BY -LAW No. 2014 - 090
BEING A BY -LAW TO CONFIRM THE OWNERSHIP OF THE LANDS KNOWN
AS CONNAUGHT PARK
WHEREAS the lands described in the schedule attached to this by -law are used and
occupied by the Municipality of Kincardine as a public park known as Connaught Park.
AND WHEREAS the lands have been occupied and used as a public park by the
• Municipality of Kincardine in excess of 80 years.
AND WHEREAS it has been determined that there was never any registered title
established for the said lands in favour of the Municipality of Kincardine and the
Municipality of Kincardine is not shown as the registered owner in the Land Titles
Registration System.
AND WHEREAS Connaught Park is an important historical and recreational resource of
the Municipality of Kincardine.
NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine
ENACTS as follows:
1. That a Deed from the Municipality of Kincardine to itself for the lands described in
Schedule "A" attached to this by -law is hereby authorized to be signed and
registered.
2. That the Clerk of the Municipality of Kincardine is authorized to execute on behalf
of the Municipality of Kincardine such declarations as may be prepared by the
11111 municipal solicitor to confirm the use and occupation of the lands as a municipal
park by the Municipality of Kincardine.
3. That the Municipal Solicitor is authorized to apply for the conversion of the said
lands from the Registry Act System to the Land Titles Qualified System showing
the Municipality of Kincardine as the registered owner.
4. This by -law may be cited as the "Connaught Park By -law ".
READ a FIRST and SECOND TIME this 18th day of June, 2014.
READ a THIRD TIME and FINALLY PASSED this 18th day of June, 2014.
