A BY-LAW TO AMEND BY-LAW NO. 82-08, BEING
THE RESTRICTED AREA BY-LAW FOR THE
CORPORATION OF THE TOWNSHIP OF KINCARDINE.
THE COUNCIL of the Corporation of the TOwnship of Kincardine,
pursuant to Section 34 of The Planning Act, 1983, ENACTS as
follows :

Schedule "A", Map 9, to By-Law No. 82-08, being the
Restricted Area By-Law for the Corporation of the TOwnship
of Kincardine, is herby amended by changing thereon from
"EP" to "Al" the Zoning designation of those parts of Lots
68, 69 and 70, Concession 1, N.D.R., and Lots 69 and 70,
Concession 2, N.D.R., in the TOwnship of Kincardine, which
are shown outlined in the heaviest black broken line on the
attached Schedule "A".
Schedule "A", Map 2 to By-Law No. 82-08 is hereby amended
by changing thereon from "PD" to "R3" the zoning
designation of those parts of Lots 50 to 56 inclusive,
Concession "A", in the TOwnship of Kincardine, which are
shown outlined in the heaviest black broken line on the
attached Schedule liB".
Schedule "A", Map 2, to By-Law No. 82-08 is hereby amended
by changing thereon from "EP" to "PD" the zoning
designation of those parts of Lots 50 and 51, Concession
"A", in the TOwnship of Kincardine, which are shown
outlined in the heaviest black broken line on the attached
Schedule "C".
By-Law No. 82-08 is hereby amended by adding the following \
paragraph (a) to Section 28.3 thereof:
(a) Notwithstanding their "I" Zoning designation, the
lands delineated as "I-l" in Schedule "A" to this
By-Law shall only be used for the purposes of a
snowmobile club in compliance with the "I" Zoning
provisions contained in this By-Law.
Schedule II A", Map 9, to By-Law lb. 82-08 is hereby amended
by changing thereon from "Al" to "I-l", the Zoning
designation of part of Lot 53, Concession 2, S.D.R., in
the TOwnship of Kincardine, which is shown outlined in the
heaviest black broken line on the attached Schedule "D".
Schedule "A", Map 3, to By-Law No. 82-08 is hereby amended
by changing thereon from "EP" to "Al", the Zoning
designation of those parts of Lots 35 and 36, Concession
"A", ih the TOwnship of Kincardine, which are shown
outlined in the heaviest black broken line on the attached
Schedule "E".

changing thereon from "081" to "PD", the Zoning designation
of Part of lot 4l, Concession II A" , in the TOwnship of
Kincardine, which is shown outlined in the heaviest black
broken line on the attached Schedule "F".
9. By-Law No. 82-08 is hereby amended by changing the m1nmum
'Non-Farm Residential' lot area and frontage requirements
of Section 9.2 from l800 square metres (20,000 square feet)
and 30 metres (100 feet) to l390 square metres (l5,000
square feet) and 24 metres (80 feet) respectively.

N.O.R., in the TOwnship of Kincardine, which are shown
outlined in the heaviest black broken line on the attached
Schedule "G".
l2. Schedule "A", Map 1 to By-Law No. 82-08 is hereby amended
by changing thereon from "PO" to "Rl" the Zoning
designation of part of Lot 70, Concession "A", in the
TOwnship of Kincardine, which is shown outlined in the
'heaviest b'lack broken line on the attached Schedule "H".
l3. By-Law No. 82-08 is hereby amended by adding the following
paragraph (a) to Section 25.4 thereof:
(a) Notwithstanding their "Ml" Zoning designation, those
lands delineated as "Ml-l" on Schedule "A" to this
By-Law shall only be used for the purposes of a fuel
storage establishment in compliance with the "Ml"
Zoning provisions contained in this By-Law, excepting
however that the minimum lot area requirement shall be
3,500 square metres (37,675 square feet).
l4. Schedule "A", Map 6, to By-Law No. 82-08 is hereby amended
by changing thereon from "C6" to "Ml-l" the Zoning
designation of Part of Lot 1, Concession 4, N.D.R., in the
TOwnship of Kincardine, which is shown outlined in the
heaviest black broken line on the attached Schedule "I".

15. By-Law No. 82-08 is hereby amended by adding the following
paragraph (a) to Section 2l.4 thereof:
(a) Notwithstanding their "C3" Zoning designation, and the
lands delineated as "C3-l" on Schedule "A" to this
By-Law shall only be used for the purposes of a retail
and/or wholesale meat and groceries market, and uses
accessory thereto, in compliance with the "C3" Zoning
provisions contained in this By-Law.
16. Schedule "A" Map 6, to By-Law No. 82-08 is hereby amended
by changing thereon from "C6" and "IU" to "C3-1" the
Zoning designation of that part of Lot l, Concession IV, in
the TOwnship of Kincardine, which is shown outlined in the
heaviest black broken line on the attached Schedule "J".
l7. By-Law No. 82-08 is hereby amended by adding the following
paragraph (b) to Section 21.4 thereof:
(a) Notwithstanding their "C3" Zoning designation, the
lands delineated as "C3-2" on Schedule "A" to this
By-Law shall only be used for the purposes of a
restaurant, drive-in restaurant or take-out
restaurant, and uses accessory thereto, in compliance
with the "C3" Zoning provisions contained in this
By-law.
l8. Schedule "A", Map 6, to By-Law No. 82-08 is hereby amended
by changing thereon from "C6" to "C3-2" the Zoning
designation of that part of Lot l, Concession IV, in the
TOwnship of Kincardine, which is shown outlined in the
heaviest black broken line on the attached Schedule "K".
19. Schedule" A", Map 6, to By-Law No. 82-08 is hereby amended
by changing thereon from "Al" to "Rl" the Zoning
designation of that part of Lot l, Concession IV, in the
TOwnship of Kincardine, which is shown outlined in the
heaviest black broken line on the attached Schedule "L".
20. Schedule "A", Bervie Zoning Map, to By-Law No. 82-08 is
hereby amended:
(a) by renumbering Lots 43 - 49 inclusive, Concession l,
N.D.R., as Lots 44 - 50 inclusive, and
(b) by positioning the north arrow thereon in the opposite
d irec tion .
21. Schedule "A", Map 3, to By-Law No. 82-08 is hereby amended
by changing thereon
(a) from "AP" to "Al" ; and
(b) from "Al" to "AP"
the Zoning designation of those parts of Lots 27, 28 and
29, Concession "A", in the TOwnship of Kincardine, which
are shown outlined in the heaviest black broken line on

ereof and replacing it with the folowing Section 6.3l:

with no municipal water or sewer shall be 4000 square
metres (43,000 square feet) ; and, (ii) the minimum lot
area for lots with either municipal water or sewer shall be
l800 square metres (l9,375 square feet).

26. By-Law No. 82-08 is hereby amended by adding the following
paragraph (c) to Section 32.2 thereof:
(c) Notwithstanding their "PD" Zoning designation, those
lands delineated as "PD-2" on Schedule "A" to this
By-Law may be used in compliance with the "R2" Zone
provisions contained in this By-Law, excepting however
that:
(i) the requirement for frontage on a public street
shall not apply.

3l This By-Law takes effect from the date of passage by
Council and comes into force pursuant to the provisions of
The Planning Act, 1983.
