THE CORPORATION OF THE TOWNSHIP OF KINCARDINE

A By-Law to authorize the Head of Council
and Clerk to sign a Quit Claim Deed releasing
Lot 60, Plan 819 in the Township of Kincardine
in the County of Bruce from the terms of a
Subdivision Agreement
I The following are some of the facts upon which this by-law is
based.
1. The Corporation of the Township of Kincardine,
hereinafter referred to as "the Township" entered
into an Agreement with Huron Ridge Limited, which
Agreement was registered in the Registry Office
for the Registry Division of Bruce (No.3) as
instrument #71680.
2. The said Agreement was a Subdivision Agreement and
it charged the land against which it was registered
with the development of the property.
3. Included in the land so charged was the whole of
Lot 60, Plan 819 in the Township of Kincardine in
the County of Bruce.
4. The said Agreement was partially released by a
release registered on December 17, 1971 as
instrument #90484.
5. The Owner of Lot 60, Plan 819 has requested that
the Township give a complete release of all
claims against the property and the Township has
agreed to do so by delivering to the Owner a
Quit Claim Deed releasing all of its claims against
Lot 60, Plan 819.
THE CORPORATION OF THE TOWNSHIP OF KINCARDINE BY ITS MUNICIPAL
COUNCIL THEREFORE ENACTS AS FOLLOWS:
1. The Head of Council and Clerk are hereby authorized
to sign a Quit Claim Deed releasing Lot 60, Plan 819
in the Township of Kincardine in the County of Bruce
from all claims of the Township arising out of the
Subdivision Agreement registered as instrument
#71680, to impress the corporate seal thereon, and
to deliver the said Quit Claim Deed to the Owner
of the property.

hereinafter referred to as the Party
OF THE FIRST PART
-and-
JAMES TIMOTHY BOS
hereinafter referred to as the Party
OF THE SECOND PART
The following are some of the facts upon which this Quit Claim Deed
is based.
In consideration of other valuable consideration and the sum of ONE
DOLLAR ($1.00) of lawful money of Canada paid by the said Party of
the Second Part to the said Party of the First Part the receipt of
and sufficiency of which is hereby acknowledged the Party of the
First Part hereby grants, releases, and quit claims unto the said
Party of the Second Part, his heirs, executors, adminstrators,
succesors and assigns forever all the estate, right, title,
interest, claim and demand howsoever both at law and in equity or
otherwise howsoever and whether in possession or expectancy of the
said Party of the First Part of or in to or out of all and singular
that certain parcel or tract of land and premises situate lying and
being in the Township of Kincardine in the County of Bruce and
being composed of the whole of Lot 60 according to registered plan
819 for the said Township of Kincardine.
TOGETHER with the appurtenances thereunto belonging or appertaining
thereto.
TO HAVE AND TO HOLD the aforesaid lands and premises with all and
slngular the appurtenances thereto belonging or appertaining unto
and to the use of the said Party of the Second Part his heirs,
executors, administrators, successors and assigns forever.
