NO. 2001 - 141
A BY-lAW TO AUTHORIZE THE SIGNING OF A CONTRACT WITH
KEllY JONES FOR THE PROVISION OF SERVICES FOR THE
OPERATION OF THE MUNICIPALITY OF KINCARDINE
VISITOR INFORMATION CENTRE
WHEREAS the Council for The Corporation of the Municipality of Kincardine
deems it advisable to renew the service contract with Kelly Jones for the
operation of the Municipality of Kincardine Visitor Information Centre;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it advisable to amend certain responsibilities, hours and financial
obligations;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the Corporation of the Municipality of Kincardine renew the amended
Service Contract Agreement with Kelly Jones for the operation of the
Municipality of Kincardine Visitor Information Centre until December 31,
200~5
2. That the Mayor and Clerk be authorized to sign, on behalf of The Corporation
of the Municipality of Kincardine, the contract and schedules attached thereto
for the operation of the Municipality of Kincardine Visitors Centre by Kelly
Jones, attached to this by-law and to affix the corporate seal as and when
required.
3. This By-law shall come into full force and effect upon its final passage.
4. This By-law may be cited as the "The Kincardine Visitor Information Centre
Services Contract Agreement 2002, By-law".

KINCARDINE VISITOR NFORMATION CENTRE SERVICE AGREEMENT
This AGREEMENT made this 12th day of December, 2001
BETWEEN:
THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
hereinafter called the "Municipality"
of the First Part,
-and-
KELLY JONES
Hereinafter called" Jones"
Of the Second Part.
WHEREAS the Municipality has contracted the operation of the Kincardine Visitor
Information Centre to Jones;
AND WHEREAS it is expedient that the terms and conditions of this service contract be
specified by Agreement between the two parties;
NOW THEREFORE THIS AGREEMENT WITNESSETH THAT in consideration of the
premises and mutual promises and covenants hereinafter contained, the parties hereby
agree as follows:
I. Jones shall operate the Kincardine Visitor Information Centre on behalf of the
Municipality of Kincardine.
2. The Municipality shall pay to Jones $1,190.00 bi-monthly for the year 2002 and
$1,213.80 for the year 2003. The payment shall start on January 15th, 2002 and
henceforth be paid on the 15th day of each month and on the last day of each
month thereafter, terminating on December 31, 2003. Payment Schedule is
attached as Appendix "A" to this Agreement.
3.
Jones acknowledges that persons working in the Kincardine Tourist Information
Centre shall not be deemed to be a servant, agent or employee of the
Municipality.
4. Jones agrees that minimum hours of operation of the Kincardine Visitor
Information Centre shall be:
(1) January, February. March, April, -11:00 a.m. to 3:00 p.m. (Tuesday to Saturday)
(2) May, June, July, August and September 1" to 15" - 9:00 a.m. to 6:00 p.m. (seven days per
week);
(3) September 16" to 30", (seven days per week) from 11:00 a.m. to 3:00 p.m. and October,
November and December, 11 :00 a.m. to 3:00 p.m. (Tuesday to Saturday)
Jones will be responsible for the provision of adequate staffing to suit this
service.
5. The Municipality aCknowledges that the Kincardine Visitor Information Centre will
be closed for the first week in February, each year on condition that the
submission of the annual events calendar to visitor' guides, as well as any other
publications has been completed.
6.
Jones agrees that tourism is to be the number one priority, that only items
approved by the Tourism Committee may be displayed or sold at the Kincardine
Visitor Information Centre and no business, other than tourism, may be
conducted at the Kincardine Visitor Information Centre.

