HomeMy WebLinkAboutTIV 85 010 Traffic regulations . . \ THE CORPORATION OF THE VILLAGE OF TIVERTON BY-LAW NUMBER 1985-/ð FOR THE REGULATION OF TRAFFIC The Council of the Corporation of the Municipality of Tiverton enacts as follows: PART 1 DEFINITIONS For the purpose of this by-law: (a) Commercial Motor Vehicles - means any motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, casket wagon, fire apparatus, police patrols, motor buses and tractors used for hauling purposes on the highways. (b) Corner -means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic. (c) Highway - includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles. (d) Intersection - means the area embraced within the prolongation or connection of the lateral curb lines, or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other. (e) i I j ] latera~ of ~ . :¡ ;¡ I (f) Parking or Park - when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. Sidewalk- means that portion of a highway between the curb lines, or the lines of a roadway and the adjacent property lines, intended for the use pedestrians. Stop- when required, means a complete cessation of movement. (g) (h) Stop or Stopping - when prohibited, means the halting of a vehicle, even momentarily, whether occulpied or not, except when necessary to avoid conflict with other traffic or in compliance with the direction of a constable or other police officer or at a traffic control sign or signal. (i) Street - see Highway. (j) Traffic - includes pedestrians, ridden or herded animals, vehicles, street cars and other:conveyances either singly or together while using any street for the purpose of travel. (k) Traffic Control Devices - means any sign, or roadway, curb or sidewalk marking or other device erected or placed under the authority of the Municipal Council for the purpose of guiding or directing traffic. (1) Vehicle - includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power including muscular power, but does not include a motorized snow vehicle, the cars of electric or steam railways running only upon rails. (m) Motor Vehicle - includes an authomobile, motorcycle, and any other vehicle propelled or driven othe~wise than by muscular power: but does not include the cars of electric or steam railways, or other motor vehicles running only upon rails, or a motorized snow vehicle traction engine, farm tractor, self- propelled implement of husbandry or road-building machine within the meaning of this Act. PART 11 OBEDIENCE TO TRAFFIC REGULATION 1. Police to enforce by law. The Police Department shall enforce· the provisions of this by-law. 2. Obedience to traffic signs and signals Every person shall promptly obey all signals given either by a police office or by a traffic control device. ',-. . PART VI SNOW REMOVAL 1. No person shall place snow or ice on any village highway in such a manner so as to obstruct or encumber the use of the said highway (RSO 1980 Chapter 302, Section 315 Paragraph 1). PART VII PENALTIES 1. Any person violating any of the provisions of this by-law shall be subject to a penalty of not more than $25.00 (twenty-five) dollars for the first offence and not more than fifty dollars (50.00) for every subsequent offence exclusive of costs and all such penalties shall be recoverable under the Provincial Offences Act. Ontario Highway Traffic Act to Govern. The provisions of this by-law shall be subject to the provisions of the Highway Traffic Act (R.S.O. 1980 Chapter 198) amd ammendments thereto. PART 111 PARKING ~ 1. Method of Parking Parallel No person shall park a vehicle on any street other than a one-way street unless on the right hand side of the street, having regard for the direction in which the vehicle had been proceeding and unless the right front and right rear wheels or runners are parallel to and distant respectively not more than six inches from the edge of the roadway. 2. Parking Prohibited. (1) In specified places. No person shall park a vehicle in any of the following places: On a sidewalk. In front of a public or private driveway. In front of or within 4 feet of the entrance to a public lane or private driveway, or so as to prevent ingress to or from such lane or driveway. Within ten feet of a point on the curb or edge of the roadway opposite any fire hydrant. On any street in such a manner as to obstruct traffic. On any street for a long period than 36 hours at anyone time. Within thirty (30) feet of an intersection. (2) In Specified places where signs are on display. When properly worded signs have been erected and are on display no person shall park a vehicle. PART IV OPERATION OF VEHICLES I. Turns Every person in charge of a vehicle before starting, stopping, turning or changing its course shall take the necessary precautions to make such movement in safety and without interfering with other traffic. 2. Entering Highway. The Driver of a vehicle emerging from a driveway, lane lot or building shall stop the vehicle immediately prior to driving onto the sidewalk and shall not enter the roadway until he can do so in safety. PART V EMERGENCY PARKING PROHIBITIONS . I. Not withstanding anything to the contrary contained herein, the Chief Constable, during any _emergency or special circumstances deemed sufficient therefore may by the use ò~ ~ppropriate signs or signals suspend the movement of any or all parking'regulations and parking thereon and the Chief Confitable during such emergency may declare that any vehicle already parked, is being parked illegally regardless of the time permitted for parking such vehicle under the provisions of this by-law and not withstanding that the period allowed to the owner or driver under this by-law has not expired: provided however, that in this event the owner or driver of such vehicle is personally notified by a police officer that parking at such place has been suspended and further that the owner or driver of such vehicle is allowed reasonable period of time to remove said vehicle.
