of Passlng for Zoning By-Law No. 84-39 of the Corporation of
the Township of Kincardine , was given in the
manner and form and to the persons and agencies prescribed by
Regulation 404/83 of The Planning Act, 1983.
I also certify that the 35 day appeal period expired at
the end of the 24t-lt day of ~r , 198d , and to
this date no notice of appeal of the By-Law has been filed with

BY-LAW NO. g-Lj....39
A BY-LAW TO AMEND BY-LAW NO. 82-08, BEING
THE RESTRICTED AREA BY-LAW FOR THE
CORPORATION OF THE TOWNSHIP OF KINCARDINE.
THE COUNCIL of the Corporation of the Tbwnship of Kincardine,
pursuant to Section 34 of The Planning Act, 1983, ENACTS as
follows :
1.
Schedule "A", Map 6, to By-Law lb. 82-08, being the
Restricted Area By-Law for the Corporation of the
Tbwnship of Kincardine, is hereby amended by changing
thereon
( a) from "EP" to "AI" and
(b) from "AI" to "Ep·
the zoning designation of those Parts of IDts 30 - 34
inclusive, Concession 2, N. D. R., in the Tbwnship of
Kincardine, which are shown outlined in the heaviest
black brokEn line on the attached Schedule "A".
2. Schedule "A", Map 1, to By-Law lb. 82-08 is hereby
amended by changing thereon from "PD" to "Rl" the
zoning designation of that part of IDt 70, Concession
"A", in the Tbwnship of Kincardine, which is shown
outlined in the heaviest black broken line on the
attached Schedule "B".
3. Schedule "A", Map 3, to By-Law lb. 82-08 is hereby
amended by chang ing thereon from "PD" to "PD-2" the
zoning designation of that part of IDt 31, Concession
"A" in the Tbwnship of Kincard ine, which is shown
outlined in the heaviest black broken line on the
attached Schedule "C".
4. Schedule "A", Map 1, to By-Law lb. 82-08 is hereby
amended by chang ing thereon from "PD" to "PD-2" the
zoning designation of that part of IDt 57, Concession
n A" in the Tbwnship of Kincard ine, which is shown
outlined in the heaviest black broken line on the
attached Schedule "D".
5. Schedule "A", Map 3, to By-LaW No. 82-08 is herby
amended by chang ing thereon from "PD" to "DP-2· the
zoning designation of that part of IDt 25, Concession
"An in the Township of Kincard ine, which is shown
outlined in the heaviest black broken line on the
attached Schedule "E".

6. By-Law No. 82-08 is hereby amended by deleting Section
6.3l thereof and replacing it with the folowing Section
6. 3l:
6.3l MAXIMUM HEIGHT REGULATIONS
Notwithstanding Section 6.l0 or any other
provisions of this By-Law to the contrary, within
those areas identified on Schedule "E" as Area l,
Area 2 and Area 3, no person shall erect or
construct any building or structure, or any
addi tion to any existing building or structure,
the highest point of which will exceed the
following heights.
(a) In Area 1, as shown on Schedule "E", no
building or structure may be higher than a
height calculated based on the ratio of l: 7
from the side perimeter of the airport
runway strip, or the height restriction of
the zone in which the land lies, whichever
is the lesser. (That is, for every 7 metres
calculated at a right angle to the side
plane of the runway strip, building or
structure height may be increased by 1
metre, until the prescribed maximll1l height
restr iction is reached.)
(b) In Area 2, as shown on Schedule "E", no
building or structure may be higher than a
height calculated based on the ratio of
l:40 from the end of the airport runway
strip, orthe height restriction of the zone
in which the land lies, whichever the the
lesser. (That is, for every 40 metres
calcula ted at aright angle to the end of
the runway strip, building or structure'
height may be increased by 1 metre, until
the prescribed maximum height restriction
is reached.
(c) In Area 3, as shown on Schedule "E", no
building or structure may be higher than a
height calculated based on the ratio of
l: 20 from the end of the airport runway
strip, or the height restriction of the
zone in which the land lies, whichever is
the lesser. (That is, for every 20 metres
calculated at a right angle to the end of
the runway strip, building or structure
height may be increased by 1 metre, until
the prescribed maximum height restriction
is reached.)
7. By-Law No. 82-08 is hereby amended by adding thereto a
Schedule "E" as shown on the attached Schedule "F".
8. By-Law No. 82-08 is hereby amended by adding the
following paragraph (c) to Section 8.3 thereof
(c) Notwithstanding the provisions of paragraph (b) (i)

inclusive, Concession "A" shall be 609 metres
