THE CORPORATION OF THE TOWNSHIP OF KINCARDINE BY-LAW NO. ?8 -,.;?t") A BY-LAW TO AMEND BY-LAW NO. 82-08, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE CORPORATION OF THE TOWNSHIP OF KINCARDINE The Council of the Corporation of the Township of Kincardine, pursuant to Section 34 of the Planning Act, 1990, ENACTS as follows: 1. That By-law 98-14 is hereby repealed. 2. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for the Corporation of the Township of Kincardine, as amended, is hereby further amended by adding the following subsection to Section 20.4 thereof: "20.4.1 Notwithstanding their 'C2' zoning designation, those lands designated as 'C2- 9g -dO -h' on Schedule 'A' to this By-law, may be used in compliance with the C2 zone provisions contained in this by-law, excepting however, that: i) ii) iii) Section 6.13 (a) Watercourse Setbacks, shall not apply; "lot area" shall be defined as the total horizontal distance within the lot lines of a lot; and, that the "sale of used cars and light trucks" be a permitted use. 2. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for the Corporation of the Township of Kincardine, as amended, is hereby further amended by adding the following subsection to Section 3104 thereof: 30 Notwithstanding their 'EP' zoning designation, those lands designated as 'EP- 9fJ-,.2o 'on Schedule 'A' to this By-law, may be used in compliance with the EP zone provisions contained in this by-law, excepting however, that: i) open storage accessory to a permitted use within the C2 zone shall be permitted. For those lands identified as being within the 'C2- 99 -,d? ð -h' zone, Council may consider removing the '-h', in accordance with the Planning Act, R.SoOo, 1990, once an appropriate site plan demonstrating how the property will be developed and measures to be used to ensure a minimal impact on the surrounding residential uses is submitted and accepted by the Council. "31.4.2 Schedule 'A'to By-law No. 82-08, as amended, is hereby further amended by changing thereon from 'C1' and 'A2'to 'C2- 9$ -,,?t:J -h' and "EP- 98 ,.. .lð 'the zoning designation of Part of Lot 21, Concession 1, Parts 2, 3, and 4, Plan 3R- 6777, Township of Kincardine, as shown outlined in the heaviest broken line on the attached Schedule 'A'. 50 This By-Law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, 19900 READ A FIRST AND SECOND TIME THIS ¿-d.
