HomeMy WebLinkAbout14 016 Amend Zoning Part of lot 22 concession a geographic township of kincardine donald james & connie bernice morrison c/o ian maclaren THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE yK- KBTy y x, ,may / C /pgLITY OF OW BY -LAW No. 2014 — 016 BEING A BY -LAW TO AMEND ZONING BY -LAW NO. 2003 -25, BEING THE COMPREHENSIVE ZONING BY -LAW FOR THE MUNICIPALITY OF KINCARDINE Donald James Morrison and Connie Bernice Morrison Part of Lot 22, Concession `A', Municipality of Kincardine (geographic Township of Kincardine) • WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by -laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has enacted By -law 2003 -25, a zoning by -law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend By -law 2003 -25; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By -law No. 2003 -25 as amended, is hereby further amended by changing thereon from `R1 -p' and `EP' to `R1 -bd' and `EP' the zoning designation of those lands described as Part of Lot 22, Concession `A', Municipality of Kincardine (geographic Township of Kincardine) as shown on the attached • Schedule 'A'. 2. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for the Municipality of Kincardine, is hereby further amended by adding the following paragraph to Section 12.3 thereof: 12.3.55 Notwithstanding their `R1' zoning designation, those lands delineated as `R1 -bd' on Schedule `A' to this By -law may be used for `Residential' purposes in compliance with the `R1' zone provisions contained in this By -law, excepting however, that: (i) Prior to development, alteration, expansion, or additions to existing buildings or structures a limited service agreement shall be entered into with the Municipality. (ii) The front lot line shall be the west lot line, being the line dividing the property from the Marine Shore Road Allowance. (iii) The Front Yard (Minimum) to buildings and structures, shall • be 0.5 metre. (iv) The Exterior Lot Line shall be the line(s) delineating the Samona Beach Lane right -of -way; (v) The Exterior Side Yard (Minimum) shall be 3.0 metres; Page 2 Amendment to Comprehensive Zoning By -law 2003 -25, Part of Lot 22, Concession `A', Municipality of Kincardine (geographic Township of Kincardine), By -law By -law No. 2014 — 016 • (vi) Subsection 6.24.4, related to unenclosed porches, unenclosed fire escapes, balconies, covered or uncovered steps, does not apply; (vii) The setback from the front lot line for a sewage disposal system shall be not less than 3 metres. 3. This By -law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 4. This By -law may be cited as the "Amendment to Comprehensive Zoning By -law 2003 -25, Part of Lot 22, Concession `A', Municipality of Kincardine (geographic Township of Kincardine), By -law ".
