NO. 2014 - 028
BEING A BY -LAW TO AMEND BY -LAW NO. 2011-043: BEING A BY -LAW TO
PROVIDE FOR A DRAINAGE WORKS IN THE MUNICIPALITY OF
KINCARDINE IN THE COUNTY OF BRUCE
WHEREAS the Council of The Corporation of the Municipality of Kincardine did
on the 4th day of May 2011 passed By -law No. 2011 - 043 to provide for the
• construction of drainage works known as the MD #13 — Wrightson Branch B -
2011;
AND WHEREAS the said drainage work was estimated to cost the sum of
$57,220.00 and has actually cost the sum of $58,512.00 and it is expedient that
the net cost of the drainage work, neither more or less, be provided for;
AND WHEREAS the amount to be contributed by the Municipality was
$23,290.00 and the actual amount is $22,029.00;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That By -law No. 2011 -043 be so amended that the actual cost of the said
drainage work of $58, 512.00 be provided for.
2. THAT the Schedule of the said By -law, including interest, total special rates
and annual payments be so amended that the amounts to be raised and
levied during the five years in which the debentures have to run shall be for
• the net amount required to discharge the principle and interest for each
annual installment as they become due and payable, the whole to be in
accordance with the Schedule hereto attached and which is to form a part
of this amending By -law.
3. That By -law No. 2011 -043 be amended as follows:
i) Delete section 2.2 and replace with
The Corporation may issue debenture(s) for the amount borrowed
less the total amount of:
(a) grants received under section 85 of the Drainage Act;
(b) monies paid as allowances;
(c) commuted payments made in respect of lands and roads
assessed with the municipality;
(d) money paid under subsection 61 (3) of the Drainage Act
(e) money assessed in and payable by another municipality.
• Such debenture(s) shall be made payable within 5 years from the
date of the debenture(s) an shall bear interest at a rate not higher
than 2% more than the municipal lending rates as posted by
Infrastructure Ontario on the date of sale of such debenture(s).
ii) Replace $23,920.00 from section 4 with $22,029.00.

4. This by -law shall come into full force and effect upon its final passage.
• 5. This by -law may be cited as the "MD #13 — Wrightson Branch B - 2011
Amendment By -law ".
