HomeMy WebLinkAbout14 132 Part Lot Control Exemption for Part of Lot 18, Concession 'A' (being parts 1 to 14, reference plan 3R-9624) By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE • 1W* �� ►% BY -LAW No. 2014 -132 BEING A BY -LAW TO REMOVE CERTAIN LANDS FROM PART LOT CONTROL WHEREAS Subsection 50(7) of the Planning Act, R.S.O 1990 permits Councils of local municipalities to exempt lands, within a plan of subdivision, from the requirements of Subsection 50(5) of said Act; • AND WHEREAS the owner of Part of Lot 18, Concession 'A', (being Part 1 of 3R- 9548), Municipality of Kincardine (geographic Township of Kincardine) County of Bruce, has made application to the Municipality of Kincardine to remove part lot control from those lands; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That Subsection 50(5) of the Planning Act shall not apply to those parts of the registered plan described as follows: i) Part of Lot 18, Concession `A', (being Part 1 of 3R -9548) (also being Parts 1 to 14 of 3R- 9624); in particular, the following parcels: a. Part of Lot 18, Concession `A', being Parts 1 and 9, Registered Plan 3R- 9624; Subject to an easement or easements over Part 9, Registered Plan 3R -9624; b. Part of Lot 18, Concession 'A', being Parts 2 and 10, Registered Plan • 3R -9624, Together with an easement or easements over Part 9, Registered Plan 3R -9624; Subject to an easement or easements over Part 10, Registered Plan 3R -9624; c. Part of Lot 18, Concession 'A', being Parts 3 and 11, Registered Plan 3R -9624, Together with an easement or easements over Parts 9 and 10, Registered Plan 3R -9624; and Subject to an easement or easements over Part 11, Registered Plan 3R -9624; d. Part of Lot 18, Concession `A', being Part 4, Registered Plan 3R -9624; Together with an easement or easements over Parts 9, 10 and 11, Registered Plan 3R -9624; e. Part of Lot 18, Concession 'A', being Part 5, Registered Plan 3R -9624; Together with an easement or easements over Parts 12, 13 and 14, Registered Plan 3R -9624; f. Part of Lot 18, Concession 'A', being Part 6 and 12, Registered Plan 3R- 9624; Together with an easement or easements over Parts 13 and 14, Registered Plan 3R -9624; and Subject to an easement or easements over Part 12, Registered Plan 3R -9624; • g. Part of Lot 18, Concession `A', being Part 7 and 13, Registered Plan 3R -9624; Together with an easement or easements over Part 14, Registered Plan 3R -9624; and Subject to an easement or easements over Part 13, Registered Plan 3R -9624; h. Part of Lot 18, Concession `A', being Part 8 and 14, Registered Plan 3R -9624; Subject to an easement or easements over Part 14, • Registered Plan 3R -9624; 2 . This By -Law shall come into force and effect upon approval by the County of Bruce. 3. Upon approval of the By -law by the County of Bruce, the Clerk of the Municipality of Kincardine is hereby instructed and authorized to register this By -law in the Land Registry Office for Bruce County. 4. This By -law shall expire within three (3) years from the date of passage of the By -law. 5. This by -law may be cited as the "Part Lot Control Exemption for Part of Lot 18, Concession `A', (being Parts 1 to 14, Reference Plan 3R -9624) By -law ".
