THE CORPORATION OF THE TOWNSHIP OF KINCARDINE BY-LAW H 93-27 A By-Law to set Policy defining the location, post size, and replacement of mailboxes on any Township Road under the jurisdiction of Kincardine Township. WHEREAS the Council of the corporation of the Township of Kincardine deems it necessary to set a policy defining the location, post size, and replacement of mailboxes. Now Therefore the Corporation of the Township of Kincardine enacts as follows: 1. That the Policy defining the location, post size, and replacement of mailboxes shall be as described in schedule "A" and forming part of this By-Law. 2. This By-Law takes effect from the date of final passage by the Council of Kincardine Township. 3. This By-Law shall be cited as the "Mailbox Policy" By-Law. SCHEDULE "A" By-Law 93-27 ;¡ ., ¡¡ f! POLICY DEFINING MAILBOX LOCATION. POST SIZE AND REPLACEMENT. 'I 1. LOCATION The box shall be erected so that the bottom of the box is 3 feet, 6 inches above the shoulder of the road. The face of the box shall be not less than 2 feet from the edge of pavement or travel portion of the road. (! 2. POSTS Only wooden posts shall be used on any Township Road under the jurisdiction of Kincardine Township to support a rural mailbox. Posts shall not have a top greater than 6 inches in diameter. Barrels and concrete or metal posts are not permitted on a Township Road as support for a mailbox. 3. MULTIPLE BOXES They shall only be erected under the authority of an encroachment permit and shall: - i. ¡¡ ¡¡ i¡' ( i ) Not cause snow to drift onto the roadway; and Not hinder snow plowing operations; and Be located at least IO feet from the edge of the pavement, and 125 feet from an intersection, and Located so that their use does not hinder or impede traffic using the roadway. (i i) ( i i i ) ( iv) n The Township Council may, for special conditions, approve exemptions to these requirements. H '1 , 4. CONSTRUCTION The Township Roads Department, when re-constructing a municipal road, will remove all mailboxes on that road. The Township will be responsible for erecting them when the road construction work is completed. , ;] ; ~ :J I I , 'I I 'i ~ ¡ 'I .I ,I , ~ 5. RESPONSIBILITY The Township accepts no responsibility for boxes other than metal regulation boxes, improperly erected mail boxes, or boxes located on roads under the jurisdiction of another governing body. DAMAGE If the post is in good shape and is damaged by the Township plowing operations, the Township will supply the owner with a new 8 foot post with top of 5 inches or more, installation to be by the owner. If the post is old and rotten, total replacement will be at the owners expense. If a box is damaged, by Township plowing operations, Township forces will straighten it. In cases where there are elderly people who are too sick and feeble to repair and/or replace the post and box, the Township will do the necessary repairs and installation.
