THE CORPORATION OF THE VILLAGE OF TIVERTON
BY-LAW NO. 1997-13
BEING A BY-LAW TO PROVIDE FOR THE REGULATION, CONTROL AND
KEEPING OF CATS WITHIN THE MUNICIPALITY

WHEREAS paragraph 1 and 4 of Section 210 of the Municipal
Act, R.S.O. 1990 c.M.45 provides that Council may pass by-
laws for prohibiting or regulating the keeping of animals and
for restricting the number of animals that may be kept;
AND WHEREAS Section 20 of the Animals for Research Act
R.S.O. c.A.22 provides for the impounding and sale and
destruction of any cat pursuant to the provisions thereof;
AND WHEREAS it is deemed desirable to control cats in the
Village of Tiverton which disturb the Village residents.
NOW THEREFORE the Council of the Village of Tiverton enacts
as follows:
SECTION I - GENERAL
1.1 The provisions of this By-law shall apply to all lands
within the boundaries of the Village of Tiverton.
1.2 This By-law shall take effect from the date of passage
by Council.
SECTION II - ADMINISTRATION AND ENFORCEMENT
2.1 The provisions of this By-law shall be administered by
the Animal control Officer or By-law Enforcement Officer
or any employee of the municipality acting under their
direction.
2.2 The Animal Control Officer. By-law Enforcement Officer
or any employee acting under their direction may enter
upon lands. premises and buildings for the purpose of
determining or effecting compliance with any provision
of this By-law.
2.3 In this By-law where any person is required to pay any
fee or charges and defaults in such payment, the
Municipality shall be entitled to collect the
outstanding fee or charge in like manner and with the
same priority as Municipal taxes.
2.4 Any person who violates any provision of the By-law or
causes or permits such violation is guilty of an offence
and upon conviction thereof, shall forfeit and pay a
fine not to exceed the maximum permitted under the
provincial Offences Act.
~ SECTION III - DEFINITIONS
3.1 In this By-law;
(a) "ANIMAL CONTROL OFFICER" means a person appointed
or employed by the Council of the Village of
Tiverton for the purpose of enforcing the provisions
of this By-law.
(b) "BY-LAW ENFORCEMENT OFFICER" means a person
appointed or employed by the Council of the Village
for the purpose of enforcing Municipal By-laws.

(c) "CAT" means any cat, male or female, over the age
of nine weeks.
(d) "CLERK" means, the Clerk of the Village of Tiverton.
(e) "COUNCIL" means the Council of the Corporation of
the Village of Tiverton.
(f) "MUNICIPALITY" means the municipality of the
Village of Tiverton.

(g) "OWNER" means that person who possesses or harbours
a cat or other animal and where the owner is a
minor, the person responsible for the custody of
the minor.
SECTION IV - KEEPING OF ANIMALS
4.1 Every person who owns an animal in the Municipality
shall provide such animal or cause it to be provided
with such food, shelter, potable water, exercise and
attention as may be required from time to time to keep
it in good health.
4.2 Every person who owns an un spayed female cat shall,
during each period the cat is in heat, keep it confined
so that it will not attract other cats.
4.3 No person shall harbour more than three cats in any
dwelling unit as defined in the Municipal Zoning By-law
within the Municipality.
4.4 A person who owns a cat shall not allow such cat to
interfere with the property rights of others or
trespass on private or public property.
4.5 Every person who is the owner of a cat at a time when
the cat fouls property other than that of the owner,
shall forthwith remove or cause the removal of the
excrement from such property.
