HomeMy WebLinkAboutTWP 98 028 Formulate Pl-Protect . , "- ,- ~ CORPORATION OF THE TOWNSHIP OF KINCARDINE BY-LAW 98-28 BEING A BY-LAW formulating a plan for protecting property and the health, safety and welfare of the inhabitants in any emergency area. WHEREAS the Province of Ontario has passed an Act which provides for the Formulation and Implementation of Emergency Plans (Short Title - The Emergency Plans Act, 1983) by the Council of a Municipality: AND WHEREAS this Act makes provision for Head of Council to declare that an emergency exists in the municipality or in any part thereof and also provides Head of Council with authority to take such action or deliver such orders as he considers necessary and are not contrary to law to implement the emergency plan of the municipality and to protect property and the health, safety and welfare of the inhabitants of an emergency area; AND WHEREAS the Act provides for the designation of one or more members of Council who may exercise the powers and perform the duties of the Head of Council during his absence or his inability to act; AND WHEREAS the Act authorizes employees of a municipality to take action under the emergency plans where an emergency exists but has not yet been declared to exist; NOW THEREFORE the Council of The Corporation of the Township of Kincardine enacts as follows: 1. That the Emergency Plan entitled, 'Municipal Emergency Plan for the Township of Bruce and the Township of Kincardine Revision 4, 4th October, 1998' on file in the Municipal Office, comes into effect 13th November, 1998 after it is executed. 2 . That the 'Municipal Emergency Plan for the Township of Bruce and the Township of Kincardine and the Village of Tiverton Revision 0, November 1994' is hereby declared obsolete and is replaced by the 'Municipal Emergency Plan for the Township of Bruce and the Township of Kincardine Revision 4, 4th October, 1998' t 3. That the Reeve and Clerk be authorized to sign the new plan on behalf of Kincardine Township. 4. That the Head of Councilor designated alternate as provided in the Plan is empowered to declare an emergency; 5. That certain appointed officials or their designated alternates as provided in the Municipal Emergency Plan are empowered to cause an emergency alert to be issued to members of the Municipal Control Group and to take action under the emergency plans where an emergency exists but has not yet been declared to exist; and 6. That annually, the Municipal Control Group will cause the emergency plan to be reviewed and to make such changes to the Emergency Notification Fan-Out and Emergency Telephone and Resource Directory as are considered appropriate while referring all other changes to Council for further review and approval. . ,,'·iN' ~"'" , . The combined Municipal Emergency Plan (Revision 4) for the Township of Bruce and the Township of Kincardine is approved by Bruce Township By-law No. 98-50 and Kincardine Township By-law No. 98-..<g, "a by-law formulating a plan to safeguard the health, safety, welfare and property of the citizens in the community". The Plan has been prepared to provide key officials, agencies and departments within Bruce Township and Kincardine Township, the Bruce Nuclear Power Development, and Bruce County, with a general guideline to the expected initial response to a Municipal emergency, and an overview of their responsibilities during an emergency, Any emergency situation is unique, so that it is not possible to precisely define the actions required by any local, County, or Provincial agency who may be involved in emergency response. It is important, then, that the elements ofthis Plan be implemented with common sense recognizing the situation at hand and the capabilities of those agencies involved. If this Emergency Plan is activated, the resources of both Municipalities are placed under the direction of the Municipal Control Group. . Non-recoverable costs are shared equally amongst all parties. For this Plan to be effective it is important that all concerned be made aware of its provisions and that every official, agency and department be trained and prepared to carry out their assigned functions and responsibilities to the best of their ability in an emergency.