7. The responsibilities associated with service are outlined in Appendix "B",
attached hereto and forming part of this agreement.

other costs to be paid by the Municipality shall include:
a) all grounds maintenance, capital expenditures, utilities and other costs
approved by the Tourism Committee.
b) the purchase and maintenance of all office fumiture, office equipment and
paper supplies.
c) the provision of property and liability insurance coverage on the building.
d) the Municipality will reimburse Jones for costs associated with the
provision of Worker's Compensation requirements upon presentation of
receipts.
9. Jones shall report to the Clerk and be accountable to the Council of the
Municipality of Kincardine.
10. The term of this agreement shall be from January 1, 2002 to December 31,
2003. Upon written agreement by both parties, this contract may be extended
for a further period of one year, ending December 31, 2004.
11. Either party may terminate this agreement within sixty (60) days written notice to
each other.
12. It is hereby agreed that correspondence between the two parties shall be

13. This Agreement shall inure to the benefit of and be binding on the respective
heirs, executors, administrators, successors and assigns of the parties hereto.
IN WITNESS WHEREOF the Municipality has hereto affixed its corporate seal attested
by the hands of its Mayor and Clerk this 12th day of December, 2001. Jones has
hereunto set her hand this 11th day of December, 2001.

TOURISM CONSULTANT
THE CLERK
To follow-up on initiatives and directives of council arising from
the development of tourism and marketing strategies to make
the new Municipality of Kincardine a tourist destination; and, to
effectively and efficiently manage the Kincardine Visitor
Information Centre.
Manage and operate the Municipality of Kincardine Visitor
Information Centre, hours of operation as determined by
Council.
As such will prepare statistical data, reports and mailing lists for
Council. Maintain "visitor log" of all visitors to the Kincardine
Visitor Information Centre; such log to include origin of visitor
and destination of visitor and visitors by e-maillphone/fax.
As such will oversee all satellite tourist information sites
including but not limited to: the Kincardine News kiosk, the
Reunion Station kiosk, the Airport kiosk, the Harp & Whistle
kiosk, the Beer Store kiosk, the BNPD Info Centre display,
Municipal Offices, Walker House; Lighthouse;Bluewater
Plahouse Box Office, Arts Facility entrance; Tiverton Merchants;
Underwood Merchants; and other sites as directed.
As such will compile Events Information and other information
useful to the visitors to the Municipality and assist in the
preparation of the annual tourist guide.
As such will maintain, in conjunction with the Recreation
Department, an up-to-date directory listing of all municipal
service clubs, recreation program groups and other community
services. This directory shall be maintained at a current status.
Serve as an information clearing house on tourism for council
for all local events and initiatives and all county, regional, and
provincial events and initiatives.
As such, shall attend meetings and participate in Lake Huron
Shoreline Tourism Group on behalf of the municipality as an
appointee at large for Kincardine.
Maintain liaison with Bruce County Tourism, Grey Bruce Owen
Sound Tourism, SOTO, and Tourism Ontario.

3.0 Will co-ordinate all advertising with regard to tourism events and
initiatives on behalf of the Municipality.
3.1 Will attend to the website of the Municipality as it effects tourism
in the Municipality, by way of maintaining the site's up-to-date
status and keep current such links (Le., sunsets.com) as
needed and shall update and maintain the Municipal website on
direction from the Clerk.
4.0 Shall act as principle liaison with the Chambers of Commerce
and Tourism Offices in Kincardine and District as well as Port
Elgin and others as necessary to ensure a good exchange of
. information and CO-Ordination, as much as possible.
4.1 Shall co-ordinate lines of communication between the
Municipality and such groups as Event Committees and assist
with the promotion of such events.
5.0 Bring to the attention of the Tourism Committee promotions,
funding opportunities, advertising, events and initiatives/ideas
and opportunities that may be worthy of consideration of
Council.
5.1 As such, should attend meetings, conferences and seminars as
deemed appropriate by the Clerk, in order to remain current
with tourism trends.
6.0 Encourage the development of effective marketing links with
area tourism and attraction operators. Le. golf courses,
restaurants, tour packaging, bed and breakfast
accommodations, cottages listings.
. 7.0 Provide secretarial support services for the Tourism
Committee.
8.0 other responsibilities as required.
