THE CORPORATION OF THE TOWNSHIP .,oF KINCARDINE :..--.- · BY-LAW NUMBER 86-24 A BY-LAW TO ENTER INTO AN AGREEMENT WITH BRUCE COUNTY FOR EMERGENCY RESCUE PROGRAM WHEREAS Paragraph 1, Section 208 of the Municipal Act, R.S.O. 1980, Chapter 302, authorizes the councils of all municipalities to enter into an agreement with other municipalities for the use of fire-fighting equipment or any of it: AND WHEREAS The Corporation of the County of Bruce has negotiated agreements with other municipalities establishing a County wide emergency rescue program; AND WHEREAS The Township of Kincardine deems it expedient to establish a Bruce County Rescue Support System and to provide for regulations governing its operation; · NOW THEREFORE the Council of the Corporation of the Township of Kincardine enacts as follows: 1. (a) That the Township of Kincardine enter into an emergency rescu~ program with the County of Bruce. 2. ~ . . "' . A Committee of Local Municipal Fire Chiefs and Municipal Representatives shall be formed. This Committee shall be named the County of Bruce Rescue Support Advisory Committee with membership and responsibilities as defined in Schedule "1" attached to the ó-I!greement forming part of this By-law. · 4. Eskr C erk-Treasure Township of Kincardine ¡ /" I' f' . eGREEMeT . ,.. >' ~ CORPORATION OF THE COUNTY OF BRUCE, herein referred to as the 'COUNTY' OF TBB PIRST PART . - and - Township of Kincardine herein referred to as the 'Municipality" OP TBB SECOND PART WHEREAS the County has purchased vehicles and equipment to augment existing fire fighting and rescue services in the County of Bruce: AND WHEREAS by the prov1s10ns of the Municipal Act. R.S.O. 1980, Chapter 302, the County now wishes to enter into an agreement with the above named party of the Second Part concerning the maintenance, control and responsibility for certain firefighting and rescue equipment; NOW WITNESS THAT in consideration of the mutual covenants contained herein and other good and valuable consideration the parties hereto agree as follows: . 1. The provisions of this agreement may be varied from time to time by agreement in writing signed by both of the parties of this agreement. 2. Should this County Rescue System Agreement be amended or alterett all equipmemt originally committed by the County, and any balance of revenues shall be reallocated to the local municipalites referred to in schedule '1' based on a recommendation of the Rescue Support Advisory Coma1ttee to County Council. 3. All rescue services within the jurisdiction of the Municipality shall be rendered by the Municipality through the existing Municipal Pire Department. 4. This agreement may be terminated upon written notice given to either party thereto by the other within six (6) months of the proposed termination date save haraless. 5. It is agreed by all parties to this Agreement that the County shall not be responsible for any damages which may result from the use of this equipment and the participating Municipalities agree to indemnify the County if the County is called on to pay any such damages. . 6. It is agreed that sschedules 1, 2 and 3 and appendices A to G form part of this agreement and are binding on the Parties hereto. 7. The County of Bruce Rescue Support Advisory Committee shall consist of: A) The Fire· Chiefs from each of the five MUnicipalities at which the rescue vehicles are housed. i.e.: Unit 11 - Township of St. Edmunds Unit 12 - Town of Wiarton Unit 13 - Town of Port Elgin Unit 14 - Town of Kincardine and Township of Kincardine Unit IS - Village of Mildmay and the Township of Carrick B) The Co-ordinator of the Bruce County Mutual Aid Association. C) Two Fire Chiefs from the Bruce County Fire Chiefs Association. in addition to the Chiefs of the departments referred to in paragraph (A) above. D) Three representatives from Bruce County Council. 2. The following shall be ex-officio members of the Committee a) A representative from the Provincial Fire Marshal's Office. b) The Clerk or Deputy Clerk of the County of Bruce who will act as Secretary of this Committee. 3. The Fire Chiefs may designate their Deputy Chiefs to attend meetings in their absence. 4. The Committee will elect a Chai~n and Vice-Chairman bi- annually. 5. Minutes of meetings will be distributed to members of the Committee. 6. The Committee will make recommendations on all expenditures which will then be submitted to County Council for approval. 7. The Committee shall determine its own procedure and shall meet from time to time as agreed or at the call of the chair- man. ., , e . . . ,I' - ,.0, SCHEDULE .. 2" . County respcnsibilities shall be: 1. Bruce County Council at its first regular meeting of each year shall appoint three members to the County of Bruce Rescue Support Advisory Committee. 2. The County of Bruce shall provide emergency rescue equipment as listed on Appendix I-AU. 3. All funds raised for the purpose of establishing a County Rescue Support System shall be administered by the County Clerk-Treasurer or his Deputy. In the event of a dispute concerning the disposition of any funds held by the said treasurer as a result of the rescue program, the Council of the County of Bruce shall be the final arbritator as to the disposition of such funds. . . . .-'" . . . . / . . . . SCHEDULE "3" Municipal responsibilities shall be: 1. To provide emergency rescue services within its jurisdiction. 2. To commit emergency equipment as listed in the attached Appendices "B-F" for the purpose of providing a Bruce County Rescue Support System. 3. To house the rescue vehicles and aaintain them in good running order and ready for immediate response including provision for all maintenance costs and adequate levels of insurance. 4. To deliver the rescue equipment and a minimum of two trained fire fighters to an emergency in response to any call that cannot be handled by the local municipal fire department. The local departments are to be called for initial service. 5. Initial response and call for assistance procedure shall be as follows: a) When a Fire Department is advised of an emergency and that its assiatance is required, the Department will respond with available equipment which will include a pumper and crew. b) Upon arrival or while working on the emergency. if additional equipment is required. the Fire Chief or Fire Officer in charge of the operation will call the designated backup Fire Department. The Bruce County Fire Co-ordinator will be notified that the County Rescue Support System has been i~plemented. 6. Authorization to respond outside the designated area or County will be at the discretion of the municipal Fire Chief or his designate. 7. Non~emergency use of the equipment may be permitted on the authority of the municipal Fire Chief or his designate. 8. The municipal fire Department shall complete a response report and fire department report. A copy of the response report -shall be kept by the municipal fire department -shall be sent to the Fire Chiefs Rescue Support Committee -shall.be sent to the Office of the Fire Marshall If the incident occurs on a Provincial highway, the fire department having jurisdiction shall subait a rescue claim to the Ministry of Transportation and Communications. Upon receipt of the claim, funds shall be distributed as per the direction of the Bruce County Rescue Support Advisory . Committee. 9. All committed equipment will re..in in the designated municipality under the control of the established fire department. 10. All equipment may be used by the Municipality or by the Bruce County Fire Co-ordinator as required. The Bruce County Fire Co-ordinator shall be appointed froa ti8e to tiae by Provincial Order-in-Council. 11.
