A BY-LAW TO AMEND BY-LAW NO. 82-08,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR
THE CORPORATION OF THE TOWNSHIP OF KINCARDINE
The Council of the Corporation of the Township of Kincardine, ~ pursuant to Section
34 and 38 of the Planning Act, 1990, ENACTS as follows:
1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for
the Corporation of the Township of Kincardine, as amended, is hereby further
amended by adding the following subsection to Section 12.3 thereof:

Notwithstanding their 'R1' zoning designation, where lands are
designated as 'R1- 7l-I';' a' on Schedule 'A' to this By-law,
may be used in compliance with the. R1 zone provisions
contained in this by-law, excepting rever, that:
i) Section 6.13 (a) Watercourse Setbacks, shall not apply;
ii) the minimum lot frontage shall be 30 metres (98 feet);
iii) the minimum lot frontage for a corner lot shall be 35
metres (115 feet);
iv) the minimum lot area shall be 4000 square metres
(43,057 square feet);
v) "lot area" shall be defined as the total horizontal distance
within the lot line of a lot; and,
vi) a building location and elevation site plan, approved by
the Saugeen Valley Conservation Authority and the
Township, shall be required prior to the issuing of a
building permit.
Notwithstanding their 'R l' zoning designation, where lands are
designated as 'R1- 97-/'1 b' on Schedule 'A' to this By-law,
may be used in compliance with the R1 zone provisions
contained in this by-law, excepting however, that:
Section 6.13 (a) Watercourse Setbacks, shall not apply;
the minimum lot frontage shall be 45 metres (150 feet);
the minimum lot area shall be 7000 square metres
(75,450 square feet);
"lot area" shall be defined as the total horizontal distance
within the lot line of a lot; and,
a building location and elevation site plan, approved by
the Saugeen Valley Conservation Authority and the
Township, shall be required prior to the issuing of a
building permit.
Notwithstanding their 'R1' zoning designation, where lands are
designated as 'R1- 9 '}-N c' on Schedule 'A' to this By-law,
may be used in compliance with the R1 zone provisions
contained in this by-law, excepting however, that:

Section 6.13a (a) Watercourse Setbacks, shall not apply;
the minimum lot frontage shall be 20 metres (66 feet);
the minimum lot size shall be 1.5 hectares (3.7 acres);
'10t area" shall be defined as the total horizontal distance
within the lot line of a lot;
"lot frontage" shall be defined as that portion of the lot
which abuts a public street; and,
a building location and elevation site plan, approved by
the Saugeen Valley Conservation Authority and the
Township, shall be required prior to the issuing of a
building permit.

2. Schedule 'A' to i:jy-Iaw No. 82-08, as amended, IS hereby further amendeo LJy
changing thereon from 'PD-2' to 'R1- 97-/"; a', 'R1--,97- / ~ þ', 'R1-
q? - /+ c", and "EP - Environmental Protection" the zoning designation of
Pari of Lots 23 and 24, Concession A, in the Township of Kincardine, as
shown outlined in the heaviest broken line on the attached Schedule "A',
3. This By-Law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planning Act, 1990.
