''::1 I ,I II I I I THE CORPORATION OF THE VILLAGE OF TIVERTON BY-LAW NUMBER 1987 - 7 Being a by-law to authorize the acquisition of land as a site for the Tiverton and District Arena. WHEREAS section 2 of the Community Recreation Centres Act R.S.O. 1980, c 80 as amended, provides that the Council of a municipality may by by-law acquire real property for the purpose of establishing a community recreation centre: AND WHEREAS the Corporation of the Village of Tiverton by by-law number 1986-7 executed an agreement with the Corporation of the Township of Bruce and the Corporation of the Township of Kincardine to jointly own, construct, operate and maintain a community recreation centre know as the Tiverton and District Arena on lands situated within the Village of Tiverton; AND WHEREAS it is deemed necessary, desirable and in the acquire jointly with the Corporation of the Township and the Corporation of the Township of Kincardine situated within the Village of Tiverton for the purpose of Tiverton and District Arena; public interest to of Bruce certain lands establishing the NOW THEREFORE THE CORPORATION OF THE VILLAGE ENACTS AS FOLLOWS: OF TIVERTON 1. That the Head of Council and the Clerk of the Corporation be and are hereby authorized to execute jointly with the Corporation of the Township of Bruce and the Corporation of the Township of Kincardine the offer of purchase and sale attached hereto as Schedule "A" and forming part of this by-law. 2. That the Head of Council and the Treasurer of the Corporation be and are hereby authorized to pay the Corporation's share of the cost of the property to be acquired pursuant to Schedule "A" attached hereto and any incidental costs related thereto. 3. ' i~ .. . ~-'>-~ ...,. , . . . .~ V:.d¡1 ¡fI~ "'·'1' AGREEMEtll' MAlE THIS IoU DAY OF 3?~ BET WEE N: , 1987 THE MUNICIPAL CORPORATION OF TIlE COUNTY OF BRUCE (Hereinafter called "the Co un ty") - and - WE MUNICIPAL CORPORATIONS OF The Village of Mildmay The Village of Teeswater The Village of Paisley The Village of Ripley The Village of Tiverton The Village of Tara The Village of Lucknow The Township of Arran The Township of Culross The Township of Saugeen (Hereinafter called "the Municipalities") WHEREAS by By-Law 2767, the County has appointed a By-Law Enforcement Officer at a remuneration fixed by Bruce County Counc il . AND WHEREAS the Municipalities have expressed a desire to use the County By-Law Enforcement Officer for the purpose of enforcing their own By-Laws; AND WHEREAS the County has agreed to allow the Municipalities to use its By-Law Enforcement Officer on a cost-shar ing basis; NOW THEREFORE, in consideration of the sum of ONE OOLLAR ($1.00) paid by the Municipalities to the County (the receipt of which is hereby acknowledged) and the mutual covenants con tained here in, the Parties here to agree as follows: 1. The County agrees to employ a By-Law Enforcement Officer who holds office during the pleasure of Council. 2. The County agrees to allow the Municipalities the right to use the County By-Law Enforcement Officer for the purpose of enforcing their own By-Laws. 3. The County and the Municipalities agree to share the cost of said By-Law Enforcement Officer as follows: (a) It is agreed that the cost being shared is the total cost of employing the By-Law Enforcement Officer, including 'salary, mileage and fringe benefits; . (b) The County of Bruce agrees to pay 50 percent of the cost of the program; (c) The remaining 50 percent of the costs of the program shall be borne equally by all participating municipalities. Invoices shall be submitted by the County on a quarterly basis in March, June, September and December; (d) The participating municipalities also agreed to pay to the County, in addition to the cost of employing the By-Law Enforcement Officer, 10 percent of the amount invoiced to each participant in accordance with paragraph 3(c) which shall be compensation to the County for administering the program and employing the personnel. ~ .J ~....'It -2- 4. It is agreed tha t all charges and fees as outl ined in Paragraph 3 of this agreement will be invoiced by the County to the Municipalities at the end of every three month period during the currency of this agreement and each participating Municipality shall be responsible to pay its share to the County within 30 days of receipt of the invo ice. 5. Each participating Municipality shall have the right to inspect all books and records maintained by the County with respect to the financial employment of the By-Law Enforcement Officer. . 6. Thi s Ag reemeri t shall be in force and shall bind all parties hereto from January 1, 1985. Each participating Municipality shall have the right to terminate their portion of this agreement at the end of the calendar year, in which notice is given, by noti fying the Co un ty in writing within sixty (60) days prior to the proposed termination date. 7. Each participating Municipality further agrees to pass a valid By-Law pursuant to Section 70 of The R>lice Act, R. S. O. 1980, C.38l, appointing the County By-Law Enforcement Officer for the specific Municipality involved, and designating the local By-Laws he will be obligated to enforce. (a) Each participating Municipality shall file a certified copy of this Appointment By-Law with the Clerk of the County within sixty (60) days after the passing of said By-Law. (b) Each participating Municipality shall file a completed copy of this ìlgreement, properly signed and sealed by the Municipality, with the Clerk of the County of Bruce within sixty (60) days of the date of this Agreement or the admission of the Municipality to the By-Law Enforcement Program. (c) Failure to file the required By-Law and Agreement forms shall entitle the County to terminate the Municipality from the program without further notice. 8. It is agreed by all parties to this Agreement that the County shall not be responsible for any damages which may result from the enforcement of any By-Laws for any of the participating Municipalities and the participating Municipalities agree to indemnify the County if the County is called on to pay any such damages. -. 9. It is agreed that any other Municipality within the County of Bruce shall be able to apply for inclusion in this Agreement and acceptance shall be at the option of the County, with cost-shar ing to be adj usted proportionately. 10. Notwi thstand ing any other financ ial agreements hereinbefore mentioned, each Party to this Agreement shall be responsible for 'the direct expenses incurred in enforc ing the ir own By-Laws. Without 1 imiting the generality of the foregoing statement, such expenses shall be the cost of purchasing tickets and other forms necessary to commence the j ud ic ial process, all costs of prosecuting By-Laws in Court, including necessary legal advice and the fees of the Justice of the Peace who swears the information. .. It is agreed that any fine's imposed for the breach of a By-Law shall be the property of the Municipality prosecuting the offence, and it shall be responsible for the necessary action and costs to collect such fines. 12. Notwithstanding anything else hereinbefore mentioned in this agreement, the County shall not be responsible to etlploy a By-Law Enforcement Officer for the term of this agreement if the existing person in this position resigns or is dismissed by the County before the termination of this agreement. . 13. Each participating Municipality agrees to pass a By-Law authorizing the signing of this agreement and a certified copy of such By-Law shall be filed with the Clerk of the County forthwith.
