NO. 2013 - 012
BEING A BY -LAW TO AMEND BY -LAW NO. 2007 -356: BEING A
BY -LAW TO AUTHORIZE THE SIGNING OF AGREEMENTS FOR
RENTAL SPACE AT THE KINCARDINE CENTRE FOR THE ARTS
WHEREAS Section 8 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, provides that the powers of a municipality under this or any other Act
• shall be interpreted broadly so as to confer broad authority on the municipality to
enable the municipality to govern its affairs as it considers appropriate and to
enhance the municipality's ability to respond to municipal issues
AND WHEREAS pursuant to the said Municipal Act, Section 9 provides that a
municipality has the capacity, rights, powers and privileges of a natural person
for the purpose of exercising its authority under this or any other Act;
AND WHEREAS the Municipality of the Kincardine owns the Kincardine Centre
for the Arts located at 707 Queen Street in Kincardine;
AND WHEREAS the Council of The Corporation of the Municipality of
Kincardine, with the passage of By -Law No. 2007 -356, authorized agreements
for the Rental Space at the Kincardine Centre for the Arts;
AND WHEREAS said agreements state that the Municipality of Kincardine
reserves the right to amend the terms and conditions of the agreements upon
mutual agreement between the parties;
• AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it necessary to amend Schedule 'A' of By -law No. 2007 -356;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That The Corporation of the Municipality of Kincardine amend the
agreement with each of the following arts groups:
The Grey- Bruce Woodturners;
The Kincardine Scottish Festival & Highland Games
The Kincardine Theatre Guild
The Bluewater Summer Playhouse
Kincardine Artists Inc.
for the Rental Space at the Kincardine Centre for the Arts by extending the
period of the agreement to December 31, 2013 with the rental rates the
same as in 2012.

2. That the Mayor and CAO be authorized to execute, on behalf of The

Corporation of the Municipality of Kincardine, the amended agreement
with the aforementioned arts groups, attached hereto as Schedule "A" and
forming part of the By -law.
3. That this by -law shall come into full force and effect upon its final passage.
5. This By -law may be cited as the "Kincardine Centre for the Arts Rental
Agreements Amendment By -law".

THIS AGREEMENT made as of the 6th day of February 2013:
BETWEEN:
THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
(hereinafter called the "Municipality ")
OF THE FIRST PART
AND
THE GREY- BRUCE WOODTURNERS
THE KINCARDINE SCOTTISH FESTIVAL & HIGHLAND GAMES
THE KINCARDINE THEATRE GUILD
THE BLUEWATER SUMMER PLAYHOUSE
KINCARDINE ARTISTS INC.
(hereinafter called the "Tenants")
OF THE SECOND PART
WHEREAS the Municipality of the Kincardine owns the Kincardine Centre for the Arts
located at 707 Queen Street in Kincardine;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine, with
the passage of By -Law No. 2007 -356, authorized agreements for the Rental Space at
the Kincardine Centre for the Arts with the Tenants;
AND WHEREAS said agreements state that the Municipality of Kincardine reserves the
right to amend the terms and conditions of the agreements upon mutual agreement
between the parties;
NOW THEREFORE THIS AGREEMENT WITNESSES THAT:
1. That the agreements for the Rental Space at the Kincardine Centre for the Arts,
as authorized by By -law No. 2007 -356, be amended by extending the period of
the agreement to December 31, 2013 with the rental rates the same as in 2012.
IN WITNESS WHEREOF the parties hereto have executed this Agreement forming part
of By -Law No. 2013 - Da. .
