HomeMy WebLinkAbout13 077 Amend Zoning west of huron road 2068140 ontario ltd and meat consultants international c/o david brown THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE [, KBT� • ' it 0. vier ,' � N �(IlY OF KMGP� BY -LAW No. 2013 — 077 BEING A BY -LAW TO AMEND ZONING BY -LAW NO. 2003 -25, BEING THE COMPREHENSIVE ZONING BY -LAW FOR THE MUNICIPALITY OF KINCARDINE 2068140 Ontario Ltd. and Meat Consultants International Inc., Block `Q' and Part of Block `A', Registered Plan 3M -98, and Part of Park Lot 8, West Huron Road, Municipality of Kincardine (geographic Town of Kincardine) • WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by -laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has enacted By -law 2003 -25, a zoning by -law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend By -law 2003 -25; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By -law No. 2003 -25 as amended, is hereby further amended by changing thereon from `M1' and `EP' to `R1', `R3 -r', `R4 -n', `OS', 'EP-s' and `EP' the zoning designation of those lands described as Block `Q' and Part of Block • `A', Registered Plan 3M -98, and Part of Park Lot 8, West Huron Road, Municipality of Kincardine (geographic Town of Kincardine) which are outlined on the attached Schedule 'A'. 2. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for the Municipality of Kincardine, is hereby further amended by adding the following paragraphs to subsection 14.3 thereof: 14.3.17 Notwithstanding their `R3' zoning designation, those lands delineated as `R3 -r' on Schedule `A' to this By -law may be used for `R3- Residential Three' purposes in compliance with the `R3' zone provisions contained in this By -law, excepting however, that: (i) The lands shall be subject to Site Plan Control; (ii) The Residential Uses shall also permit two attached triplex dwellings divided vertically by a fire separation wall, each triplex dwelling having an independent entrance either directly from the outside or through a common vestibule in • accordance with subsection 14.2.1; Page 2 of 3 Amendment to Comprehensive Zoning By -law 2003 -025 Block `Q' and Part of Block 'A', Registered Plan 3M -98, and Part of Park Lot 8, West Huron Road, Municipality of Kincardine (geographic Town of Kincardine) Ill By -law No. 2013 — 077 (iii) Notwithstanding subsections 14.2.1, 14.2.2 and 14.2.3, the Building Height (Maximum) shall be 12 metres, and the Dwelling Unit Floor Area (Minimum) shall be: 35 square metres for a Bachelor Dwelling Unit; 50 square metres for a One Bedroom Dwelling Unit, plus 10 square metres for each additional bedroom in a dwelling unit; (iv) Notwithstanding subsection 6.20.1, one off - street parking space shall be provided for each dwelling unit; (v) The Lot Frontage (Minimum) shall be 20 metres, save and except where individual row dwellings units are on a separate lot (`freehold'); (vi) The lands shall be developed at a density of not less than 25 dwelling units per hectare; • 3. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for the Municipality of Kincardine, is hereby further amended by adding the following paragraphs to subsection 15.3 thereof: 15.3.14 Notwithstanding their `R4' zoning designation, those lands delineated as `R4 -n' on Schedule `A' to this By -law may be used for `R4- Residential Four' purposes in compliance with the `R4' zone provisions contained in this By -law, excepting however, that: (i) The lands shall be subject to Site Plan Control; (h) Notwithstanding subsection 15.2.1, the Building Height (Maximum) shall be 26 metres but not more than eight (8) stories; (iii) Notwithstanding subsection 6.20.1, one off - street parking space shall be provided for each dwelling unit; (iv) The Lot Frontage (Minimum) shall be 20 metres; (v) The lands shall be developed at a density of not Tess than 30 dwelling units per hectare; • 4. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for the Municipality of Kincardine, is hereby further amended by adding the following paragraphs to subsection 34.6 thereof: 34.6.18 Notwithstanding their `EP' zoning designation, those lands delineated as 'EP-s' on Schedule `A' to this By -law may be used for 'EP - Environmental Protection' purposes in compliance with the 'EP' zone provisions contained in this By -law, excepting however, that: (i) One road and stream crossing for access to the property will also be a permitted Non - Residential use, subject to approval of the Conservation Authority under Ontario Regulation 169/06 — Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation. 5. This By -law takes effect from the date of passage by Council and comes into III force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990.
