HomeMy WebLinkAbout01 112 amend 76-13 lt 21 con 11 e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW No. 2001 -112 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 76-13, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE (FORMER) TOWNSHIP OF BRUCE (ELDERSLlE FARMS LTD. LOT 21, CONCESSION 11), MUNICIPALITY OF KINCARDINE WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Township of Bruce has enacted by-law 76-13, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Corporation oUhe Township of Bruce has restructured to now be a part of the Corporation of the Municipality of Kincardine; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend by-law 76-13; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to by-law No. 76-13 as amended, is hereby further amended by changing thereon from 'Rural-A' to 'A-55a', 'A-55b', and 'H' the zoning designation of those lands described as Lot 21, Concession 11, Municipality of Kincardine (former Township of Bruce) which are outlined on the attached Schedule 'A'. 2. By-law No. 76-13, as amended, being the Comprehensive Zoning by-law for the T.ownship of Bruce, is hereby further amended by adding the following paragraphs (ak) and (al) to subsection 5.11 thereof: (ak) Notwithstanding their 'Rural-A' zoning designation, the lands delineated as 'A-55a' on Schedule 'A' to this by-law may be used for rural residential purposes in accordance with the 'Rural-A' zone provisions contained in this by-law, excepting however that: (i) the 'maximum lot area' shall be 3.49 ha (8.64 acres) (ii) all future development must comply with the requirements of the by-law (Hi) no intensive livestock operations (over 150 livestock units or 1.5 livestock units per tillable acre) shall be permitted. e e e e By-Law No. 2001 -112 Amendment to Comprehensive Zoning by-law 76-13, By-law (Lot 21, Concession 11, Ward 3) (former Township of Bruce) Page 2 (al) Notwithstanding their 'Rural-A' zoning designation, the lands delineated as 'A-55b' on Schedule 'A' to this by-law shall be used in accordance with the 'Rural-A' zone provisions contained in this by- law excepting however that: (i) no residential buildings or residential structures shall be permitted. 3. This by-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 4. This by-law may be cited as the "Amendment to Comprehensive Zoning by-law 76-13, By-law (Lot 21, Concession 11, Ward 3) (former Township of Bruce) READ a FIRST and SECOND time this 19th day of September, 2001. READ a THIRD TIME and DEEMED TO BE PASSED this 26th day of September, 2001. Lot 21, Concession 11 Municipality of Kincardine, County of Bruce . Subsection 34(23.1) of the Planning Act provides; (23.1) If all appeals to the Municipal Board under subsection (19) are withdrawn and the time for appealing has expired, the secretary of the Board shall notify the clerk of the municipality and the decision of the council is final and binding. I am writing to advise that the appeal by the County of Bruce was withdrawn by letter dated August 13, 2003. There are no_out_standing appeals in this matter, and our file is closed.
