THE CORPORATION OF THE TOWNSHIP OF KINCARDINE
BY-LAW NO. '16 -d/
A TEMPORARY USE BY-LAW TO AMEND BY-LAW NO. 82-08,
AS AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW
OF THE TOWNSHIP OF KINCARDINE
The Council of the Corporation of the Township of Kincardine, pursuant to Section
34 and 38 of the Planning Act, 1990, ENACTS as follows:
1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for
the Corporation of the Township of Kincardine, as amended, is hereby further
amended by adding the following subsection to Section 9.3 thereof:
"9.3.33
Notwithstanding their 'A1' zoning designation, where lands are
designated as 'A1- 'It -07/ ' on Schedule 'A' to this By-law,
may be used in compliance with the A 1 zone provisions
contained in this by-law, excepting however, that:
i)

a second dwelling may be erected on the lot;
the second dwelling may be a mobile home and shall
only be permitted until July 1, 2006;
the minimum distance between a barn existing on the
date of the passing of this by-law and the second
dwelling shall be 5.4 metres (18 feet); and,
the minimum ground floor area for the second dwelling
unit shall be 38 square metres (409 square feet).
2. Schedule 'A' to By-law No. 82-08, as amended, is hereby further amended by
changing thereon from 'A1'to 'A1- 9¿ -d/ ' the zoning designation of West
Half of Lot 2, Concession 10, in the Township of Kincardine, as shown
outlined in the heaviest broken line on the attached Schedule 'A',
3. This By-Law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planning Act, 1990.
