Part of Lot 30, Concession 4, geographic Township of Bruce, Municipality of Kincardine WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the • Councils of Municipalities to enact and amend zoning by -laws which comply with an approved official plan; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine has enacted By -law 2003 -25, a zoning by -law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine desires to amend By -law 2003 -25; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By -law No. 2003 -25 as amended, is hereby further amended by changing thereon from 'Al' to `ACI -t' the zoning designation on a portion of those lands described as Part of Lot 30, Concession 4, geographic Township of Bruce, Municipality of Kincardine, as outlined on the attached Schedule 'A'. 2. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for III the Municipality of Kincardine, is hereby further amended by adding the following paragraph to subsection 9.5 thereof: 9.5.183 Notwithstanding their 'Al' zoning designation, those lands delineated as `A1 -gc' on Schedule `A' to this By -law may be used for `Agricultural Commercial Industrial' purposes in compliance with the 'Al' zone provisions contained in this By -law, excepting however, that: (i) The minimum farm lot area shall be 37.5 hectares. 3. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for the Municipality of Kincardine, is hereby further amended by deleting section 27.4.19 in its entirety, and adding the following paragraph to subsection 27.4 thereof: 27.4.19 Notwithstanding their `ACI' zoning designation, those lands delineated as `ACI -t' on Schedule `A' to this By -law may be used for `Agricultural Commercial Industrial' purposes in compliance with the `ACI' zone • provisions contained in this By -law, excepting however, that: (i) A facility for the growing of fruits, vegetables, herb plants, and the production of medical marijuana are permitted; Page 2 Amendment to Comprehensive Zoning By -law 2003 -25, (Part of Lot 30, Concession 4, geographic Township of Bruce, Municipality of Kincardine), By -law By -law No. 2015 - 008 • (ii) Processing and sales of medical marijuana, including but not limited to storing, drying, processing, analyzing, selling, shipping and destroying of medical marijuana or its by- products are permitted, in accordance with the Controlled Drugs and Substances Act, S.0 1996 and the Marijuana for Medical Purposes Regulations, SOR/2013 -119, as amended from time to time; (iii) An accessory office to a permitted `Agricultural Commercial Industrial' use on the property is also permitted. 4. This By -law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 5. This By -law may be cited as the "Amendment to Comprehensive Zoning By -law 2003 -25, (Part of Lot 30, Concession 4, geographic Township of Bruce, Municipality of Kincardine), By -law ".
