THE CORPORATION OF THE TOWNSHIP OF KINCARDINE
BY-LAW NO. 85-09

A By-Law to Amend By-Law No. 82-08, being the zoning By-Law for the
Corporation of The Township of Kincardine.
The Council of the Corporstion of the Township of Kincardine, pursusnt to
Section 34 of The Planning Act, 1983, ENACTS as follows:
1. By-Law No. 82-08, being the Zoning By-Law for the Corporation of the
Township of Kincardine, as amended, is hereby further amended by adding
the following sentence to clause (i) of Section 6.1 (a) thereof;
"Notwithstanding the generality of the foregoing, this
approval by the Corporation shall not be required for any
undertaking which has been spproved under the Environmental
Assessment Act."
2. By-Law No. 82-08, as amended, is hereby further amended by deleting
clause (ii) of Section 6.1 (a) thereof and replacing it with the
following clause (ii);
.
(ii) Any electric power facility of Ontario Hydro or any public
utility corporation, and any receiving or'transmitting tower
and facilities of any radio or television! station existing on
the date of passing of this By-Lsw are p~mitted.

3. By-Law No. 82-08, as amended, is hereby further amended by deleting
Section 6.4 thereof and replacing it with the following Section 6.4:
6.4 NON-COMPLYING USES
Lands, buildings or structures which conform to the uses
permitted in the applicable zone, but do not comply with one or
more other provisions of the By-Law may be used Dr strengthened
to a safe condition as provided for in the non-conforming uses
section but where such building or structure is reconstructed
or rebuilt as a result of forces beyond the control of the
owner, then such reconstruction shall comply, as close aa
possible, with all applicable setbacks and yard provisions of
this By-Law provided that such compliance does not have the
effect of reducing the original height, size or volume of the
4IIÞ building or structure.
4. By-Law No. 82-08~as amended, is hereby further amended by adding the
following sentañce to Section 6.1.1 thereof:
"NtÍtwithstanding the generality of the foregoing, this
requirement to conform to all provisions of this By-Lsw shall
not apply to any electric power facility of Ontario Hydro,
where such facility hss been spproved under the Environmental
Assessment Act."
5. By-Law No. 82-08, as smended, is hereby further amended by renumbering
Sections 5.35 and 5.36 as 5.36(a) and 5.36(b), respectively.
6. By-Law No. 82-08, ss amended, is hereby further amended by adding
the following Section 5.35.
5.35
"CONSERVATION AREA" mean a an area of land owned or
leaaed by the Conaervation Authority and used for flood
and erosion control purposesj snd/or, day use
recreational purposes.

7. By-Law No. 82-08, BS amended, is hereby further amended by deleting
Section 5.96 thereof and replacing it with the following Section 5.96:
5.96
"PARK" mesns an ares of land, playground or plsyfield
which msy include thereon one or more field houses,
community centres, swimming pools, wading pools,
greenhouses, skating rinks, tennis or bsdminton courts,
bowling greens, curling rinks, refreshment rooms, Brenss or
similsr uses.
8. This By-Law takes effect from the date of passage by Council snd
comes into force pursuant to the provisions of The Planning Act, 1983.
