mill Street are registered plan 830, in the Village of Tiverton, County of Bruce are hereby assumed as public highways under the control and jurisdiction of the Village of Tiverton. . 2. That the acquisition of the one foot reserves shown as Blocks E and F on Registered Plan 830, in the Village of Tiverton, County of Bruce are hereby assumed as public highways under the control and jurisdiction of the Village of Tiverton. PLAN M-44 3. That the street on Plan M-44 namely Princess Street, e, . .' - , ~ - I _ 1--::' 1 page 2, By-Law 1995-14 Manse street and Maple street are hereby assumed as public highways under the control and jurisdiction of the Village of Tiverton. 4. That the acquisition of Block B, Plan M-44 by the Village of Tiverton is confirmed and said Block B is under the control and jurisdiction of the Village of Tiverton. 5. That this by-law shall come into force upon its final passage by the council of the Village of Tiverton and shall be effective upon its registration at the Land Registry Office for the County of Bruce.
