THE CORPORATION OF THE TOWNSHIP OF KINCARDINE
BY-LAW NO. 93-10
(INVERHURON - OPA .65)
A BY-LAW TO AMEND BY-LAW NO. 82-08, AS AMENDED
BEING THE COMPREHENSIVE ZONING BY-LAW OF
THE CORPORATION OF THE TOWNSHIP OF KINCARDINE
The Council of the Corporation of the Township of Kincardine
pursuant to Section 34 of the Planning Act, 1983, ENACTS as
follows:
1. By-Law No. 82-08, as amended, being the Comprehensive
Zoning By-Law of the Corporation of the Township of
K i ncard i ne, is hereby further amended by addi ng the
fOllowing Subsection 31.4.1 to Section 31 thereof:
31.4.1
(a) Notwithstanding their 'EP' Zoning
designation, those lands described as Part
of Lots 66 to 70, Concession "A", in the
Township of Kincardine (west side of Lake
Street) and de 1 i neated as ' EP-1 ' on
Schedule "A" to By-Law No. 82-08, may be
used in accordance with the 'EP' Zone
provisions contained in this By-Law,
excepting however that:
i) all legally existing bui ldings and
structures are permitted as they
existed on the date of the passing of
By-Law No. 93-10;
ii) the replacement, renovation or
enlargement of existing buildings or
structures may be permitted provided
that a connection to a municipal
sewer system approved under the
Ontario Water Resources Act is
obtained;
iii) 'Minimum Lot Area' shall be the lot
area as it ex i sts on the date of
passing of By-Law No. 93-10;
iv) the 'Minimum Lot Frontage' shall be
the lot frontage as it exists on the
date of the passing of By-Law No.
93-10;
v) the 'Maximum Bui lding Height' shall
not exceed 1.5 storeys or 20 feet
above grade whichever is the lesser;
vi) for the purposes of this paragraph,
Section 6.5 of By-Law No. 82-08 shall
not apply as it relates to lots
front i ng upon a street wi th a
perpendicular width of less than 66
feet;
vii) for the purposes of this paragraph,
Section 6.13 and Section 6.29 of By-
Law No. 82-08, shall not apply;

viii)for the purposes of this paragraph,
where there is an established
building line extending on both sides
of the lot, a building or structure
may be erected closer to the easterly
lot line, provided such permitted
building or structure is not erected
closer to the easterly lot line, than
the established building line on the
date of passing of By-Law No. 93-10;
For the purposes of this clause, the
Building Line will be established
from the perimeter of the dwell ing
unit and shall not include unenclosed
decks or open porches.

ix) the 'Minimum On-Site Parking'
requi rement shall be one space per
dwelling unit, the 'Minimum Width' of
such space sha 11 be 8 feet and the
'Minimum Length' shall be 20 feet;
and
x) no westerly expansion of any existing
buildings or structures shall be
permitted;
xi) northerly or southerly expansion of
the most northerly and southerly
limits of existing buildings or
structures may be permitted provided
that such expansion does not comprise
more than a maximum of 25 percent of
ground floor area of the existing
building or structure, as it exists
on the date of passing of By-Law No.
93-10; or, extend within 4 feet of
the side lot line, whichever is the
lesser.
2. Schedule "A" of By-Law No. 82-08, as amended, is hereby
further amended by changing thereon from 'OS1' to 'EP-1',
the Zoning designation of those lands described as Part of
the Marine Reserve, West side of Lake Street, being Lots
66 to 70 inclusive, Concession "A", (Inverhuron), in the
Township of Kincardine which is shown outlined by the
heaviest black broken line on the attached Schedules "A",
"B" I "C", "D" and "E".
3. By-Law No. 92-32 is hereby rescinded.

4. This By-Law takes effect from the date of passage by
Council and comes into force and effect pursuant to the
provisions of the Planning Act, 1983.
