HomeMy WebLinkAboutTIV 90 005 sewer rate -,!~ ~ THE CORPORATION OF THE VILLAGE OF TlVERTON BY-LAW NO. 1990-5 FRONTAGE - SEWER RATE BY-LAW BEING A BY-LAW WITH RESPECT TO A SEWER RATE UNDER SECTION 218 OF THE MUNICIPAL ACT, CHAPTER 302, R.S.O. 1980 (FRONTAGE RATE). WHEREAS The Corporation of the Village of Tiverton (the "Municipality") proposes to provide sewage works for the supplying of sewage service to the Municipality; . AND WHEREAS it is deemed desirable by the Municipality to pay for a portion of the capital cost of the sewage works by imposing a metre frontage rate as a sewer rate upon owners or occupants of land who derive or will or may derive a benefit or deferred benefit from the sewage works; NOW THEREFORE, THE COUNCIL OF THE MUNICIPALITY ENACTS AS FOLLOWS: 1. A frontage rate is hereby imposed pursuant to subsection 218 ( 7 ) of the Municipal Act, upon the owners or occupants of land who derive or will or may derive a benefit or a deferred benefit from the sewage works, as a sewer rate to pay for a portion of the capital cost thereof. 2. The lands in respect of which such owners or occupants are deemed to derive benefit from this project are all lands which front or abut on the streets or parts of . streets described in Schedule "A" hereto, or connect to the sewers constructed thereon. 3. The lands in respect of which such owners or occupants are deemed to derive a deferred benefit from this project are all lands which front or abut on the streets or parts of streets described in Schedule "B" hereto. 0. --,.. . 5. . , .~.. (a) In the case of a property which will derive or will be deemed to derive a benefit under paragraph 2, above, the sewer rate shall be an annual charge and shall be imposed for a period of 10 years commencing in the calendar year in which the sewage works are installed and shall be an annual frontage rate of $1.50 per foot ($4.90 per metre) on the lands designated in paragraph 2 hereof, provided that such sewer rate at the opinion of the person liable therefor, may other wise be commuted as a charge of $8.35 per foot ($27.40 per metre) and shall be due and payable in the calendar year in which such sewage works are installed, or, (b) In the case of a property which will derive or will be deemed to derive a deferred benefit under paragraph 3 above, the sewer rate shall be an annual charge and shall be imposed for a period of 10 years commencing in the calendar year in which the sewage works are installed and shall be an annual frontage rate of $1. 62 per foot ($5.31 per metre) on the lands designated in paragraph 3 hereof, provided that such sewer rate at the option of the person liable therefor, may other wise by commuted as a charge of $9.15 per foot ($30.00 per metre) and shall be due and payable in the calendar year in which such sewage works are installed. (a) In the case of corner lots situated at the junction or intersection of streets or highways, 165 feet (50.50 metres) of the flankage is exempt from the frontage rate. (b) Triangular or irregularly shaped lots shall either experience an increase in the metre frontage rate or a decrease in same on a basis that is deemed to be equitable and just. (c) Where a lot is for any reason wholly or in part unfit for '. ',,> building purposes, a reduction may be made in the frontage rate that otherwise would be chargeable thereon, sufficient to adjust its frontage charge as compared with that of lots fit for building purposes on a fair and equitable basis. (d) In the case of lots that because of the nature of the terrain or the elevation of the sewer, do not derive the . same benefit as other lands fronting or abutting on the sewer, a partial exemption from the frontage rate may be made, having regard to the benefit derived as compared with other lots, sufficient to adjust the frontage charge on a fair and equitable basis. (e) Any changes that are required to be made by the application of paragraphs (a) to (d) herein shall be made by deducting from or adding to the total frontage of the lot which is subject to the metre rate so that the whole of the lot is charged on a basis that is equitable and just. 6.
