No. 2014 -148
BEING A BY -LAW TO REMOVE CERTAIN LANDS
FROM PART LOT CONTROL
WHEREAS Subsection 50(7) of the Planning Act, R.S.O 1990 permits Councils of local
municipalities to exempt lands, within a plan of subdivision, from the requirements of
Subsection 50(5) of said Act;
• AND WHEREAS the owner of Part of Lot 140 and Lots 141 to 143 and Part of Lot 144,
Plan 3M -98 (being Parts 1 to 12, Reference Plan 3R -9634, Municipality of Kincardine
(geographic Town of Kincardine) County of Bruce, has made application to the
Municipality of Kincardine to remove part lot control from those lands;
NOW THEREFORE the Council of the Municipality of Kincardine ENACTS as follows:
1. That Subsection 50(5) of the Planning Act shall not apply to those parts of the plan
of subdivision described as follows:
i) Part of Lot 140 and Lots 141 to 143 and Part of Lot 144, Plan 3M -98 (being
Parts 1 to 12), Reference Plan 3R -9634; in particular, the following parcels:
a. Part of Lots 140 and 141, Registered Plan 3M -98, being Parts 1 and 2,
Registered Plan 3R -9634;
b. Part of Lots 141 and 142, Registered Plan 3M -98, being Parts 3 and 4,
Registered Plan 3R -9634, Together with an easement or easements over Part
of Lot 142, Lot 143 and Part of Lot 144, being Parts 9, 10, 11 and 12,
Registered Plan 3R -9634;
e c. Part of Lot 142 and 143, Registered Plan 3M -98, being Parts 5, 6, 11 and 12,
Registered Plan 3R -9634, Together with an easement or easements over Part
of Lots 143 and 144, being Parts 9 and 10, Registered Plan 3R -9634; and
Subject to an easement or easements over Part of Lots 142 and 143, being
Part 11 and 12, Registered Plan 3R -9634;
d. Part of Lots 143 and 144, Registered Plan 3M -98, being Parts 7, 8, 9 and 10,
Registered Plan 3R -9634; Subject to an easement or easements over Part of
Lots 143 and 144, being Parts 9 and 10, Registered Plan 3R -9634.
2. This By -Law shall come into force and effect upon approval by the County of Bruce.
3. Upon approval of the By -law by the County of Bruce, the Clerk of the Municipality
of Kincardine is hereby instructed and authorized to register this By -law in the Land
Registry Office for Bruce County.
4. This By -law shall expire within three (3) years from the date of passage of the By-
law.

5. This By -Iaw may be cited as the "Part Lot Control Exemption for Part of Lot 140
and Lots 141 to 143 and Part of Lot 144, Plan 3M -98 (being Parts 1 to 12,
Reference Plan 3R -9634) By-law".
