THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2001 - 79
A BY-LAW TO AMEND ZONING BY-LAW NO. 82-08, BEING THE
COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY OF KINCARDINE
(VOSKAMP, PART LOTS 17 & 18, CONCESSION 4, KNOWN MUNICIPALLY AS 735
CONCESSION 5) FORMER TOWNSHIP OF KINCARDINE
WHEREAS Section 34 ofthe Planning Act, R.S.O 1990, Chapter 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws which comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has
enacted By-law 82-08, a Zoning By-law enacted under Section 34 of the said Planning
Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
desires to amend By-law 82-08;
NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine
ENACTS as follows:
1. Schedule 'A' to By-law No. 82-08 as amended, is hereby further amended by
changing thereon the zoning designation of Part of Lot 17 & 18 Concession 4 (former
Township of Kincardine) from A1-2000-903a to A1-2001-79 and part of A1-2000-93b to
A1-2001-79 as shown on Schedule 'A' attached hereto.
2. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law for the
Township of Kincardine, is hereby further amended by adding the following paragraph
to subsection 9.3 thereof:
Notwithstanding their 'Rural-A' zoning designation, the lands delineated as
'A1-2001-79' on Schedule 'A' to this By-law may be used for rural
residential purposes in accordance with the 'Rural-A' zone provisions
contained in this by-law, excepting however that:
(i) the 'maximum lot area' shall be 1.66 ha (4.11 acres)
(ii) all future development must comply with the requirements of the
by-law
(iii) no intensive livestock operations (over 150 livestock units or 1.5
livestock units per tillable acre) shall be permitted.

3. This By-law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions ofthe Planning Act, R.S.O. 1990.
4. This By-law may be cited as the "Amendment to By-law 82-08 (Lot 17 and
Lot 18, Concession 4 <former Township of Kincardine>)'.
READ a FIRST and SECOND time on this 20th day of June 2001.
READ a THIRD time and DEEMED TO BE PASSED this 27th day of June 2001.
