HomeMy WebLinkAbout14 009 Part Lot Control Exemption for part of lot 132 and lots 133 to 135 and part of lot 136 plan 3M-98 being parts 1 to 13 reference plan 3R-9528 THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT . 3 ; . 11111 �'� f :rt I Li BY -LAW No. 2014 - 009 BEING A BY -LAW TO REMOVE CERTAIN LANDS FROM PART LOT CONTROL WHEREAS Subsection 50(7) of the Planning Act, R.S.O 1990 permits Councils of local municipalities to exempt lands, within a plan of subdivision, from the requirements of Subsection 50(5) of said Act; • AND WHEREAS the owner of Part of Lot 132 and Lots 133 to 135 and Part of Lot 136, Plan 3M -98 (being Parts 1 to 13, Reference Plan 3R -9528, Municipality of Kincardine (geographic Town of Kincardine) County of Bruce, has made application to the Municipality of Kincardine to remove part lot control from those lands; NOW THEREFORE the Council of the Municipality of Kincardine ENACTS as follows: 1. That Subsection 50(5) of the Planning Act shall not apply to those parts of the plan of subdivision described as follows: i) Part of Lot 132 and Lots 133 to 135 and Part of Lot 136, Plan 3M -98 (being Parts 1 to 13), Reference Plan 3R -9528; in particular, the following parcels: a. Part of Lots 132 and 133, Registered Plan 3M -98, being Parts 1 and 2, Registered Plan 3R -9528; Together with an easement over Part of Lot 133, Lots 134, 135 and Part of Lot 136, being Parts 8, 9, 10, 11, 12 and 13, Registered Plan 3R -9528; b. Part of Lots 133 and 134, Registered Plan 3M -98, being Parts 3, 4, 10 and • 11, Registered Plan 3R -9528, Together with an easement or easements over Part of Lot 134, Lot 135 and Part of Lot 136, being Parts 8, 9, 12 and 13, Registered Plan 3R -9528; and Subject to an easement over Part of Lots 133 and 134, being Part 10 and 11, Registered Plan 3R -9528 c. Part of Lot 134 and 135, Registered Plan 3M -98, being Parts 5, 6, 12 and 13, Registered Plan 3R -9528, Together with an easement or easements over Part of Lots 135 and 136, being Parts 8 and 9, Registered Plan 3R -9528; and Subject to an easement or easements over Part of Lots 134 and 135, being Part 12 and 13, Registered Plan 3R -9528; d. Part of Lots 135 and 136, Registered Plan 3M -98, being Parts 7, 8 and 9, Registered Plan 3R -9528; Subject to an easement or easements over Part of Lots 135 and 136, being Parts 8 and 9, Registered Plan 3R -9528. 2. This By -Law shall come into force and effect upon approval by the County of Bruce. 3. Upon approval of the By -law by the County of Bruce, the Clerk of the Municipality of Kincardine is hereby instructed and authorized to register this By -law in the Land Registry Office for Bruce County. /2 Page 2 Part Lot Control Exemption for Part of Lot 132 and Lots 133 to 135 and Part of Lot 136, Plan 3M -98 (being Parts 1 to 13, Reference Plan 3R -9528) • By -law No. 2014 - 009 4. This By -law shall expire within three (3) years from the date of passage of the By -law. 5. This By -law may be cited as the "Part Lot Control Exemption for Part of Lot 132 and Lots 133 to 135 and Part of Lot 136, Plan 3M -98 (being Parts 1 to 13, Reference Plan 3R- 9528) ".
