THE CORPORA'.t'ION OF THE VILLAGE OF TIVERTON
BY-LAW NO. 1990-4
SEWER CONSTRUCTION AND DEBENTURE BY-LAW
BEING A BY-LAW TO AUTHORIZE THE CONSTRUCTION OF A
SEWAGE WORKS IN THE VILLAGE OF TIVERTON PURSUANT
TO PARAGRAPHS 208 (13) AND 210 (78) OF THE
MUNICIPAL ACT, CHAPTER 302, R.S.O. 1980 AS AMENDED¡
AND TO AUTHORIZE THE ISSUANCE OF DEBENTURES BY THE
MUNICIPALITY FOR THE UNFINANéÈD PORTION OF THE
SEWAGE WORKS PURSUANT TO SECTIONS 143 and 185 AND
PARAGRAPH 210 (51) OF THE MUNICIPAL ACT, CHAPTER
302, R.S.O. 1980 AS AMENDED

WHEREAS it is deemed necessary~ desirable, expedient and
in the public interest by the Council of the Village of Tiverton
{the "Municipality") to commence construction of sewage works (the
·works") to provide sewage service to the Municipality.
AND WHEREAS an engineering study and professional opinion
have been received with respect to the necessity, existing and
proposed utilization, design criteria, and related matters
regarding the Works and the said study has been reviewed and
adopted by the Council of the Municipality.
AND WHEREAS approval has been received from the Ministry
of the Environment that the Works are eligible to receive
provincial grant funds available for the construction of the Works
AND WHEREAS the Municipality intends to issue debentures
in connection with the financing of the net capital cost of the
Works¡
AND WHEREAS Section 64 of the Ontario Municipal Board
Act, C. 347 R.S.O., 1980 as amended, provides that a municipality
shall not authorize any undertaking, the cost or" any portion of the
cost of which will not be payable within the term for which the
Council was elected, or is to be provided for by the issuance of
long term debt, until the approval of the Ontario Municipal Board
has first been obtained.

NOW THEREFORE, THE COUNCIL OF THE MUNICIPALITY ENACTS AS
FOLLOWS I
1.
That the construction of the Works which are more
particularly described in Schedule "A" attached hereto is hereby
authorized.
2.
That application be made to the Ontario Municipal Board
. by the Clerk on behalf of the Municipality fQr approval of the
construction of the Works at an e$timated cost of $4, l75, 500.00 and
for approval to finance the Municipality's portion of the capital
cost by the issuance of debentures on a fix~~"jterm capital loan for

a total amount not exceeding Sfifi1r-l~.98 to be amortized over a
term not exceeding 10 years and to bear interest at such rate a$
Council may determine.
3.
That the firm of B. M. Ross and Associates Limited, on
behalf of the Municipality, prepare plans, profiles, $pecifications
and such other information as may be necessary for inviting tenders
to carry out the construction of the Works.
4.
That the Ministry of the Environment, on behalf of the
Municipality, is hereby authorized to invite tenders for carrying
out the construction of the Works in accordance with the plans,
profiles, specifications and other information prepared under
clause 3 of this by-law.
5.
That the Works shall be carried out under the supervision

of the Ministry of Environment as agent for the Municipality in
accordance with an agreement executed with the Ministry of
Environment.
6.
That the Municipality shall by resolution accept the
tender or tenders of a person or persons, firm or firms"
corporation or corporations as may be acceptable to Council and
authorize the Reeve and Clerk to enter into and execute a contract

on behalf of the Municipality before any construction is carried
out, based on and in accordance with the terms and conditions of
the tender or tenders accepted.
7.
That the Reeve and Treasurer are hereby authorized to
secure temporary advances from the Municipality's bank as required
to meet the cost of the Works, pending completion of the project
and the payment of the holdback portion of the subsidy from the
4IÞr Ministry of the Environment.
8.
That special sewer rates shall be established by by-laws
to pay the capital costs incurred by the Municipality for the Works
including all connections thereto on a rateable basis in accordance
with the enactments authorizing same.
9.
That this by-law øhall not come into force and take
effect until the approval of the Ontario Municipal Board has been
obtained.
